City Council Minutes September 20 2012 Page 1 of 4 The City Council met on September 20, 2012, at the Plainview Convention Center, 2902 West 4t Street, Plainview, Texas. The agenda for this meeting was posted in City Hall at 11:00 a.m. on September 17, 2012. Mayor Wendell Dunlap presided. Councilmembers present were: Charles Starnes - District 1, Cathy Waggoner- District 2, David Garcia - District 3, Shane Martinez- District 5, and Lionel Garcia - District 6. Councilmembers V. O. Ortega- District 4 and Eric Hastey- District 7 were absent. Staff members present were: Greg Ingham -City Manager, Leslie Pearce -City Attorney, Sarianne Beversdorf- Director of Finance, Jeffrey Snyder- Assistant City Manager, William Mull - Police Chief, Mike Gilliland- Director of Public Works, Vanessa Rincon - Accounting Coordinator, Tammy Adams - Accounting Coordinator, Daniel Born - Information Technology Specialist and Belinda Hinojosa -City Secretary. Greg Ingham, City Manager presented for consideration on first reading Ordinance No. 12 -3578, an Ordinance of the City of Plainview, Texas, Adopting and Approving the Budget for the Fiscal Year Beginning October 1, 2012 and Terminating September 30, 2013, and Making Such Appropriations for each Department, Project and Account; Cumulativeness Clause; Conflicts Clause; Severability Clause; and Effective Date. The budget document presents in financial terms the overall plan for providing municipal services during the coming twelve months. This budget provides funds for the current level of services and provides a basis for a higher level of services in the future. It also provides funds to comply with State and Federal mandates and provides for improvements to the City's infrastructure that are necessary to ensure progress and development. The total expenditures for all funds for the coming year are $31,084,783 which is $385,000 over last year's total funds. The budgeted revenues for the major operating funds are $22,208,895. The budgeted expenditures for the major operating funds are $22,148,200. The general fund revenues for fiscal year ending September 30, 2013 are $11,894,415. The general fund expenditures for fiscal year ending September 30, 2013 are $11,978,515. The budget includes a 2.5% cost of living adjustment for all employees. The proposed tax rate for 2012 -2013 is $0.5785 which is the same as the adopted tax rate for 2011 -2012. The effective tax rate for 2012 -2013 is $0.5712 and the rollback rate for 2012 -2013 fiscal year is $0.6280. The Solid Waste Management Fund revenues for fiscal year ending September 30, 2013 are $3,101,480 and the Solid Waste Management Fund expenditures for fiscal year ending September 30, 2013 are $4,114,055. In order to fund the current operating needs for these departments and to develop a revenue stream from the Solid Waste Management Fund to the Solid Waste Improvement Fund, a two percent (2 %) increase has been included in the proposed budget. This will increase the base residential bill from $18.71 to $19.08. The 2% increase will apply to all residential and commercial classes of service. The Water & Sewer Fund revenues for fiscal year ending September 30, 2013 are $7,197,500 and the Water and Sewer Fund Expenditures for fiscal year ending September 30, 2013 are $12,672,630. In order to fund the Water and Sewer Fund adequately and to keep the funds on sound footing we have proposed an increase in the base sewer rate from $10.55 to $11.05 per month and the rate per thousand will increase from $1.53 to $1.60. These increases will raise a basic 5,000 gallon sewer bill from $18.20 to $19.05. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Starnes moved to adopt Ordinance No. 12 -3578 on first reading. The motion was duly seconded by Councilmember David Garcia. Councilmember Lionel Garcia asked where economic development was in the budget. Mr. Ingham explained that we do not have an economic development sales tax so the city tries to build up reserves in case something does come up. There are some items that are paid out of the fund such as supporting Plainview /Hale County Industrial Foundation, working on retail development, High- Ground participation, TTU Wind Development, Strategic Plan, Buxton and Retail Coach. The total budgeted amount is $130,000. Councilmember Starnes stated we did not give a cost of living raise last year. He asked if the city had looked at the history of the COLA to see how it compares to the inflation rate. He stated it would be worthwhile to find out if we are gaining or losing. Mr. Ingham stated that had not been looked at but would take it into consideration. Mayor Dunlap asked for a vote on the matter. Mayor Dunlap, Councilmembers Starnes, Waggoner, David Garcia, Martinez voted "for" the motion. Councilmember Lionel Garcia voted "against" the motion. The motion carried. Mr. Ingham presented for consideration to ratify the property tax increase reflected in the 2012 -2013 budget. The Legislature has placed a requirement on cities that the Council must take a vote to Ratify the Property Tax increase that is included in the budget they just voted to adopt. The budget has a tax rate of $0.5785 which is the same rate that we used last year but it is technically an increase because it is higher than the effective rate of $0.5712. