First item on the agenda: Approval of May 200I minutes. Fred Willis made motion to accept
minutes as read and John Bickel seconded. Motion carded 4-0~
Second item on the agenda: BA # 1383, the request of Alberto Aguirre for a variance of twenty-
five (25) feet of the required twenty-five (25) foot front setback as stated in Section 34 of the City of
Plainview Zoning Ordinance to build a 25' X 20' carport in a Single Family Residential (R-2)
Zoning District, and being Lot 5, Unit 4, Block 18, Thunderbird Addition, Plainview, Hale County,
Texas and same being 1317 Navajo Trail. Mr. Aguirre is present. John Castro stated that the only
recommendation staff would make would be to reduce the front portion to twenty-four (24) feet
instead of twenty-five (25) feet, making the entire carport 24' X 20'. There were three (3) responses
received, two (2) in favor of the variance and one (1) against the variance. The comments for the
response against the variance read: 'SI do not like to see deed restrictions broken or set aside. Once
this happens it just opens the door for other things that are against the deed restrictions." Mr.
Aguirre pointed out to the Board that the fence seen in the photo shown of his property does not
belong to him - it is his neighbor's fence. He also points out that he intends to use new material if
thc vahance is approvcc[ It will be a diffcrmt color from the blue trim on the garage door, which
will result in him painting the remainder of the house to match the color of the carport. Ray Jameson
asked Mr. Aguirre if he bad any great problem g~th cutting the carport down one foot to the twemy-
four (24)' instead of the requested twenty-five (25)' and Mr. Aguirre replied he did not. Fred Willis
made motion to approve the variance of 24' of the required 25' making the carport 24' X20' instead
of 25' X 20'. Jennifer Wright seconded the motion. Motion carded unanimously.
Third item on the agenda: BAg I384, the request of Pete Rodriguez for a variance ofnine (9) feet
six (6) inches of the required twenty-five (25) foot firont setback as stated in Section 34 of the City of
Plainview Zoning Ordinance to build a 32.5' X i6' carport in a Single Family Residential (R-2)
Zoning District, and being Lot 21-22, Block 25, NSLS Addition, Plainview, Hale County, Texas and
same being 1112 W. 16~ Street. Mr. Redriguez is present with his daughter, Melissa Diaz. There
were no responses received on this variance, either for or against. John Castro stated staff has no
problem with the request. This house faces 16~ Street and has a second floor and balcony that had
been previously added to the ~,~elling. During the construction phase, Mr. Rodriguez was out of
town due to illness in the family and the contractors finished out the structure into the setback Mr.
Rodriguez was cited for building in the front setback and that is why he is here asking for approval
from the Board or he will be required to tear down the portion in the setback. Jennifer Wright made
motion to approve the variance based on lack of responses and appearance of property.. Fred Willis
seconded the motion. Motion carded unanimonsly.
Fourth item on the agenda: B.agI385, the request of Norman II. and Charlene Jones for a
variance of seven (7) of the required ten (I0) foot side setback as stated in Section 34 of the City of
Plainview Zoning Ordinance to build a 34' X 14' carpor~ in a Single Family Residential (R-2)
Zoning District, and being Lot 5, Block 2, Elmdale Subdivision, Plainview, Hale County, Texas and
same being 308 South Broadway. Mr. and Mrs. Jones are present and their contractor, Clinton
Thrasher, is als6 present. There were no responses received on this variance, either for or against.
John Castro stated staff has no pmblem with this variance request. John BickeI made motion to grant
the -variance due to non-use of the side sm~ and neighborhood response and Jennifer Wright
seconded hhe motion. Motion carded un~o~ly.
Fifth item on the agenda: BA~1386, the request of Tilman Reagan for a variance of fifteen (15)
feet four (4) inches of the required ~ (30) foot front setback as stated in Section 34 of the City of
Plainview Zoning Ordinance to build a 20' X 12' carport in a Single Family Residential 0~-1)
Zoning Distri~ and being Lot 8, Block 1, Simmons Addition, Pla/nview, Hate Cotmty, Texas and
same being 1305 Dallas. Tilman Reagan is present. There were thr~ responses received, two in
favor, and one against, stating: "I would not be opposed if the house vas added onto in a way that
would blend and match w/th the house, a perrmmnt add on - not a carport." One of the in favor
responses stated the follox~Sng: "I would like to see every curb in the 1300 block of Dallas St. done
away witk Nearly everyone has anywhere from 2 & 3 cam w/th only single car driveways. There
are so ninny cars parked on the street in this block that there is no way a fire truck or ambulance
could get down this ~in case they -were neede&" Mr. Reagan states he does plan on having a
pitched roof on the carport to match the house. Fred W~fllis motioned to grant the va~mce due to this
being the only logical place to put the carport and John Bickel seconde& Motion carried
unanknonsly.
Sixth item on the agenda: BA # 1387, the request of Clifton W. Jernigan for a vmriance of
twenty five (25) feet of the required twenty five (25) foot rear setback and five (5) feet of the
required five (5) foot side setback on both s/des as stated in Section 34 ofthe City of Plainview
Zoning Ordinance to build a 25' X 35' carport in a Single Family Residential (R-l) Zoning
District, and being the East 35 feet of Lot 14, Grandview Addition, Pla/nview, Hale County,
Texas ~ same being 3604 Grandview Drive. This item was pulled and the money was
refunded to Mr. Jemigan.
