HomeMy WebLinkAbout12 0925 min146 The Plainview City Council met on September 25, 2012 at 7:00 p.m. in the City Council Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was posted in City Hall at 5:05 p.m. on September 21, 2012. Mayor Wendell Dunlap presided. Councilmembers present were: Charles Starnes - District 1, Cathy Waggoner - District 2, David Garcia - District 3, V. O. Ortega- District 4, Shane Martinez- District 5, Lionel Garcia - District 6 and Eric Hastey- District 7. Staff members present were: Greg Ingham -City Manager, Jeffrey Snyder- Assistant City Manager, Leslie Pearce -City Attorney, Mike Gilliland- Director of Public Works, Will Mull - Police Chief, Rusty Powers -Fire Chief, Sarianne Beversdorf - Director of Finance, Eric Turner -Main Street/CVB Coordinator, Daniel Born - Information Technology Specialist and Belinda Hinojosa -City Secretary. News Media Present: Jessica Thornton - Plainview Herald Mayor Pro Tem Cathy Waggoner delivered the invocation and led in the pledge of allegiance. Councilmember Ortega moved to adopt the consent calendar. The motion was duly seconded by Councilmember David Garcia and carried by unanimous vote. Items approved on the consent calendar included the approval of the minutes of September 11, 2012 and September 20, 2012; and approval of the financial reports. Greg Ingham, City Manager presented for consideration on second reading Ordinance No. 12 -3578, an Ordinance of the City of Plainview, Texas, Adopting and Approving the Budget for the Fiscal Year Beginning October 1, 2012 and Terminating September 30, 2013, and Making Such Appropriations for each Department, Project and Account; Cumulativeness Clause; Conflicts Clause; Severability Clause; and Effective Date. We are in the adoption stage in the second of two readings. The budget document presents in financial terms the overall plan for providing municipal services during the coming twelve months. This budget provides funds for the current level of services and provides a basis for a higher level of services in the future. It also provides funds to comply with State and Federal mandates and provides for improvements to the City's infrastructure that are necessary to ensure progress and development. A significant effort has been made to control costs. The total expenditures for all funds for the coming year are $31,084,783. The budgeted expenditures for the major operating funds are $22,148,200. The general fund covers police protection, fire protection, EMS Service, street maintenance and park maintenance. The general fund expenditures for fiscal year ending September 30, 2013 are $11,978,515. We have removed one heavy equipment operator, one part-time summer position from streets department, and one clerical worker from the health department from the general fund. Included in the general fund is a 2.5% cost of living adjustment for all employees. We have also included an additional code enforcement officer. In order to fund the general fund, we have kept the same tax rate as in 2011 -2012. The proposed tax rate for 2012 -2013 is $0.5785 which is the same as the adopted tax rate City Council Minutes September 25, 2012 Page 1 of 5 for 2011 -2012. That is calculated to be a tax increase when compared to the effective tax rate for 2012 -2013 of $0.5712. The Solid Waste Management Fund is an enterprise fund. The proposed operating budget is fairly level. We have budgeted funds to build a ten acre, type one landfill pit at an estimated cost of $1.1 million. We are undertaking this without issuing any debt but in order to fund that we will need to increase all garbage collection fees by 2 %. The Water & Sewer Fund is an enterprise fund also. The largest part of increases in this fund is due to increase in cost of maintenance at the wastewater plant due to the fact that this plant is ten years old. Because of the increase in maintenance costs, we are proposing an increase in the base sewer rate from $10.55 to $11.05 per month and the rate per thousand will increase from $1.53 to $1.60. We are continuing to review the water rates and will have to look at our water conservation rate structure in the next few months. We will also look at water rates at the earlier part of next year. The goal is to improve services and encourage growth in the community. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Starnes moved to adopt Ordinance No. 12 -3578 on second reading. The motion was duly seconded by Councilmember Waggoner. Councilmember Martinez stated that his constituents have come up with major concern regarding paramedic staffing levels. Mr. Ingham advised that in the past two budgets some things have been done to bump up pay specifically for Fire /EMS and Police, and provide training opportunities; but we feel we need to look at a cost of living adjustment for all employees in this budget. Mayor Dunlap asked for a vote on the matter. The motion carried with Mayor Dunlap, Councilmembers Starnes, Waggoner, David Garcia, Ortega, Martinez and Hastey voting "for" the motion and Councilmember Lionel Garcia voting "against" the motion. Mr. Ingham presented for consideration to ratify the property tax increase reflected in the 2012 -2013 budget. The Legislature has placed a requirement on cities that the Council must take a vote to Ratify the Property Tax increase that is included in the budget they just voted to adopt. The budget has a tax rate of $0.5785 which is the same rate that we used last year but it is technically an increase because it is higher than the effective rate of $0.5712. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Ortega moved to ratify the property tax increase reflected in the budget for Fiscal Year 2012 -2013 Budget. The motion was duly seconded by Councilmember David Garcia. Mayor Dunlap, Councilmembers Starnes, Waggoner, David Garcia, Ortega, Martinez and Hastey voted "for" the motion. Councilmember Lionel Garcia voted "against" the motion. The motion carried. Mr. Ingham presented for consideration on second reading, Ordinance No. 12 -3579, an Ordinance Levying Municipal Ad Valorem Taxes for the City of Plainview, Texas, for the Year 2012, and Directing the Assessment and Collection Thereof; Severability Clause; City Council Minutes September 25, 2012 Page 2 of 5 147 148 Mayor Dunlap — Yes Councilmember Starnes — Yes Councilmember Waggoner — Yes Councilmember David Garcia — Yes Councilmember Ortega — Yes Councilmember Martinez — No Councilmember Lionel Garcia — No Councilmember Hastey — Yes The motion carried with a vote of 6 "for" the motion and 2 "against." Cumulativeness Clause; Conflicts Clause; Repealer; and Effective Date. Mr. Ingham stated this ordinance adopts the tax rate of $0.5785 which is included in the budget. Since this is a final reading, this will require a record vote. