BOARD OF ADJUSTMENT
MINUTES

First item on the agenda, approval of August 99' minutes. Joe Rodriguez Jr. made motion to approve minutes
as read and Cezar Cervantez seconded. Motion carried 4-0.
Second item on the agenda, Case # 1348, the request of Larry Rollins for a variance of thirteen (13) feet eight
(8) inches of the required thirty-five (35) foot front setback as stated in Section 34 of the City of Plainview
Zoning Ordinance to extend his garage in a Single Family Residential (R-t) Zoning District, and being Lot
S.47'- 5/N.27'- 6, Block 2, Day Addition, Plainview, Hale County, Texas and same being 1409 N. Canyon
Street. Mr. Castro informed the Board there were alternatives to building in the front set baclc He also
informed Mr. Rollins of this fact. This is an R-1 district and there is a 35 foot front setback. Granting an
extension of 13' 8" will phce the structure 21' 4" from the front property line. There were nine responses. Five
were in favor and four opposed. The four opposing letters stated that it would lower the property values, block
the air flow from the south & east windows, it would set a precedent for other such variances in this section
of Canyon Street and destroy the quality of the neighborhood. All houses on the street are back the same
distance from the front setbacks and adding to the front of garage will look bad for this street. Let him build
on to back where there is plenty of room. Mr. Rollins stated that the extended garage would be a pickup length
from the inside of the door, with room to walk around it. Mr. Rollins replied the reason why he could not build
onto the back of his property was became the plumbers told him that he could not lay concrete over his sewer
and gas lines. He also has two large, 35 yr old tree he did not want to get rid of. The patio restricts the are
to build. The board suggested to Mr. Rollins to move his sewer and gas line, but he replied that the lines were
just replaced last year. John Bickel asked what his purpose of the extended garage, if he was just adding onto
the house and still have a garage and Mr. Rollins replied yes, he was raising one grandchild and maybe f~xing
to raise another and maybe move his mother-in-law in too. John Biekel did ask if there were any other extended
garages or carports and Mr: Rollins and John Castro replied no. Cezar Cervantez stated that the way our
standards are set up and everyone knows they are there, as the zoning laws are, to assume accountability for
the integrity of the neighborhood. With the responses we have had and the precedent that have been set by this
committee in the past, right now he see's no alternative, but to make a motion not to approve this variance.
Cezar Cervantes made motion not to approve the variance. John C. Biekel seconded. Motion carried 4-0.
Cezar stated for the record, the three reason; precedent, no hardship proven and the negative responses that
were received from the neighborhood.
Third item on the agenda, Case #1349, the request of Milton Sanders for a variance of three O) feet six (6)
inches of the required five (5) foot side setback as stated in Section 34 of the City of Plainview Zoning
Ordinance to build a 30' X 12' carport in a Single Family Residential (R-2) Zoning District, and being Lot 4,
Block 2, Warren Addition, Plainview, Hale County, Texas and same being 206 SE 7~ Street. Mr. Sanders
wants to build a canopy for his mobile home. Mr. Sanders will enter the canopy through the front. The canopy
will be located on the side of the house opposite where the carport is located. Mr. Sanders is going to build
it himself and he is going to use C-pttrlins and steel. There were four responses in favor of the request. Staff
has no problem with the variance based on neighborhood response. Cee_ar made motion to approve the variance
provided that the flow of water goes towards Mr. Sanders property and no sides are to be added to the structure
after it is built. Joe Rodriguez Jr. seconded. Motion carried 4-0.
