AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS, AMENDING
SECTION 12.12.048 OF THE CODE OF ORDINANCES TO PROHIBIT
THE PARKING, STOPPING OR STANDING OF ANY MOTOR VEHICLE
ON A PORTION OF ENNIS STREET; PROVIDING A PENALTY;
CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; SEVERABILITY
CLAUSE; AND EFFECTIVE DATE.
WHEREAS, the area of Ennis Street between Olton Road (U.S. 70) and S.W. 3rd
Street (FM 3466) is congested with traffic creating public safety hazards for pedestrians
as well as vehicles; and
WHEREAS, a traffic study has been conducted which indicates the parking,
stopping, or standing of motor vehicles of any type on Ennis Street between 4 th Street
and Kirchwood Drive create the most danger to persons and property; and
WHEREAS, said traffic study has indicated that a portion of South Ennis Street
from 4 th Street to Kirchwood Drive be designated as No Parking areas with a sixteen
foot wide pedestrian crosswalk located in front of the entrance gate to the YMCA
playing field; and
WHEREAS, the City Council finds it in the best interest of the public safety and
welfare for the City of Plainview citizens to establish no parking and a pedestrian
crosswalk in a designated area of South Ennis Street.

NOW, THEREFORE, the City of Plainview Hereby Ordains that:
Section12.12.048 of the Plainview City Code of Ordinances is hereby amended
as follows:
Section 12.12.048. Parking prohibited in specific places
(m) Parking, stopping, or standing of any kind of motor vehicle on the East
side and the West side of South Ennis Street at the location of four feet on either side of
the eight foot wide marked crosswalk, including such marked crosswalk, between 4th
Street and Kirchwood Drive.

Any person who shall violate or fail to comply with the provisions of this
Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall
be punished by a fine not to exceed Five Hundred and No /100 Dollars ($500.00).

SECTION III
All ordinances or parts of ordinances inconsistent with any provision of this
Ordinance are hereby repealed to the extent of such conflict, and the provisions of this
Ordinance shall be and remain controlling as to the matters regulated herein.
SECTION IV
Severability is intended throughout and within this Ordinance. If any provision,
including any section, paragraph, sentence, clause, phrase or word or the application
thereof to any person or circumstance is held invalid, unconstitutional, or unenforceable
by a court of law or administrative agency with the jurisdiction over the matter, such
action shall not be construed to affect any other valid portion of the Ordinance. A
constitutional construction hereof is intended and shall be given. There is not intent
herein to violate either of the Texas Constitution or the Constitution of the United States.
SECTION V
Provisions of the ordinance are cumulative and nothing herein shall prevent,
alter, or diminish the applicability or enforcement of other ordinances restricting,
regulating, or governing the subject matter herein.
SECTION VI
This Ordinance shall be of full force and effect upon its passage and publication
as required by law.
