HomeMy WebLinkAbout12 0327 minThe Plainview City Council met on March 27, 2012 at 7:00 p.m. in the City Council
Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting
was posted in City Hall at 3:15 p.m. on March 22, 2012. Mayor John C. Anderson
presided. Councilmembers present were: Charles Starnes - District 1, Cathy Waggoner -
District 2, David Garcia - District 3, V. O. Ortega- District 4, Ron Trusler- District 5,
Wendell Dunlap- District 6 and Roland Nash - District 7.
Staff members present were: Greg Ingham -City Manager, Jeffrey Snyder- Assistant City
Manager, Leslie Pearce -City Attorney, Sarianne Beversdorf- Director of Finance, Mike
Gilliland- Director of Public Works, Will Mull - Police Chief, Rusty Powers -Fire Chief, Eric
Turner -Main Street/CVB Coordinator, Daniel Born -IT Specialist, and Belinda Hinojosa-
City Secretary.

Councilmember Cathy Waggoner delivered the invocation and led in the pledge of
allegiance.
Mayor Anderson presented a Proclamation to Councilmember V. O. Ortega proclaiming
April as Safe Digging Month. Also present was Jack Morris with West Texas Gas
Association.
Councilmember Trusler moved to adopt the consent calendar. The motion was duly
seconded by Councilmember Dunlap and carried by unanimous vote. Items approved
on the consent calendar included the approval of the minutes of March 13, 2012 and
March 22, 2012; approval of the financial reports; authorize Mayor to sign Amendment
to Department of State Health Services and Plainview -Hale County Health District
Program Attachment #001 to Contract #2012 - 039616; approval of the appointment of
Sandra Dulakis as President of the Plainview Board of Health; authorize to sign Farm
Lease Agreement with Robert Wilson; and approval of Resolution R12 -267, a
Resolution of the City Council of the City of Plainview, Texas, Approving the Request of
Plainview YMCA to Host the YMCA Triathlon Bike Race; Authorizing the Filing of the
Agreement for the Temporary Closure of State Right -Of -Way with the Texas
Department of Transportation for this Bike Race; Declaring that the Event Serves a
Public Purpose; and Agreeing to Comply with Regulations.
George Meriwether with Davis, Kinard & Co., PC presented the Comprehensive Annual
Financial Report for year ended September 30, 2011. The City received a clean opinion
or unqualified opinion which is the highest and best opinion they can render. The City
has received a clean opinion every year that they have performed the audit.
Mayor Anderson asked for public comment. There was no public comment.
Councilmember Dunlap moved to accept the Comprehensive Annual Financial Report
for Fiscal Year 2010 -2011. The motion was duly second by Councilmember Ortega and
carried by unanimous vote.

92 Belinda Hinojosa, City Secretary presented Resolution R12 -266, a Resolution
Canceling the May 12, 2012 Regular Election for Mayor and Councilmembers for
Districts 5, 6 and 7 and Declaring Each Unopposed Candidate Elected to Office. Since
there are no propositions to appear on the ballot, the city secretary has certified that
each candidate on the ballot is unopposed and the filing deadlines for placement on the
ballot have passed, Section 2.053(a) of the Texas Election Code authorizes a governing
body to declare each candidate elected to office and to cancel the election. The
following candidates are hereby elected:

Shane Martinez, City Council District 5
Lionel A. Garcia, City Council District 6
Eric Hastey, City Council District 7
The candidates however cannot take office until election day has passed and the
canvassing period has begun. It is proposed that the candidates take office on May

Mayor Anderson asked for public comment. There was no public comment.
Councilmember Trusler moved to adopt Resolution R12 -265. The motion was duly
seconded by Councilmember Starnes and carried by unanimous vote.
Mayor Anderson presented for consideration on second reading Ordinance No.12 -3571,
an Ordinance of the City of Plainview Amending Ordinance No. 11 -3561 to Appropriate
Funds in the General Fund and Various Revenue and Capital Funds Pursuant to
Section 5.07 (A) and (D) of the Plainview City Charter Allowing for Supplemental
Appropriations in the 2011 -2012 Budget; Cumulativeness Clause; Conflicts Clause;
Severability Clause; and Effective Date. Since this was the second of two readings, the
Council chose to forego the staff briefing and asked for public comment. There was no
public comment. Councilmember Ortega moved to adopt Ordinance No. 12 -3571 on
second reading. The motion was duly seconded by Councilmember Waggoner and
carried by unanimous vote.
There being no further business, Mayor Anderson adjourned the meeting at 7:28 p.m.
