HomeMy WebLinkAbout04.24.1989 BA Minutes BOARD OF ADJUST~tT MEETING MINU~IES Monday, April 24, 1989, 7:30 P.M., City Hall The Board of Adjustment met in regular session with Chairman Jack Burton presiding. Other members present were John Oathout, Carolyn Warrick, Randy Ballinger, Rebecca Escalante and Lynn Davis. Staff present were Mike McDonough, Director of Municipal Services and David Blackburn, City Attorney. Also present and not taking part in any discussion was Board Member Fred Bechtold who signed a "Conflict of Interest" statement as he would be involved in Case No. 1073. He did not take part as a Board Member in any of the cases under discussion. Visitors present were: Loretta Preuit, Amber Washington, Mrs. Frank Day, Darlene Lunday, Mrs. Fred Bechtold, Melvin Bramlet, Mr. & Mrs. Robert N. Hoffman, Mr. & Mrs. James Seipp, Randy Seipp, and Mr. & Mrs. Bob Coleman. B.A. CASE NO. 1071: Tabled from the meeting of March 27, 1989 Request of Loretta Preuit for a special exception to the Zoning Ordinance to allow the placement of a mobile home for use as living quarters in a R-2 (Single-Family Residential) Zoning District, being Lots 1 & 2, Block 82, Highland Addition and located at 1509 E1 Paso. Loretta Preuit explained to the Board that she had recently purchased a double wide mobile home and had paid $1,000 down on two (2) lots located at 1509 E1 Paso to place the mobile home. She stated that she is using a portion of a insurance settlement to purchase the mobile home and the two (2) lots so that she and her family could have a place to live without paying rent as she might not be able to return to work. Mike McDonough reviewed with the Board the requirements dealing with mobile homes within the Zoning Ordinance which necessitated the request for Special Exception. Video of the property in question was also shown. The Board discussed the request at length with Mrs. Preuit. Following the discussion Lynn Davis moved, seconded by John Oathout that no hardship had been shown in this case and thus the request for the Special Exception be denied. The Board voted four (4) to one (1) to deny the request. Voting in favor of the motion were members Davis, Oathout, Warrick and Ballinger. Member Escalante voted against the motion. On the four (4) to one (1) vote the request was denied. Board of Adjustment Meeting Minutes April 24, 1989 Page 2 B. A. CASE NO. 1072: Request of Darlene Lunday for a variance to continue to park a mobile home for use as living quarters in a R-2 (Single-Family Residential) Zoning District, being Lot 1, Block 61, Highland Addition, and located at 801 W. 15th Street. Darlene Lunday explained to the Board that she was requesting to continue to park her mobile home on property adjacent to her mother's residence. Mrs. Lunday's mother is in ill health and for the past ten (10) years Mrs. Lunday has lived adjacent to her parent's house to provide assistance in caring for her mother. Mrs. Lunday stated that she had requested a letter from Dr. Mary Bublis as to the medical need for this request but it had not been received by the City at this time. When Mrs. Lunday called Dr. Bublis she was advised that the letter had not been signed as Dr. Bublis had been ill recently, but as soon as the doctor returns to work, the letter would be taken care of. After a lengthy discussion on this request, Carolyn Warrick moved, seconded by Rebecca Escalante to table this request until a statement had been received from a physician advising of the medical hardship involved in this situation. The motion carried unanimously and the request was tabled until the May 22, 1989 meeting of the Board, B. A. CASE NO. 1073: Request of Mrs. Willa Coleman for a variance to construct an open carport in the required front and side yards in a R-1 (Single-Family Residential) Zoning District being Lot 5 & West half of 6, Block 5, of High School Addition and located at 1904 W. 20th Street. Mike McDonough explained the requirements of the Zoning Ordinance which necessitated the variance request and showed video of the residence and the area. Fred Bechtold, who was representing Mrs. Coleman in this request, explained that his company would be erecting an open metal carport adjacent to and in front of this residence if the request was granted. He provided the Board with copies of brochures showing the type of carport that would be constructed. Diagrams showing how far into the side and front yards the proposed carport would extend were also presented. The proposed carport was to be a 20' x 20' .open metal carport which would extend to within 6" of the side property line and 10' into the front required yard. Mr. Bechtold also listed for the Board all the carports constructed adjacent to residences within a several block radius on 19th, 20th and 21st Streets. Board of Adjustment Meeting Minutes April 24, 1989 Page 3 Speaking in opposition to the request were Melvin Bramlet, Robert Hoffman, Randy Seipp and Jimmy Seipp. After a lengthy discussion, John Oathout moved to grant the request for a variance to construct the open carport to within 6" of the side property line and I0' into the front required yard on the basis that others have been allowed in the area of a similar nature. Carloyn Warrick moved to amend the motion to grant the request to not less than 12" of the side property line and 10' into the front yard requirement. John Oathout seconded the amendment. John Oathout, Carolyn Warrick and Randy Ballinger voted for the request. Lynn Davis and Rebecca Escalante voted against. The amendment failed as there was not four members voting in favor. The original Oathout motion died due to the lack of a second. Rebecca Escalante moved to table the request until the meeting of May 22, 1989 to allow the Board additional time to study and revisit. Lynn Davis seconded the motion and requested that the neighbors in the area get together to determine what they could agree on. The motion carried three (3) to two (2) and was tabled until the next regular Board meeting. With no other business pending, Lynn Davis moved, seconded by John Oathout to adjourn the meeting.
