HomeMy WebLinkAbout11 1117 minThe City Council met on November 17, 2011, at the Plainview Convention Center, 2902 West 4 Street, Plainview, Texas. The agenda for this meeting was posted in City Hall at 10:45 a.m. on November 14, 2011. Mayor John C. Anderson presided. Councilmembers present were: Charles Starnes - District 1, Cathy Waggoner- District 2, David Garcia - District 3, V. O. Ortega- District 4, Wendell Dunlap- District 6 and Roland Nash - District 7. Councilmember Ron Trusler- District 5 was absent. Staff members present were: Greg Ingham -City Manager, Leslie Pearce -City Attorney, Rusty Reese -Parks Superintendent, Rusty Powers -Fire Chief, Mike Gilliland - Director of Public Works, William Mull - Police Chief, Daniel Born - Information Technology Specialist, and Belinda Hinojosa -City Secretary. News Media Present: Jessica Thornton, Plainview Herald Mayor Pro Tem Roland Nash led in the Invocation. Councilmember Trusler was granted an excused absence. Mayor Anderson presented for consideration on second reading Ordinance No. 11- 3565, an Ordinance Amending Chapter 23, Taxation, of the City of Plainview Code of Ordinances to Tax Tangible Personal Property in Transit Which Would Otherwise be Exempt Pursuant to Texas Tax Code, Section 11.253; Cumulativeness Clause; Conflicts Clause; Severability Clause; and Effective Date. Since this was the second of two readings, the Council chose to forego the staff briefing and ask for public comment. There was no public comment. Councilmember Ortega moved to adopt Ordinance No. 11 -3565 on second reading. The motion was duly seconded by Councilmember Dunlap and carried by unanimous vote. Mayor Anderson presented for consideration on second reading Ordinance No. 11- 3566, an Ordinance Amending Chapter 11, Fire Protection and Prevention, of the City of Plainview Code of Ordinances and Clarifying the Certification Pay and Assignment Pay in the Fire Department and the Fire Marshal's Office; Cumulativeness Clause; Conflicts Clause; Severability Clause, and Effective Date. Since this was the second of two readings, the Council chose to forego the staff briefing and ask for public comment. There was no public comment. Councilmember Dunlap moved to adopt Ordinance No. 11 -3566 on second reading. The motion was duly seconded by Councilmember Nash. Councilmember Starnes asked for confirmation that such was in the budget and that this was required because of the civil service process. He was advised that was correct. Mayor Anderson asked for a vote on the matter. The motion carried unanimously. Rusty Reese, Parks Superintendent presented for consideration to award bids for two 30 HP New Diesel Riding Mowers with 72 inch Side Discharge Mowing Deck. The following bids were received: City Council Minutes November 17, 2011 Page 1 of 2 59 60 1) Western Equipment bid a 2011 John Deere 1435 in the amount of $33,210.14 which did not meet specifications; 2) Professional Turf Productions bid a 2011 Toro GM328D in the amount of $35,245.48 which did not meet specifications; 3) Western Equipment bid a 2011 John Deere 1445 in the amount of $36,445.54; 4) James Bros. Implement bid a 2011 Kubota F3080 in the amount of $36,790.00; 5) Hurst Farm Equipment bid a 2011 John Deere 1445 in the amount of $37,311.12; 6) Luber Brothers bid a 2011 Jacobsen Turfcat in the amount of $38,600.00; and 7) Ray Lee Equipment bid a 2011 John Deere 1545 in the amount of $53,836.00. Mr. Reese recommended the Council grant a .94% local variance and award the bid to James Bros. Implement in the amount of $36,790.00. Mayor Anderson asked for public comment. There was no public comment. Councilmember Nash moved to award the bid to James Bros. Implement in the amount of $36,790 and to grant them a local bidder's preference of 0.94 %. Councilmember Starnes asked why a lower horsepower would not work. He was advised that a horsepower below 30 hp bogged down and used more fuel. Mayor Anderson asked for a vote on the matter.