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Starnes moved that the property tax rate be increased by the adoption of a tax rate of fifty -seven and eighty -five hundredths cents ($.5785), which is effectively a 1.278011 percent increase in the tax rate. The motion was duly seconded by Councilmember Waggoner. Belinda Hinojosa, City Secretary asked for a record vote of the Council with the Council voting as follows: Mr. Ingham presented for consideration on second reading, Ordinance No. 12 -3580, an Ordinance of the City of Plainview, Amending Section 13.02.010, Entitled "Sewer Rates" of the Code of Ordinances of the City of Plainview, Texas; Severability Clause; Cumulativeness Clause; Conflicts Clause; Repealer; And Effective Date. The base rate would increase from $10.55 to $11.05 and the rate per thousand would increase from $1.53 to $1.60. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Waggoner moved to adopt Ordinance No. 12 - 3580 on second reading. The motion was duly seconded by Councilmember Martinez. Mayor Dunlap, Councilmembers Starnes, Waggoner, David Garcia, Ortega, Martinez and Hastey voted "for" the motion. Councilmember Lionel Garcia voted "against" the motion. The motion carried. Mr. Ingham presented for consideration on first reading, Ordinance No. 12 -3581, an Ordinance Of The City Of Plainview, Texas, Amending Section 13.06.063, Entitled "Classes Of Service; Fees" Of The Code Of Ordinances Of The City Of Plainview, Texas; Severability Clause; Cumulativeness Clause; Conflicts Clause; Repealer; And Effective Date. The base rate would increase from $18.71 to $19.08. The 2% increase will apply to all residential and commercial classes of service. The tipping fee will remain at $41.00 per ton. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Ortega moved to adopt Ordinance No. 12 -3581 on second reading. The motion was duly seconded by Councilmember Starnes. Mr. Ingham presented for consideration on second reading, Ordinance No. 12 -3582, an Ordinance of the City of Plainview Amending Ordinance No. 11 -3561 to Appropriate Funds in the General Fund and Various Revenue and Capital Funds Pursuant to Section 5.07 (A) and (D) of the Plainview City Charter Allowing for Supplemental Appropriations in the 2011 -2012 Budget; Cumulativeness Clause; Conflicts Clause; Severability Clause; and Effective Date. We are transferring for the major airport grant $216,000 into capital improvement fund. Various capital equipment is being replaced with some financed and others purchased outright. We are transferring funds to the service center which is providing services to other departments. We are also able to purchase some funds out of this year's budget so we are purchasing items for the emergency management operations center; animal control is purchasing some garage doors and doing some plumbing repairs; and city hall had a major plumbing problem. We are also taking care of some rust problems in columns at city hall. We are also working on special projects with the Downtown Association on Christmas lighting; purchasing computer equipment and some issues at library with plumbing problems. We are making transfers out of general fund into capital improvement and equipment replacement. Solid waste management is transferring funds to system improvement fund. The water and sewer revenues are running a little high so we are transferring $300,000 into system improvement and some funds into service center and economic development. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Starnes moved to adopt Ordinance No. 12 -3582 on second reading. The motion was duly seconded by Councilmember Waggoner. Councilmember Lionel Garcia asked if the $7,500 for Main Street advertisement had already been done. He was advised that yes. We had an opportunity for advertising thru the Texas Governor's office on a publication. Mayor Dunlap asked for a vote on the matter. Mayor Dunlap, Councilmembers Starnes, Waggoner, David Garcia, Ortega, Martinez and Hastey voted "for" the motion. Councilmember Lionel Garcia voted "against" the motion. The motion carried. Mr. Ingham presented for consideration to authorize Mayor to sign Texas Department of Transportation Grant for Rehabilitation and Reconstruction of Taxiways and Apron Areas and Replace Runway Lighting TxDOT Project No. AP HALE 2, Contract No. 3XXAV016. This is the first actual step on the TxDOT aviation grant of $4.3 million. This project will handle the design services for the rehabilitation and marking of these runways. The design and engineering project costs are projected to be $476,000 with the FAA paying 90% of the cost and the City /County paying the other 10% which is $47,600 combined. City Council Minutes September 25, 2012 Page 4 of 5 149 150 Once this design phase is complete we will see the total projected cost which is projected to be at $3,844,000 which will come back to Council at a later date. Councilmember Ortega moved to authorize Mayor to sign Texas Department of Transportation Grant for Rehabilitation and Reconstruction of Taxiways and Apron Areas and Replace Runway Lighting TxDOT Project No. AP HALE 2, Contract No. 3XXAV016. The motion was duly seconded by Councilmember David Garcia and carried by unanimous vote. Councilmember Starnes moved to go into closed session to deliberate the purchase, exchange, lease or value of real property, the public discussion of which would not be in the best interest of the City's bargaining position with third parties, in accordance with Tex. Gov't Code, Section 551.072. The motion was duly seconded by Councilmember Waggoner and carried by unanimous vote. Mayor Dunlap recessed the meeting at 7:30 p.m. Mayor Dunlap called the meeting back in open session at 8:03 p.m. and announced that no action would be taken.
