HomeMy WebLinkAbout03.23.1998 BA MinutesBOARD OF ADJUSTMENT MINUTES MARCH 23RD, 1998 BOARD MEMBERS PRESENT: BETTY GONZALES, FRED WILLIS, RAY JAMESON AND JOHN BICKEL. STAFF MEMBERS PRESENT: JOHN CASTRO, DIRECTOR OF COMMUNITY DEVELOPMENT AND SHARLA RUCKER, SECRETARY OF COMMUNITY DEVELOPMENT. GUESTS: BOBBY MCGEHEE, COUNCIL MEMBER, CLINTON THRASHER, CURTIS GRAHAM, MIKE HATCH, SILAS URRUTIA, JESSIE BERGIL AND KENNETH BROWN. Betty Gonzales called meeting to order for March 23rd, 1998. No approval of minutes. Minutes from January 26th, 1998 and minutes from March 23rd, 1998 will be done at April's Board meeting First case on the agenda #1293, Curtis Graham. Mr. Graham is asking for a vadance of five foot of the required five foot side setback, Mr. Graham is wishing to build'a 14'6" x 50' carport in an R-2 zone. John Castro stated that the staffs recommendation is that a 12' width would be sufficient and that the board could grant if they so desired only a 2'5" variance. John also stated that another staff recommendation would be to grant the five foot variance and limit the length to 20 feet instead of the 50 foot. Curtis Graham took the floor, he stated that in order for the carport to look dght in accordance with his driveway, was the reason he was asking for the whole five feet. He also stated that a gutter was going to be put on the carport to catch debd, and the roof would also have a one inch pitch. Mr. Castro stated that staff reccomendation was to change his side setback to a variance of 3 feet. Betty Gonzales made motion and Ray Jameson seconded to grant Mr. Graham a three feet variance. Motion carried 4-0. Second case on the agenda #1294, Kenneth Brown. Mr. Brown is asking for a variance of 18' of the required front setback of 25'. Mr. Brown is wishing to build a 24' x 23' carport in a R-2 zoning district. John Castro explained to the board how the carport would set in accordance with the house. John stated that the staff had no problem with Mr. Browns request. Mr. Brown took the floor. He stated that as an amputee he was sure that in the near future he would probably be wheelchair bound and wanted to build a wheelchair ramp under the carport. Board granted Mr. Brown a 18' variance so he made build a 24' x 23' carport. Fred Willis made motion and Ray Jameson seconded. Motion carried 4-0. Mr. Browns address is 1505 S. Baltimore. Third case on the agenda #1295, Othella McDonald. Mrs. McDonald is asking for a variance of 9' 6" of the required front setback of 30 feet. Mrs. McDonald is wishing to build a 24' x 12' carport in a R-1 zoning district, John stated that there were two response from neighbors both in favor. John Bickel made motion to grant the variance and Fred Willis seconded. Motion carried 4-0. Mr. and Mrs McDonalds address is 2310 Norma. Fourth case on the agenda #1296, Forrest Bitner. Mr. Bitner is asking for a var lance of 14' for the required front setback of 25'. John Castro took the floor and read a letter addressed to him from Mr. and Mrs. Bitner explaining the hardship due to health problems which made it impossible to attend the meeting. The letter read as follows: In reference to our applying for a vadance for a carport we request to be excused from the board meeting because of hardship circumstances my husband can't drive because of eye surgery and I am limited on night driving. If you would take care of this for us we would appreciate it. John stated Mr. and Mrs. Bitner are also wanting to build a 14' x 24' carport. Fred Willis made motion to grant the variance and John Bickel seconded the motion. Motion carried 4-0. Mr. and Mrs. Bitners street address is 2415 Galveston. Fifth case on the agenda #1297, Jessie Bergil. Mr. Bergil is asking for a vadance of 11' x 6" of the required front setback of 30 feet. He is wishing to build a 20' x 20' carport in a R-1 zoning district. Mr. Bergils street address is 2111 W. 20th. John showed the video to the board of the property. John stated that staff had no problem with the carport as long as curb and gutters be put in since the ddveway is only wide enough for one vehicle. Fred Willis made motion to grant the vadance and John Bickel seconded the motion. Motion carried 4-0. Sixth case on the agenda #1298, Silas Urruita. Mr. Urruita is asking for a variance of 24' of the required front setback of 25' & five feet of the required five feet side setback to build a 21' x 24' carport, in a R-2 zoning district. Mr. Urruita's street address is 1402 W. 25th. John stated that they were concerned about building all the way to the property line since there was plenty of room to build it over toward the front of the house. John indicated staff recommendation was that the board approve the 24' front setback but not the 5' side setback, since there was room to build toward the front of the house without encroaching on the neighbors property. Mr. Urruita stated that he was building the carport the width of the drive and wanted to not build in front of his property and block the view of the street. John also read a letter sent in by Jimmie Davis stating as follows: I would not be opposed to this carport if a certain criteria is met. That being, new painted material, all frame work straight and level (built in accordance with standard building practices) and no solid wall or wind break. I do have some concerns with the width of 21 feet and the complete 5 foot side setback. Mr. Urruita again spoke and said his reason for not wanting to move within the property line was cost due to having to add more concrete on the east side. Motion made by Ray Jameson to grant a 24' front setback to build the carport only 20' x 24' so no side setback variance would be needed. John Bickel seconded the motion. Motion carried 4-0. Seventh case on the agenda #1299, Michael Hatch. Mr. Hatch is Building Trades teacher at Plainview High School. Mr. Hatch is asking for a variance of three feet on behalf of Jack and Kersi Riley, in a R-1 zoning district. The street address is 2605 Jefferson Street. John stated how the properties are divided by the alley, one side being Westgate and the other side being Town West. John also stated that staff recommends that PISD be granted a variance of three feet on each side and therefore reducing the side setback to five feet. Mr. Castro also noted that in 1993 the Board of Adjustment granted a blanket variance to approximately 15 lots in the town West edition. Also on the south of this lot the house is built on a 5' setback while the house on the north is built on a 8' setback. Mr. Hatch stated that he was building trades teacher and this property was to build a building trades house. He also stated that he works with an advisory committee that recommends size of house to build for the best re-sale chances. John Bickei made a motion to grant the variance and Fred Willis seconded.
