HomeMy WebLinkAbout12 0214 min78 The Plainview City Council met on February 14, 2012 at 7:00 p.m. in the City Council Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was posted in City Hall at 4:45 p.m. on February 10, 2012. Mayor John C. Anderson presided. Councilmembers present were: Charles Starnes - District 1, Cathy Waggoner - District 2, David Garcia - District 3, V. O. Ortega- District 4, Wendell Dunlap- District 6 and Roland Nash - District 7. Councilmember Ron Trusler- District 5 was absent. Staff members present were: Greg Ingham -City Manager, Jeffrey Snyder- Assistant City Manager, Leslie Pearce -City Attorney, Mike Gilliland- Director of Public Works, Will Mull - Police Chief, Rusty Powers -Fire Chief, Eric Turner -Main Street/CVB Coordinator, Sarianne Beversdorf- Director of Finance, and Belinda Hinojosa -City Secretary. News Media Present: Jessica Thornton - Plainview Herald Guests Present: Dalex Gary, Daelon Gary, David Garry III, Nathan Bair, Matt Buxton, Samson Weiss, Casandra Gary, Leon Heinen, Sherril Weiss and Becky Buxton Mayor Pro Tem Roland Nash delivered the invocation. Boy Scout Troop #253 posted the colors. Mayor Anderson presented a proclamation to the troop in honor of the local Boy Scouts celebrating their 100 anniversary on April 26, 2012. Councilmember Dunlap moved to adopt the consent calendar. The motion was duly seconded by Councilmember Ortega and carried by unanimous vote. Items approved on the consent calendar included the approval of the minutes of January 24, 2012 and February 9, 2012. Mayor Anderson presented for consideration on second reading, Ordinance No. 12- 3569, an Ordinance Amending the Zoning Map of the City of Plainview by Issuance of a Specific Use Permit to Operate a Bowling Alley in a Commercial Retail (C -2) Zoning District, Said Parcel Being 2002 North Quincy Street of the LAKESIDE PLV BLK 42 SW /PT S /OF RR 221.7' on Quincy, City of Plainview, Hale County, Texas; Cumulativeness Clause; Conflicts Clause; Severability Clause; and Effective Date. Since this was the second of two readings, the Council chose to forego the staff briefing and asked for public comment. There was no public comment. Councilmember Waggoner moved to adopted Ordinance No. 12 -3569 on second reading. The motion was duly seconded by Councilmember Starnes and carried by unanimous vote. Jeffrey Snyder, Assistant City Manager presented for consideration Resolution R12- 260, a Resolution of the City of Plainview, Texas, Authorizing the Submission of a Texas Home Investment Partnership Program Application to the Texas Department of Housing and Community Affairs for the Homeowner Rehabilitation Assistance Fund as well as to Become a Reservation Assistance Program Participant; and Authorizing the City Mayor to act As the City's Executive Officer and Authorized Representative in all Matters Pertaining to the City's Participation in the Home Program. This Resolution authorizes the City to submit a grant application to carry out housing rehabilitation /reconstruction and to be in the reservation program. The contract award is $451,000 to reconstruct five substandard homes in the community. There are certain City Council Minutes February 14, 2012 Page 1 of 3 income requirements. Right now there are no match requirements until August 31, 2012. Mayor Anderson asked for public comment. There was no public comment. Councilmember Starnes moved to adopt Resolution R12 -260. The motion was duly seconded by Councilmember Garcia. The motion carried by unanimous vote. Belinda Hinojosa, City Secretary presented for consideration Resolution R12 -261, a Resolution of the City of Plainview calling and setting the date for the Regular Municipal Election; Setting two twelve hour days for early voting as required by Section 85.005 (d) of the Texas Election Code; Designating districts and polling places for Mayor, and Districts 5, 6, and 7; Designating the election of a Councilmember for Districts 5, 6, and 7 respectively; Designating the election of a Mayor At- Large; and posting Notice of Election. This Resolution calls an election for Mayor, Councilmembers District 5, 6, and 7. It also sets out the two twelve hour early voting days as Monday, April 30, 2012 from 7:00 a.m. to 7:00 p.m. and Monday, May 7, 2012 from 7:00 a.m. to 7:00 p.m. Early voting will be held April 30, 2012 through May 8, 2012 in City Hall. The Resolution sets out the polling places as follows: District 1: District 2: District 2: District 3: District 4: District 5: District 6: District 7: Ash Elementary School Ash Elementary School Hillcrest Elementary School Lakeside Elementary School College Hill Elementary Edgemere Elementary School Senior Citizens Center Coronado Junior High School The General Election will be held on May 12, 2012. The filing period will be from February 4, 2012 through March 5, 2012. The write -in candidate filing period deadline will be from February 4, 2012 through March 5, 2012. In City's with four year terms, if no one files by this time, deadline is extended to 5:00 p.m. on Friday, March 16, 2012. Mayor Anderson asked for public comment. There was no public comment. Councilmember Ortega moved to adopt Resolution R12 -261. The motion was duly seconded by Councilmember Waggoner and carried y unanimous vote. Greg Ingham, City Manager presented for consideration Ordinance no. 12 -3570, an Ordinance of the City of Plainview, Texas, Amending Chapter 25 Article II Entitled "Rates And Charges" of the Code Of Ordinances of the City Of Plainview, Texas; Cumulativeness Clause; Conflicts Clause; Severability Clause; and Effective Date. This is the Ordinance that will be adopting a water rate structure that is targeted at conserving water use. City staff is in the process of revising the Drought Contingency Plan. We have looked at water rate structures from several cities and it is apparent that Plainview's rates are relatively low. The 1.7 million gallons a day coming from Lake Meredith are now gone. We need to pull peak day down if we are going to sustain. There was no public comment. Councilmember Nash moved to adopt Ordinance No. 12 -3570 on first reading. The motion was duly seconded by Councilmember Ortega. Councilmember Starnes stated this is an important step towards conservation plan, mostly been worried about supply and not working on resources to make users more efficient. It is vital to note that this is only the first step, not only by city but to encourage users to monitor usage. The City will look at bringing in, in about a month an updated drought contingency plan. Mayor Anderson asked for a vote on the matter. The motion carried by unanimous vote. Mayor Anderson moved to go into closed meeting to deliberate the appointment, employment, evaluation, reassignment, duties, discipline or dismissal of a public officer or employee, or to hear a complaint or charge against an officer or employee. [Tex. Gov't. Code Section 551.074]. City Manager Evaluation. The motion was duly seconded by Councilmember Dunlap and carried by unanimous vote. Mayor Anderson recessed the meeting at 7:40 p.m. Mayor Anderson called the meeting back to order at 8:30 p.m. Councilmember Ortega moved to renew City Manager contract and authorize a salary of $140,450 effective October 1, 2012. The motion was duly seconded by Councilmember Garcia. There was no public comment. The motion carried by unanimous vote.