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Waggoner moved to ratify the property tax increase reflected in the budget for Fiscal Year 2012 -2013 Budget. The motion was duly seconded by Councilmember Starnes. Mayor Dunlap, Councilmembers Starnes, Waggoner, David Garcia, and Martinez voted "for" the motion. Councilmember Lionel Garcia voted "against" the motion. The motion carried. Mr. Ingham presented for consideration on first reading, Ordinance No. 12 -3579, an Ordinance Levying Municipal Ad Valorem Taxes for the City of Plainview, Texas, for the Year 2012, and Directing the Assessment and Collection Thereof; Severability Clause; City Council Minutes September 20 2012 Page 2 of 4 143 144 Cumulativeness Clause; Conflicts Clause; Repealer; and Effective Date. Mr. Ingham stated this ordinance adopts the tax rate of $0.5785 which is included in the budget. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Starnes moved that the property tax rate be increased by the adoption of a tax rate of fifty -seven and eighty -five hundredths cents ($.5785), which is effectively a 1.278011 percent increase in the tax rate. The motion was duly seconded by Councilmember David Garcia. Mayor Dunlap, Councilmembers Starnes, Waggoner,. and David Garcia voted "for" the motion. Councilmembers Martinez and Lionel Garcia voted "against" the motion. The motion carried. Mr. Ingham presented for consideration on first reading, Ordinance No. 12 -3580, an Ordinance of the City of Plainview, Amending Section 13.02.010, Entitled "Sewer Rates" of the Code of Ordinance's of the City of Plainview, Texas; Severability Clause; Cumulativeness Clause; Conflicts Clause; Repealer; And Effective Date. The base rate would increase from $10.55 to $11.05 and the rate per thousand would increase from $1.53 to $1.60. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Starnes moved to adopt Ordinance No. 12 -3580 on first reading. The motion was duly seconded by Councilmember Waggoner. Mayor Dunlap, Councilmembers Starnes, Waggoner, David Garcia, Martinez voted "for" the motion. Councilmember Lionel Garcia voted "against" the motion. The motion carried. Mr. Ingham presented for consideration on first reading, Ordinance No. 12 -3581, an Ordinance Of The City Of Plainview, Texas, Amending Section 13.06.063, Entitled "Classes Of Service; Fees" Of The Code Of Ordinances Of The City Of Plainview, Texas; Severability Clause; Cumulativeness Clause; Conflicts Clause; Repealer; And Effective Date. The base rate would increase from $18.71 to $19.08. The 2% increase will apply to all residential and commercial classes of service. The tipping fee will remain at $41.00 per ton. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Waggoner moved to adopt Ordinance No. 12 -3581 on first reading. The motion was duly seconded by Councilmember David Garcia. Mayor Dunlap, Councilmembers Starnes, Waggoner, David Garcia, Martinez voted "for" the motion. Councilmember Lionel Garcia voted "against" the motion. The motion carried. Mr. Ingham presented for consideration on first reading, Ordinance No. 12 -3582, an Ordinance of the City of Plainview Amending Ordinance No. 11 -3561 to Appropriate Funds in the General Fund and Various Revenue and Capital Funds Pursuant to Section 5.07 (A) and (D) of the Plainview City Charter Allowing for Supplemental Appropriations in the 2011 -2012 Budget; Cumulativeness Clause; Conflicts Clause; Severability Clause; and Effective Date. We are transferring funds out of the General Fund into capital improvement, equipment replacement, and economic development funds to enable us to do additional projects, replace equipment, do major maintenance, and to continue efforts to strengthen our position in terms of encouraging job growth in Plainview. The Sanitation Fund and Water and Sewer Fund are transferring funds into their System Improvement funds so that capital improvements and major maintenance projects can be undertaken, as well as supporting the Service Center and economic development fund. City Council Minutes September 20 2012 Page 3 of 4 In the Emergency Operations we moved to purchase some items related to lighting and security at the Armory from next year's budget to the current year budget. Animal control had a couple of projects that we felt needed to move forward and some unexpected repairs on their van which will be replaced in 2012 -2013. Significant plumbing problems have struck both City Hall and the Library and we have moved forward with those projects. Budget overruns in Wastewater Treatment show up in the Water & Sewer Fund and the rebuilding of a scraper for the landfill shows up in the Solid Waste Management budget. Most of these amendments are already included in the totals shown in the Projected 2011 -2102 expenditure columns for these departments, with the most significant exception being the City Hall plumbing problem which just came up this month. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Starnes moved to adopt Ordinance No. 12 -3582 on first reading. The motion was duly seconded by Councilmember Waggoner. Councilmember Lionel Garcia asked if department heads have input as to what goes in the budget when the budget is put together. Mr. Ingham stated yes and explained the budget process. Mayor Dunlap asked for a vote on the matter. Mayor Dunlap, Councilmembers Starnes, Waggoner, David Garcia, Martinez voted "for" the motion. Councilmember Lionel Garcia voted "against" the motion. The motion carried. The Council and staff reviewed the agenda for the City Council meeting of September 25, 2012.
