First item on the agenda, swore in Ronnie A. Miller as an alternate member.
Second item on the agenda, approval of minutes. Fred Willis made motion to accept minutes as read and Cesar
Cervantez seconded. Motion carried 4-0.
Third item on the agenda, Case # 1325, the request of Kelvin Tipton for a variance of fiReen (t 5) feet of the required
twenty (20) foot rear setback as stated in Section 34 of the City of Plainview Zoning Ordinance to lxfild a 22 x 40
storage/garage in the rear yard of a Single Family Residential 01[-2) Zoning District, and being Lot 9 & t0, Block 5,
Highland Addition, Plainview, Hate County, Texas and same being 811 W. 1 l th Street. They did get olle (1) yes
response and the staffhad no problems w/th this request. Thereason Mr. Tipton has to get a variance for a twenty foot
set back is that he plans to put a garage door on the storage/garage, Ray James~ asked Mr. Tipton what the material
he was going to build it w/th. Mr. Tipton replied that he might put in on center blocks but does not know. Mr. Tipton
is going to put a single door in it with a four foot gate so it will open up six(6) foot and put it in will wood so it will
swing hack into his property. So it w/Il make it clear of the building if he needs access to get in and out. Fred Willis
made motion to approve this variance and Cesar seconded. Motion carried 44).
Fourth item on the agenda, Cas~1326, the request of Donald Dixon for a variance of sixteen (16) feet of the required
twenty-(20) foot rear setback as stated in Section 34 ofthe City of Plainview Zoning Ordinance to build a 24' x 30'
garage/storage/workshop in a Single Family Residential (R-l) Zoning District, and being Lot 50, Unit 1, Westgate
Addition, Plainview, Hale County, Texas and same being 3505 West 25th Street. They did receive six (6) yes responses
toward this variance. Mr. Dixon is planning on moving the old storage out, and place the new one on the exact place
the old one was. Since he going to place a door in the back of it, that is why he nexxls a variance. Mr. Dixon requited
fiRem (15) foot of the required twenty (20) to build a 24' x 30' garage/storage/workshop in a Single Family Residence.
Ronnie Miller asked Mr. Dixon what size he had in there now and he replied 12' x 26'. It is a wooden structure on
piers and he wants to go to concrete floor with a metal frame and metal sides. Fred Willis made motion to approve
this variance and Ronnie Miller seconde& Motion carried 4-0.
Fiith item on the agenda, Case #1327, the request of Ted Noel on behalf of Jack Morris Ford for a variance of twenty-
five (25) li~ ofthe required twenty-five (25) foot rear setback as stated in Section 34 of the City of Ptainview Zoning
Ordinance to build a 24' x 185' canopy in a Commercial General Business (C-3) Zoning District, and being Lot 2
N15/1, Block 1, West End Addition, Plainview, Hale County, Texas and same being 1020 N. IH 27. To build a canopy
along the back in the all~y, John Castro stated they had some trouble hDSng to define what we were doing here. To
build a carport, you have got to have a primary building. Which there is nothing there but a vacant lot. A canopy can
be built anywhere to protect property owners property. A canopy is any structure of a permanent fixed nature attached
to or independent of a main structure. Any structure on a C-3 has to be twenty five (25) foot from any residential
boundaries which is on the other side of the alley. The staff feels that it would be better served if they were granted
the variance to go ahead and build the fence; attached the structure to it to afford them more protection for the vehicle
parked there. They did receive six (6) yes responses. Mr. Noel stated that he would match it with Fuzzy's and that
it would be the same or nicer. They plan to go up to ten (10) foot to the front on a slope. BUt the back of it is going
to be eight (8)foot~ with the same cot6rs and trim, with no gates to go in and out of the back. The canopy wilt have
a white top. If he has to move it up, to a chain link fence, its going to cost somuch more money. He is wanting to
do it so th~ neighbors do not have no complaints. Cesar Cervantez mad~ motion to approvo this variance and Fred
Willis s~onded. Motion Carried 4 - O.
