MINUTES
JUNE 22ND,- 1998
BOARD MEMBERS PRESENT: Cesar Cervantez, Ray Jameson, Veronica Gutierrez,
Betty Gonzales and John Bickel
STAFF MEMBERS PRESENT: John Castro, Director of Community Development and
Sharla Rucker, Secretary of Community Development
OTHER GUESTS: Randy Lawson, Casper Sims, Emma Sims, Joel Endquez, Epifanio
Enriquez, Deen Estes, Buddy McGehee.
First item on the agenda, approval of minutes. Ray Jameson made motion to accept
minutes as read and John Bickel seconded. Motion carried 5-0.
Second item on the agenda, Case #1308, the request of Epifanio Enriquez for a
variance of ten (10) feet of the required twenty-five (25) foot rear setback. Mr.
Enriquez wants to move in a house to face west toward Galveston Street. John
Castro stated to board that there were three (3) responses received back, all were in
favor. Ray Jameson made motion to grant variance as requested and John Bickel
seconded. Motion carried 5-0.
Third item on the agenda, Case #1309, the request of Randy Lawson on the behalf of
the Church of God for a variance to expand on a non-conforming use and a variance
to build within five(5) foot of the rear setback. Address being 1002 EIPaso Street.
John Castro took the floor to show video to board and explained that staff
recommendation was in favor of the variance. John also stated that no responses
were received back from the neighborhood. Veronica Gutierrez made motion to grant
both variances as requested and Ray Jameson seconded, so both variances were
granted. Motion carried 5-0.
Fourth item on the agenda, Case #1310, the request on Deen Estes for a variance of
five (5) feet of the required eight (8) foot side setback and fifteen and one-half (151/2)
'feet of the required thirty (30) foot front setback to enclose a carport at his residence
of 2308 Norma Street. John Castro took the floor to show video to the board and
reminded board that in 1996 the board had granted a variance to construct a 24' x 24'
carport. Mr. Castro also stated that the City of Plainview had received a complaint
about a wall that had been built on the side of the carport and that responses were all
against the request. Mr. Estes took the floor on his behalf and stated that he had
gone up and down the street himself and no one complained to him. Mr. Estes stated
that his wife had arthritis and had a hard time cleaning off her car in the winter time
and did not want to take the wall down. Ray Jameson stated that this was going to be
a structure in front of the house instead of a carport. Mr. Estes stated that he would
fight all the way if he had to. Mr. Castro took the floor again and stated that a
hardship had to be shown. Ray Jameson made motion to not approve the variance
and deny the request~and Veronica Gutierrez seconded. Motion carried 5-0.
Fifth item on the agenda, Case #1311, the request of Tony Mata for a variance of four
and one-half feet of the required five (5) foot side setback at his residence of 509
Houston to build a carport. John Castro took the floor and stated that Mr. Mata was
working ou-of-town and could not be there and Mr. Mata did not have anyone to
represent him there. John also stated that Mr. Mata did not have a permit to build this
carport and that Mr. Mata had come in and applied for the permit and that was when
they discovered how close he was to the side property line (6 inches). Mr. Castro
showed video to the board and stated that Mr. Mata had put the carport in the only
place he would be able to put it, and that no responses were received from the
neighborhood. Ray Jameson made motion to grant the variance as requested and
Cesar Cervantez seconded. Motion carried 5-0.
Betty asked for any other business. None brought forward.
