BUILDING CODE AND FIRE CODE BOARD OF APPEALS '~ _, ORDINANCE NO. 89-27.$4 AN ORDINANCE OF CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS, AMENDING CHAPTER 6 ARTICLE III (BOARD OF APPEALS) OF THE PLAINVIEW CITY CODE FOR THE PURPOSE OF .UPDATING THE. RULES AND REGULATIONS EFFECTING THE PLAINVIEW BUILDING CODE AND FIRE CODE BOARD OF APPEALS ~l~iD BRINGING THEM .INTO CONFORMANCE WITH CURRENT POLICIES OF THE CITY OF PLAINVIEW AND PROVIDING FOR AN EFFECTIVE DATE. Whereas, the City Council of the City of Plainview, Texas, has determined that there is a need for a Building-Code and Fire Code Board of Appeals in the City of Plainview to help promote the health, safety, and welf~.re of its inhabitants; and Whereas, the City Council has adapted various rules and regulations effecting all of its Boards, Commissions and Committees by Resolution R87-286; and Whereas, the City Council of the City of Plainview has considered. the need of bringing the regulations effecting the _ Building Gode and Fire Cade Board of Appeals into conformance with the existing policies and has determined it would be appropriate ~~- to do so. Now, Therefore, Be It Resolved by the City Council of the City of Plainview, Texas: Section 1: Chapter 6, Article LII, Board of Appeals, Section 6-14, Composition of the Plainview City Code be amended to read as follows: The Board of Appeals shall consist of seven (7) members. All members appointed shall not be at the time of appointment or during their term of office serve on any other Authority, Berard, Commission or Committee of the City of Plainview, without the consent of the City Council, and all members appointed shall be residents. of the City of Plainview at the time of their appointment .and during their term of office. Section 2: Chapter 6, Article III, Board of Appeals, Section 6-45, Terms, of the Plainview City Code be amended to read as follows: l of 2 __ ,- Each member of the Board of Appeals shall ~~._ ,~ serve for a term of two ( 2 ) years. No person shall serve more than two (2) full terms as a member of the Board of Appeals without the consent of the City Council.. Section 3: Chapter 6, Article III, Board of Appeals, Section 6-47, .Mandatory- Attendance Requirements, of the Plainview City Code shall be amended to read as follows: No member of the Board of Appeals shall miss three (3) consecutive meetings, whether regular, special or emergency, without acceptable reason or five such meetings during any. single anniversary year. Upon. a majority vote of the Board present and voting, the Chairperson of the Board shall request that the City Council replace the member immediately.. The Board of Appeals shall determine: what is "acceptable reasons" for missing a meeting. Secti©n 4: This Ordinance shall be effective upon its lawful passage and as allowed by law.
