The Plainview City Council met on July 10, 2012 at 7:00 p.m. in the City Council
Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting
was posted in City Hall at 4:10 p.m. on July 6, 2012. Mayor Wendell Dunlap presided.
Councilmembers present were: Charles Starnes - District 1, Cathy Waggoner- District 2,
David Garcia - District 3, V. O. Ortega- District 4, Shane Martinez- District 5, and Lionel
Garcia - District 6. Councilmember Eric Hastey- District 7 was absent.
Staff members present were: Greg Ingham -City Manager, Jeffrey Snyder- Assistant City
Manager, Leslie Pearce -City Attorney, Mike Gilliland- Director of Public Works, Will Mull -
Police Chief, Rusty Powers -Fire Chief, Sarianne Beversdorf- Director of Finance, Eric
Turner -Main Street/CVB Coordinator, Daniel Born - Information Technology Specialist
and Belinda Hinojosa -City Secretary.

Councilmember Cathy Waggoner delivered the invocation and led in the pledge of
allegiance.
Councilmember Waggoner moved to adopt the consent calendar. The motion was duly
seconded by Councilmember David Garcia and carried by unanimous vote. Items
approved on the consent calendar included the approval of the minutes of June 26,
2012 and the granting of an excused absent to Councilmember Eric Hastey.
Chief William Mull presented for consideration on first reading Ordinance No. 12 -3577,
an Ordinance of the City of Plainview, Texas, Amending Section 12.12.048 of the Code
of Ordinances to Prohibit the Parking, Stopping or Standing of any Motor Vehicle on a
Portion of Ennis Street; Providing a Penalty; Cumulativeness Clause; Conflicts Clause;
Severability Clause; and Effective Date. The City received a request from the YMCA
regarding traffic issue on Ennis at the YMCA. There is parallel parking on both sides of
the street. They asked if the Police Department could regulate traffic flow during their
games. City staff looked at several options including a crosswalk with no parking on the
east and west side. The no parking area will be 16 feet which is the length of one
vehicle. It is hoped that with proper signage, people will cross at or near the crosswalk.
This will open up line of sight for vehicles. Yellow zones will be no parking areas and
this will be worked during events.
Mayor Dunlap asked for public comment. There was no public comment.
Councilmember Starnes moved to adopt Ordinance No. 12 -3577 on first reading. The
motion was duly seconded by Councilmember Martinez.
Councilmember Lionel Garcia questioned whether the no parking area was sufficient.
Chief Mull stated he felt that 16 feet would be sufficient if the police department worked
the area.
Mayor Dunlap asked for a vote on the matter. The motion carried with Mayor Dunlap,
Councilmembers Starnes, Waggoner, David Garcia, Ortega, and Martinez voting "for"
the motion. Councilmember Lionel Garcia voted against the motion.

an Ordinance Amending the Zoning Map of the City of Plainview by Issuance of a Specific
Use Permit to Operate an Arcade in a Commercial General Business (C -3) Zoning District,
Said Parcel Being 506 West 5th Street of the Standley Addition, Block JK -2, Section N40,
78' X 140' West Side Track 17 A -4 and A, City of Plainview, Hale County, Texas;
Cumulativeness Clause; Conflicts Clause; Severability Clause; and Effective Date. Since
this is the second of two readings the Council chose to forego the staff briefing and asked
for public comment. There was no public comment. Councilmember Martinez moved to
accept Ordinance No. 12 -3576 on second reading. The motion was duly seconded by
Councilmember Waggoner and carried by unanimous vote.
Greg Ingham, City Manager presented for consideration and to take necessary action
regarding contract with Blacktopper Technology, Inc. for the 2012 Seal Coat Construction
Contract. This year the City is working with a group of about 20 other cities to do a joint
seal coat program. By working together the cities have a larger project and historically
have gotten better pricing due to the larger size of the project. This project is
coordinated by Parkhill Smith & Cooper Engineering. The low bidder on the project is
Blacktopper Technology and the City of Plainview's contract is for $420,550.82. The
City will try a section out with the coated rock and is also looking into doing fog seal on
1 t Street. The seal coating for Plainview is tentatively scheduled to start later this
month.
Mayor Dunlap asked for public comment. There was no public comment. Councilmember
Ortega moved to award contract to Blacktopper Technology for the 2012 seal coat
contract. The motion was duly seconded by Councilmember Starnes.
Mayor Dunlap asked for a vote on the matter. The motion carried by unanimous vote.
Jeffrey Snyder, Assistant City Manager presented for consideration and to take necessary
action regarding Amendment No. 1 to Contract No. CS0783 Between the City of Plainview
and Comptroller of Public Accounts State Energy Conservation Office (SECO) Related to
American Recovery and Reinvestment Act (ARRA) Energy Efficiency and Conservation
Block Grant (EECBG). In September 2010 the City received grant funds in the amount of
$86,365.00 from the State Energy Conservation Office (SECO) through the Energy
Efficiency and Conservation Block Grant (EECBG) program. The majority of this has
been used for windows and lighting upgrades at the library. There is still $12,725.00
available and the City has made a request to move funds to project equipment category.
This amendment authorizes the City to move $12,725 into a line item category where
the funds can be used to upgrade existing equipment to more efficient energy star rated
equipment, which will enable the City to use most of the remaining grant funds. This will
be used for energy efficient printers at the library and energy efficient refrigerators at other
city facilities. Staff recommends approval.
Mayor Dunlap asked for public comment. There was no public comment.
Councilmember Starnes moved to approve the Amendment No. 1 to Contract No.
CS0783 Between the City of Plainview and Comptroller of Public Accounts State Energy
Conservation Office. The motion was duly seconded by Councilmember Lionel Garcia
and carried by unanimous vote.

There being no further business, Mayor Dunlap adjourned the meeting at 7:26 p.m.
