OTHER GUEST: Manuel Mitchell, Rebekah & Phillip Mize, Joaquin Lucio, Sandra Lucio, Nicandra Perez, Jay Laird, Joe H. Cavazos, Derrell D. Smith, Jose Martinez, Sammy Vaughan Jr. First item on the agenda, approval of minutes. Ray Jameson made motion to accept minutes as read and John Bickel seconded. Motion carried441. Second item on the agenda, Case # 1318, the request of Jose S. Martinez for a variance of nineteen (19) feet three O) inches of the required twenty-five (25) foot setback and three (3) feet of the required five (5) foot side setback as stated in Section 34 ofthe City of Plainview Zoning Ordinance to build a 18' x 24' carport in a Single Family Residential (R- 2) Zoning District, and being Lot 7, Block 1, GeoffCa'een Addition, Plainview, Hale County, Texas and the same being 112 Lindberg Street. Jctm Castro replied that the staffhad no problem with this and they recommend that this request for a variance be approved. They had four yes responses. Ray Jameson made motion to approve this variance and send it to City Council bemuse this is the only logical place to put it on the property, Cesar Cervantez seconded. Motion carried 44). Third item on the agenda, Case # 1319, the request of Derrell Smith for a variance of sixteen (16) feet four (4) inches ofthe required thirty (30) foo~ front setback and six (6) inches of the required eight (8) foot side setback as stated in Section 34 ofthe City of Ptainview Zoning Ordinance to build a 20' x 20' carport in a Single Family Residential (R- I) Zoning District, and being Lot t4, Block 6, Brock, Unit 2 Addition, Plainview, Hale County, Texas and same being 1406 Floydada Street. They did receive nine yes responses and one no response. And no reason given on the no response. The staffhad no problem with this request, Cesar Cervantez stated this being the only Iogical place this ~ he recommends that they approve this request and send it to City Council for approval, Ray Jameson seconded. Motion carried 4-0. Fourth item on the agenda, Case #1320, the request of Manuel Mitchell for a variance of four (4) feet of the required five (5) foot side setback as stated in Section 34 of the City of Plainview Zoning ordinance to build a 20' x 12' carport in a Single Family Residential (R-2) Zoning District, and being Lot 3, Block 60, Highland Addition, Plainview, Hale County, Texas and same being 1409 Iq. Fresno Street. They did receive six yes responses. The staffhad no problem with this request. The fence does an S type thing, and they are not sure on who's property it is setting on and they could not determine that unless they got a survey on it. Cesar Cervantez stated that again being the most logical place to put the carport, he makes the motion to approve this variance and send it to City Counell for final approval, John Bickel seconded. Motion carried 44). Fifth item on the agenda. Case #1321, the request ofPhillip Mize for a variance ofseventeen (17) feet ofthe required twenty (20) foot rear setback as stated in Section 34 of the City of Plainview Zoning Ordinance to build a 24' x 36' garage in a Single Family Residential (R-l) Zoning District, and being Lot 33 S45'-34, Block 5, Country Club Addition, Plainview, Hale County, Texas and same being 310 Juanita Street. They did receive three yes responses. Mr. Mize was asked from Betty why he wanted to set the garage there, and he replied the he wants to convert the garage into another bedroom. The garage is in the front part of the house. The house is a three bedroom, Mr. Mize has three girls. By doing that he is going to have to add on a bathroom and more closet space onto his bedroom. By pta~g this on the back of the house, he is going to take up 17 more foot. If he moves it back the 17 foot, then the two buildings are going to be so close yon won't be able to walk in between them and he can't move it to the South any, because ofall the utilities. The only place he could move it is directly back to the house, fiMr. Mize built on to the back of the house, it would be close enough that he would have to request another variance to add on to the back of the house because it would be tess than 10 ft. apart. So he were ahead and put it back towards the house. He would refer to put the shop where it is that way he would only have to get the variance for the shop not for the house. John Bickcl asked what the Hardship was, Mr. Mize stated that the only thing that he is trying to keep from is applying fc~ two variances. Mr. Mize explained why he was doing it in that order and he e~cplained that he had so much stuff in that garage and has no place to put it. That is why he wants to build the storage first. Cesar Cervantez replied, "Being we've got three (3) approvals, going along by the definition of Hardship and going along the lines of practical difficulties and trying to be as practical as we can. I make a motion that we approve this request." Ray Jameson seconded. Motion carried 4-0. Six~ item on the agenda, Case #1322, the request of Joe FL Cavazos for a variance of six (6) feet of the required twenty (20) foot ~ setback as stated in Section 34 ofthe City of Plainview Zoning Ordinance to build an 8' porch extension in a Single Family Residential (R-2) Zoning District, and being Lot 1 & 2, Block 19, Highland Addition, Plainview, Hale County, Texas and same being 1113 N. Street. They did receive three yes responses. Betty asked what his Hardship was and he replied that in the future he wanted to enclose the porch and e, zctend his living room because his living area is to small. Bu~ he does not want to enclose the living roc~n and have a bigger living room and have no porch. Ia~ has a big family and not enough room. ~m Bickel asked why don't you do the living room first. He does not think it will look right if the front of the house is fiat. He thinks it will make his house look better ffhe goes all the way across the house, By enclosing the porch, it will give him 6 more feet by the width of the living room. Jay Laird, a neighbor of Mr. Cavazos, spoke positive on behalf of Mr. Cavazos request and on his work. Ray Jameson made motion to approve this variance, John Bickel s~conded. Motion carried 4-0. Seventh item on the agenda, Caso #1323, the request of Joaquin Lucio for a variance to expand on a non-conforming use as defined in Section 35 of the City of Plalnview Zoning Ordinance to build 9' x 17' porch in a Single Family Residential (R-2) Zoning l)istr~ and being Lot N50~.9 & I0, Block 16, Highland Addition, Ptainview, Hate County, Texas and same being 1108 Portland Street, John Castro stated that they did receive three responses on this variance and the staff did not have a problem with this request because regardless of what you do whether you approve the variance or not, and we are recommending that you approve the expanding on the nonconforming use, Mr. Lucio wilt still have to replace the beams on the porch because he u~I 2x4's and you cannot use 2x4's. You have to use 2x6's instead. They did receive six yes responses on this variance. John Bickel made motion to approve this variance, Ray Jameson seconded. Motion carried 4-0. Eighth item on the agenda, Case #1324, the request ofNicandra Perez for a variance of sixteen (16) feet of the required twenty, five (25) foot front setback as stated in Section 34 of the City of Ptainview Zoning Ordinance to build a 21'2" x 24' carport in a Single Family Residential (R~2) Zoning District, and being Lot 15, Block I, Northside Addition, Plainview, Hale County, Texas and same being 2208 Kokomo Street. They did receive six yes responses on this -t0xiance and the staff did not have a problem with this. Cesar Cervantez made motion to approve the request for this variance of 16ft,, John Bickel seconded. Motion carried 4-0. Betty asked for any other business. None was brought forward.
