Monday, December 19, 1988, 7: 30 P.M-, City Hall
The Board of Adjustment met in regular session with Chairman Jack
Burton.presiding. Other members present were Pat Stoner, Carolyn
Warrick, Fred Bechtold and Lynn Davis.
Staff members present were Mike McDonough, Director of Municipal
Services and David Blackburn, City Attorney.
Franklin Ebeling was the only visitor present.
B. A. Case No. 1066:
Request of Frank Burge for a variance to construct an open
carport in the required front yard in a R-1 (Single-Family
Residential) Zoning District, being Lot 14, Block 1, Aylesworth
Subdivision and located at 1304 Utica.
This item was tabled from the meeting of November 28, 1988 and
was removed from the table for rehearing. Mike McDonough
presented the outline of the request of Mr. Burge to construct a
carport within his front yard which would necessitate a variance
to within ten foot four inches (10'4") of the front property
line. There would be no other variances' needed to construct the
open metal carport. He also stated that there were other similar
carports in the neighborhood and that this carport would not
cause any undue problem to the adjoining neighbors. One letter
of relpy in favor was presented to the Board.
Franklin Ebeling, representive of the applicant, reviewed the
type of carport that would be built and answered questions that
the Board members had.
After a brief discussion, Pat Stoner moved, seconded by Carolyn
Warrick that a variance be granted to construct an open metal
carport within the required front yard and to within ten foot
four inches (10'4") of the front property line. The motion
carried with Chairman Burton, Stoner, Warrick and Davis voting in
favor. Member Fred Bechtold abstained as he had disqualified
himself from taking part in the discussions or the vote on this
case as he had filed an affidavit for Conflict of Interest.

Second item of business for the meeting was a work session on
review of the State requirements of the Board of Adjustment and
procedures as they affect that board. David Blackburn and Mike
McDonough reviewed State Law and Local Ordinances and procedures
as they affect the board.
With no other business pending the meeting adjourned at 10:00
P.M.
