Bickel, Jennifer Wright and Fred STAFF MEMBERS PRESENT: John Castro, Director of Community Service, Kristin Page, and Community Development Secretary OTHER GUEST PRESENT: Gonzales Mr. & Mrs. Herbert Smith, Arthur Rodriguez, and Felix First item on the agenda, approval of February 2001 minutes. Fred Willis made motion to accept minutes as read and Jennifer seconded. Motion carried 4-0. Second item on the agenda, BA #1373, the request of Herbert N. Smith Jr. for a variance of two (2) feet of the required five (5) foot rear setback and two (2) foot three (3) inches of the required three (3) foot side setback as stated in Section 34 of the City of Plainview Zoning Ordinance to build a 16' x 40' carport in a Single Family Residential (R-I) Zoning District, and being North 75' of Lot 10 and the South 15' foot of Lot ll, Unit 1, Westgate Addition, Plainview, Hale County, Texas and same being 2502 Holliday Street. There was one (1) in favor response received. Jolm Castro stated that Mr. Smith's fence is about 9 inches inside his property line. Mr. Smith wants to set his supporting poles inside his fence. The alley is one (1) foot inside the property line. Fred made motion to approve variance based on the existing stmeture and neighborhood response and Jennifer Wright seconded. Motion carded 4-0. Third item on the agenda, BA #1374, the request of Felix Gonzales for a variance of twelve (12) feet six (6) inches of the required fifteen (15) foot side setback as stated in Section 34 of the City of Plainview Zoning Ordinance to build a 17 X 20 (triangular shaped) carport in a Single Family Residential (R-2) Zoning District, and being Lot 1, Block 25, Highland Fair Addition, Plainview, Hale County, Texas and same being 1601 Joliet Street. There was one (1) in favor response received. John Castro stated that Mr. Gonzales property is on a comer. So since you have 2 streets, you have the front setback, but whenever your sitting on a side street then the side setback changes. It is 10 feet or 15 feet, depending on the classification of the side street. In this case, 16~ St. is considered a major sweet so the side setback is 15 feet. Mr. Gonzales is going to build along the same line of the existing carport if the variance is granted. John Bickel asked if there had akeady been a variance granted for this other carport. John Castro replied, that we could not find one. This ordinance came into affect in 1989 and at that time we are not sure if exactly what the set backs were without doing some research. This house has been there a long time; the fence is built in the right of way. If he had in fact had a variance granted before, he would not be here. Because the variance would have been granted to build within so many feet of the property line. Ray Jameson asked Mr. Gonzales if he was going to tie the two units together and Mr. Gonzales replied yes and he was going to use similar material as used in the existing carport. Jennifer made motion to approve the variance based on neighborhood response and location, John Bickel seconded. Motion carried 4-0. ' sEcP ? ,
