HomeMy WebLinkAbout08.24.1998 BA MinutesBOARD OF ADJUSTMENT MINUTES AUGUST 24TH, 1998 BOARD MEMBERS PRESENT: BETTY GONZALES, JOHN BICKEL, RAY JAMESON AND CESAR CERVANTEZ STAFF PRESENT: JOHN CASTRO, DIRECTOR OF COMMUNITY DEVELOPMENT AND SHARLA RUCKER, SECRETARY OF COMMUNITY DEVELOPMENT OTHER GUESTS PRESENT: GENE CURB, CAROLE BELL, HAZEL YOUNG, LONNIE SMITH, DAVID RILEY AND JOY DENTON First item on the agenda, approval of minutes. Ray Jameson made motion to approve minutes as read and John Bickel seconded. Motion carried 4-0. Second item on the agenda, Case #1312, the request of Lonnie Smith for a variance of six feet eight inches of the required eight foot side setback in a Single Family Residential Zoning District, address being 1305 Holliday Drive. John Castro showed video of property in question to the board and stated that this structure had already been built and was built without a permit and built within the setback. John also stated that eight responses from the neighborhood were received back and five were against and three were in favor, he then read comments from those responses to the board. Mr. Castro then stated that staff felt like that it could have been built within the setbacks and did not see a hardship or reason to deviate from the setback requirements. Mr. Smith then took the floor and stated that he thought the contractor that built the cover had pulled the permit and that it was his(Mr. Smith's) fault for thinking they would handle that process and they didn't. Mr. Smith said that he did have a small building there that would store a pickup and the roof had gotten hailed on and so he built this structure. Mr. Smith also stated that he and his wife had been though a lot of misery over this structure and that he evidently had made other people miserable. Mr. Smith stated that he had a leg cut off and two heart attacks and that it was hard for him to tarp his motor home. Ray Jameson made motion to deny the request because it could have been built in the setbacks without a variance and Cesar Cervantez seconded. Motion carried 4-0. Third item on the agenda, Case #1313, the request of Hazel Young fora variance of nine feet to the required twenty-five foot front setback to build a 12' x 24' carport in a Single Family Residential (R-2) zoning district, address being 217 SE 8th Street. John showed video to the board and stated that four responses were received back and all were in favor. Mr. Castro stated that staff recommendations were in favor of this variance. John Bickel made motion to grant variance as requested and Ray Jameson seconded. Motion carried 4-0. Fourth item on the agenda, Case #1314, the request of Belinda Bailey for a variance of three feet of the required eight foot side setback to build a 13' x 27' garage in a Single Family Residential (R-l) zoning district, address being 1316 Vernon Street. John showed video to board and stated that two responses were received back, both in favor. Mr. Castro stated that staff recommendation was in favor of this variance. John Bickel made motion to grant variance as requested and Cesar Cervantez seconded. Motion carried 4-0. MEETING ADJOURNED SECRETARY
