Ortiz, Ruby Benton, Elaine Benton, Paula Saucedo, Reynaldo Saucedo, Jerry Matlock, Ix)ri Marlo&, Luis Garcia, Enedelia Moreno First item on the agenda: Approval of August 200i minutes. Fred hVillis made motion to accept minutes as read and Jennifer Wright seconded. Motion carried 5-0. Second item on the agenda: The request of Ruby H. Benton for a variance of twenty feet (20) feet of the required twenty-five (25) foot from setback as stated in Section 34 of the City of Plainview Zoning Ordinance to erect a temporm, y 10'X 20' (met~ & canvas) carport in a Single Family Residential 01.-2) Zoning District, and being Lot N17.5'-10 S42.5'-11, Block 2, Titus & Pillow Addition, Plainview, Hale County, Texas and same being 2406 Galveston Street. Ruby Benton and her daughter Elaine Benton are present. Elaine Benton is speaking for her mother. There were three (3) responses received, ~ in favor of granting the ~&riance. According to John Castro, tNs case is unusual since the request is for a temporary metal and canvas carport, not a permanent one. Ray Jameson asked about the reason for the temporary instead of a permanent carport and Elaine Benton stated that her mother is eighty-six (86) years old and she needs some protection from the elements and the reason for the temporary structure is due to lack of finances at this time. Charlene Jones inquired as to how stable this type carport would be and Elaine Benton stated they have an anchor kit with 6 anchors with tie-downs that ~ buried into the ground to hold it down. Ray Jameson asked about what kind of pitch the carport would have in case of a heavy snow and Elaine Benton stated it would be pitched enough that the snow would not accumulate and in addition there are a couple large trees nearby that would provide some wind blockage. Jennifer Wright inquired about the weight of snow on the carport and Elaine Benton stated it would not affect the carport since it has metal rods and pipes in the top of it. Charlene Jones asked if the caq>ort would pose any danger to the neighbors' homes. Elaine Benton stated "Not at all." Max Browning asked if the neighbors were aware the structure would be temporary and John Castro stated that the letters that are sent out to all the neighbors did state it would be a temporary carport and all three responses received were in favor of the carport. Ray Jameson inquired as to what was considered temporary and Elaine Benton stated it was until a more permanent structure could be financially afforded. Fred W'ffiis made motion to grant the variance based on the applicant's age and lack of mobility and on positive neighborhood response. Jennifer Wright seconded. Motion carded 5-0. Third item on the agenda: The request of Luis Garda for a variance of twenty-forar (24) feet of the required twenty-five (25) foot front setback as stated in Section 34 of the City of Plainview Zoning Ordinance to build a 20'X 24' carport in a Single Family Resider~al (R-2) Zoning District, and being Lot 26, Block 1, Titus Addition, Plainview, Hale County, Texas and same being 709 W. 28th Street. Luis Garda is present. There was one response received in favor of granting the variance. Luis Crarcia stated the carport would be made of steel and metal with a concrete foundation so the carport would be sturdy and durable. Max Browning made motion to grant the variance on the basis of being the only logical place to put the c~-orport. Charlene~econded. Motion carried 5-0. 'me3 Fourth item on the agenda: The request of Jun Matlock for a variance for expansion of a non- conforming use of land and structure as stated in Section 35 and 37 of the City of Plainview Zoning Ordinance to enlarge a contractor's storage building in a General Commercial (C-3) Zoning District, and being a Tract of land 94'X190' OUT OF NW/4 &20'X94' STRIP, Block 80, College ITfll Addition, Plainview, Hale County, Texas and same being 2705 W. 7th Street. Jerry Matlock is present to represent Jun Matlock- stating it is his father's building. Jerry Matlock stated he needs a storage building since he cannot store his ceramic tile supplies outside. 1Vmx Browning stated that since it is non-conforming at the present time, it would still be non-conforming if the variance is granted. John Castro stated this is a contractor's warehouse in a C-3 Zoning district and that it can exist there with a Specific Use Permit but since this warehouse has been there for so long, it is grand fathered. The structure is also a non-conforming use of structure because it is using the land and structure in combinatio~ There were two responses received, both in favor of the request. Max Browning asked if the structure would be built with sianilar building materials as the existing structure and Jerry Maflock stated it would conform to the extst/ng building. Fred W'dlis made motion to grant the variance based on neighborhood response and neighborhood character. In addition, it ~ not adversely affect the area. Jennifer Wright seconded. Motion carried 5-0. Fifth item on the agenda: The request of Reynaldo Saucedo for a variance for expansion of a non- conforming structure as stated in Section 35 and 37 of the City of Plainview Zoning Ordinance to enlarge a Single Family Residential structure in a Single Famh~y Residential (R-2) Zoning District, and being Lot 13, Block 8, Montrose Addition, Plainview, Hale County, Texas and same being 1913 E1 Paso. Paula Sauce, do is present. John Castro stated the reason this is non-conforming is because it has a fourteen (14) foot front yard and a twelve (12) foot back yard. Jennifer Wright asked if the materials would match the exLq/ng house and Paula Saucedo stated there would be a concrete foundation and have the same siding as is already present on the house. There were five (5) responses received, all in favor of the variance. Charlene Jones made motion to grant the variance based on positive response from the neighborhood and being the only logical place for the addition and it will not adversely affect the neighborhood. Fred Willis seconded. Motion carded 5- 0. Sixth item on the agenda: The request of Arturo Ortiz for a variance of twenty-one (21) feet six (6) inches of the required twenty-five (25) foot fi~ont setback and one (1) foot of the required five (5) foot side setback as stated in Section 34 of the City of Plainview Zoning Ordinance to build a 23' X 24' carport in a Single Family Residential (R-2) Zoning District, and being Lot 27, Block 2, Hillcrest Addition, Plainview, Hale Com~, Texas and same being 214 SE 10m Street. Armro Ortiz is present. There were 6 responses received, all in favor of the variance. Mr. Ortiz states he wants to pour a two-car concrete driveway with the carport covering only one half of the driveway. Charlene Jones made motion to grant the variance based on positive neighborhood response and this being the only logical place for the carport. Fred Willis seconded. Motion carried 5-0.
