HomeMy WebLinkAbout10.26.1987 BA MinutesBOARD OF ADJUSTMENT MEETING MONDAY, OCTOBER 26, 1987, CITY HALL, 7:30 P.M. The Meeting was called to order by Chairperson Terry Teague. Other Board members present were Carolyn Warrick, Jack Burton, E.K. Hufstedler III, Pat Stoner and John Oathout. Staff present: Jim Sewell, Building Inspector. Visitors present were: Walter Woods, Mary Spain, Carrol Foster, Mark Hays, Harold Gladman and Thomas Stoner. B.A. Case No. 1033 Request of Thomas M. Stoner for a variance to construct an addition to a residence within the required front and side yards in a C.R.D. (Commercial Retail District) Zoning District, being the West half of Lots 8 and 9, Block 5, Brandes Subdivision and. located at 1000 Canyon. The case was presented to the Board by Mr. Sewell. Through overhead projection, Mr. Sewell indicated the location of the property and presented slides showing the buildings and their location on the property. Mr. Stoner stated that he wanted to construct an entry way at the front entrance to his residence that would come out 10 feet from the present building. He also stated that he wanted to construct an open carport within 2 feet of the rear property line. After a short discussion Mr. Burton made a motion, seconded by Mr. Hufstelder, to grant a variance to construct an addition to the residence 10 feet from the present into the required front yard with a 2 foot overhang and an open carport addition within 2 feet of the North side property line. The motion carried 5 to 1 with Ms. Stoner abstaining. B.A. CASE NO. 1034. Request of Mary B. Spain for a variance to construct an open carport in the required front and side yards in an R-1 (Single-Family Residential) Zoning District, being the South 40 feet of Lot 9 and the North 20 feet, 8 inches of Lot 10, Block 1, Aylesworth Subdivision and located at 1305 Travis. The case was presented to the Board by Mr. Seweli through the use of overhead projection and slides. Mr. Wood, 805 Yonkers, spoke for Ms. Spain. He stated that Ms. Spain wanted to construct a 13 ft. x 24 ft. open carport on the South side of her residence and a 13 ft. x 24 ft. open carport on the front of her residence. He further stated that carports were for the protection of Ms. Spain's two vehicles and that the South carport would also serve as weather protection to the rear entrance of the residence. After a short period of questions and discussion from the Board, Mr. Burton made a motion, seconded by Mr. Hufstedler, to grant a variance for Ms. Spain to construct a 13' x 24' open carport addition to the South 13 ft. from the present building with a 1 ft. overhang, and a 12' x 24' open carport to the front of the present building. Motion carried unanimously. B.A. CASE NO. 1035. Request of Bill Eaves to construct a storage building in the required side and rear yard in a R-1 (Single-Family Residential) Zoning District, being Lot 1, Block 20, Brock Addition, Unit No. 5 and located at 1009 Holiday Drive. The case was presented to the Board by Mr. Sewell through the use of slides and overhead projection. Mr. Gladman, representing Mr. Eaves, stated that when the residence was constructed, a concrete slab was poured for a storage building within 3 ft. of the side and rear property line. He said that at the time of construction the zoning ordinance did 'not require the 5ft. setback from the rear property line nor the 10' from the side property line adjacent to a side street. He stated that Mr. Eaves requested the variance to permit him to construct a 16 ft. x 12 ft. storage building on this existing slab. Mr. Gladman then gave the Board a plot plan of the property showing where the building would be constructed. After a short discussion by the Board, Ms. Warrick made a motion, seconded 'by Mr. Burton, to grant a variance for Mr. Eaves to construct a 16' x 12' storage building within 3 ft. of the rear property line and within 3 ft. of the north side property line. Motion carried unanimously. CASE NO. 1036. Request of Carrol Foster to construct an open carport in the front and side yards in a R-2 (Single-Family Residential) Zoning District being Lot 27, Block 3, Boynton Addition, Unit No. 5 and located at 101 S.E. 9th Street. The case was presented to the Board by Mr. Sewell through the use of slides and an overhead projection. Mr. Foster stated that he desired to construct an open carport in the required front and side yard of his property. The construction would be with 2 1/2 ft. of the East side property line and 2 ft. of the front property line. After a short discussion among the Board members, Mr. Hufstedler made a motion, seconded by Ms. Stone, to grant a variance for an open carport to be constructed within 2 1/2 feet of the East side property line. and within 2' of the front property line. Motion carried unanimously. CASE NO. 1037. Request of Mark Hays to construct an open carport in the required front and side yards in a R-1 (Single-Family Residential) Zoning District being the North 12.56 ft. of Lot 10 and all of Lot 11, Block 1, Brannon Subdivision and located at 1004 Zephyr. The case was presented to the Board by Mr. Sewell through the use of overhead projection and slides. Mr. Hays stated that the carport was needed to provide protection from the trees and birds. He requested to construct the carport within 3 feet of the north side property line and within 0 ft..of the front property line. Mr. Burton made a motion, seconded by Ms. Warrick to grant the variance as requested. Motion carried unanimously. Having no further business the meeting was adjourned at 8:30 p.m. Jim' Sewell, Building Inspector Presiding Boardmember
