The Plainview City Council met on October 9, 2012 at 7:00 p.m. in the City Council
Chambers of the Plainview City Hall' at 901 Broadway. The agenda for this meeting
was posted in City Hall at 5:05 p.m. on September 21, 2012. Mayor Wendell Dunlap
presided. Councilmembers present were: Charles Starnes - District 1, Cathy Waggoner -
District 2, David Garcia - District 3, V. O. Ortega- District 4, Lionel Garcia - District 6 and
Eric Hastey- District 7. Councilmember Shane Martinez- District 5 was absent.
Staff members present were: Greg Ingham -City Manager, Jeffrey Snyder- Assistant City
Manager, Leslie Pearce -City Attorney, Mike Gilliland- Director of Public Works, Will Mull -
Police Chief, Rusty Powers -Fire Chief, Sarianne Beversdorf- Director of Finance, Eric
Turner -Main Street/CVB Coordinator, Daniel Born - Information Technology Specialist
and Belinda Hinojosa -City Secretary.

Councilmember David Garcia delivered the invocation and led in the pledge of
allegiance.
Councilmember Lionel Garcia moved to adopt the consent calendar. The motion was
duly seconded by Councilmember Waggoner and carried by unanimous vote. Items
approved on the consent calendar included the approval of the minutes of September
25, 2012 and October 4, 2012; and the granting of an excused absence to
Councilmember Shane Martinez.
Jeffrey Snyder, Assistant City Manager presented to consider and take necessary
action to authorize Mayor to sign Texas Department of Housing Community Affairs
Home Investments Partnerships Program Reservation System Participant Agreement
#2011 -0086 with City of Plainview. In February 2012, the City Council authorized the
City to submit a grant application for the homeowner rehabilitation assistance program.
This allowed the city to rehabilitate or reconstruct single family homes. We had initially
submitted for reconstruction of five homes and the reservation system. The reservation
system allows the opportunity to reconstruct more homes.
We have been notified by TDHCA that we have been approved for the TDHCA
reservation system. There is a $10,000 match per house or 12.5 %; most of which is
met through in -kind labor. In order to move forward the Council would need to consider
approval.
Mayor Dunlap asked for public comment. There was no public comment.
Councilmember Ortega moved to authorize Mayor to sign Texas Department of Housing
Community Affairs Home Investments Partnerships Program Reservation System
Participant Agreement #2011 -0086 with City of Plainview. The motion was duly
seconded by Councilmember Starnes and carried by unanimous vote.
Mr. Snyder presented for consideration on first reading Ordinance No. 12 -3583, an
Ordinance Amending the Zoning Map of the City of Plainview For Rezoning From a Heavy
Industrial (M -2) Zoning District to a Light Industrial (M -1) Zoning District, Said Parcel Being
Lots 8 -9 and Lots 12 -14, Block 23 of the McClelland Addition, City of Plainview, Hale

County, Texas, the Same Being 1101 -1109 East Fifth Street; Cumulativeness Clause;
Conflicts Clause; Severability Clause; And Effective Date. On September 27, the Planning
and Zoning Commission reviewed and recommended approval to rezone to Light
Industrial M -1 Zoning District. Some of the lots are currently zoned M -2 and some are
zoned M -1; this would allow for one zoning district in that block.
Mayor Dunlap asked for public comment. There was no public comment.
Councilmember Waggoner moved to adopt Ordinance No. 12 -3583 on first reading.
The motion was duly seconded by Councilmember Garcia and carried by unanimous
vote.
Mr. Snyder presented for consideration on first reading, Ordinance No. 12 -3584, an
Ordinance Amending the Zoning Map of the City of Plainview By Issuance of a Specific
Use Permit to Operate Alamo Beer and Wine, a Package Store, in the Light Industrial (M-
1) Zoning District, Said Parcel Being Lots 8 -9, Block 23 of the McClelland Addition, City of
Plainview Hale County, Texas, Same Being 1101 East Fifth Street; Cumulativeness
Clause; Conflicts Clause; Severability Clause; And Effective Date. This is contingent on
approval of prior ordinance. This is request of George and Maria Flores to open a
package store. Normally alcohol requests do not go to Council, but since this is in a
manufacturing district, it is required to go through the specific use permit process. The
Planning & Zoning Commission also recommends approval.
Mayor Dunlap asked for public comment. There was no public comment. Councilmember
Waggoner moved to adopt Ordinance No. 12 -3584 on first reading. The motion was duly
seconded by Councilmember Starnes and carried by unanimous vote.
Councilmember Starnes moved to go into closed meeting to deliberate the appointment,
employment, evaluation, reassignment, duties, discipline or dismissal of a public officer
or employee, or to hear a complaint or charge against an officer or employee. [Tex.
Gov't. Code, Section 551.074]. Appointments to the following boards and commissions:
Board of Minimum Housing Standards and Runningwater Draw Retired & Senior
Volunteer Program Community Advisory Group. The motion was duly seconded by
Councilmember Ortega and carried by unanimous vote.
Mayor Dunlap recessed the meeting at 7:16 p.m.
Mayor Dunlap called the meeting back in open session at 7:35 p.m.
Councilmember Starnes moved to appoint Arthur Williams to the Board of Minimum
Housing Standards with said term to expire January 1, 2014 and to appoint Gail
Thrasher to the Runningwater Draw Retired & Senior Volunteer Program Community
Advisory Group with said term to expire December 2014. The motion was duly
seconded by Councilmember Lionel Garcia and carried by unanimous vote.
There being no further business, Mayor Dunlap adjourned the meeting at 7:36 p.m.
