BUILDING, PLUMBING, ELECTRICAL CODE AMENDMENT

AN ORDIN~4NCE OF THE CITY OF .PLAINVIEW, TEXAS
AMENDING' CHAPTER 10 OF THE PLAINVIEW CODE OF
ORDINANCES SEVERABILITY CLAUSE, CUMULATIVENESS
CLAUSE; CONFLICTS CLAUSE; AND EFFECTIVE DATE.
WHEREAS, The City of Plainview Building Trades and Fire Gode Board of
Appeals has reviewed Chapter 10 of the City of Plainview Code of Ordinances,
Electricity; and,
WHEREAS, 'The Building Trades and Fire Code Board of Appeals has
made recommendations for changes in the licensing and supervision of
apprentice electricians; and,
WHEREAS,',it is determined by the City Council that this action is in the
best interest of the citizens of Plainview and it would not be detrimental or
injurious to the public health, safety or general welfare:
NOW, THEREFORE, THE CITY OF PLAINVIEW HEREBY ORDAINS:
SECTION l:
Chaster 10 Electricity to be amended as follows:
ARTICLE 1.
IN GENERAL
Article IV, Sec. 10-~32.
Scope_of apprentice electrician license:
(a) Apprentice qualifications and experience. Anyone desiring to do work
as an apprentice electrician shall be able to read and write the English
language!,
(b) City applentice work permit. Anyone desiring to do work as an
apprentice electrician within the city shall register with the electrical
inspector band obtain from such office an apprentice license for a fee of
five doll rs ($5.00). When the application is submitted for the
apprentic license, it shall be signed by the supervising master
electricia and give the company name. Such licenses shall expire on
the thirty-first (31) day of December of each calendar year, and may be

renewed by application thereafter to the electrical inspector and
payment of a five dollars ($5.00) renewal fee.
(c) Possession of an apprentice license. Every apprentice electrician shall
keep such license in his possession and on his person at all times
when engaged in work on any electrical installation, project or site.
(d} V1(orking under supervision. Every apprentice-shall undertake electrical
work only when engaged under the direct .supervision of a master
electrician, .master sign .electrician, journeyman electrician or
journeyman.. -sign electrician. No more than three (3) apprentice
electricians shall be under the direct supervision. of a licensed
journeyman or master electrician on any individual jobsite -a ratio of 3
apprentices to each journeyman or master electrician.
SECTION II:
If any section, subsection, sentence, clause, phrase or portion of this ordinance
is, for any reason, held .invalid or unconstitutional by any court of .competent
jurisdiction, such portion shall be deemed a separate, distinct, and independent
provision and such holding shall not affect the validity of the remaining provisions
thereof.
SECTION III:
Provisions of this ordinance are cumulative and nothing herein shall prevent,
alter, or diminish the applicability or enforcement of other ordinances restricting,
regulating, or governing the subject matter herein.
SECTION IV:
All ordinances or portion of any ordinance of the City of Plainview, Texas, in
conflict herewith, are hereby amended to conform with the provisions hereof.
SECTION V:
This ordinance shall be of full force and effect upon its passage.
