Bickel, Fred Willis, Ronnie Miller STAFF MEMBERS PRESENT: John Castro, Director of Community Development, Kristin Page, Board of Adjustment Secretary OTHER GUEST PRESENT: None First item on the agenda, approval of August 2000 minutes. Fred Willis made motion to approval as read and John C. Bickel seconded. Motion carded 4-0. Second item on the agenda, Case #1367, the request ofMargarito Apodaca for a variance oftwenty-five (25) feet of the required twenty-five (25) foot front setback and two (2) feet of the required five (5) foot side setback as stated in Section 34 of the City of Plainview Zoning Ordinance to build a 12' X 19'5" carport in a Single Family Residential (R-2) Zoning District, and being Lot 1, Block 51, Highland Addition, Plainview, Hale County, Texas and same being 1315 Houston Street. John Castro stated that the location of this house, its on the corner of 14a and Houston. The house sits 36 feet off the curb. The first 22 feet is right of way and belongs to the City of Plainview. Take the 22 feet off the 36 feet that leaves 14 feet. That means the front of his house is 14 feet from his front lot line. Here are some interesting things to note. (1) There is nothing to prevent him from building the carport beside the house. You can see tell-tell signs where they go through the driveway and drive all the way through to the back. If you look at it, the only thing that is here is the evaporative cooler on the wall. Remember the ordinance reads, "It is deemed by the board that there is no other practical location on the property. It is deemed by the board that the carport is similar structure will not negative effect other nearby properties." Which it probably won't affect the neighborhood. "It is deemed by the board that the lot is smaller with less space available for parking. It is deemed by the board that the material designs conform to the building code regulations. It is deemed by the board that the existing structure does not conform to the setbacks pursuing to the existing zoning ordinance guidelines." There were two (2) in favor responses receive& It is staff opinion, there is a practical location for this carport. And that place is right beside the house without putting it in the front setback. John Bickel asked how much does he have out to the side there that he could build on. John Castro stated that you may still grant him a 2 ft variance from the side setback so he could build a 12 ft carport beside his house. John Bickel asked to hear from Mr. Apodaca, whom which was not present. Fred Willis asked if the gas lines were going into the side of the house on the bottom. Ray replied, No there is not a meter. His service is in the back. Ronnie Miller asked how wide is a car? John Castro replied, according to the ordinance, a parking space is 9 ft by 20 ft. That is the standard size car. John Bickel made motion, to grant Mr. Apodaca a variance of 2 feet offthe side setback, but deny the variance for the front setback, since the carport could be built beside the house with encumbering the front setback.
