HomeMy WebLinkAbout12 1023 minThe Plainview City Council met on October 23, 2012 at 7:00 p.m. in the City Council Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was posted in City Hall at 4:00 p.m. on October 19, 2012. Mayor Pro Tem Cathy Waggoner presided. Councilmembers present were: Charles Starnes - District 1, David Garcia - District 3, V. O. Ortega- District 4, Shane Martinez- District 5, and Lionel Garcia - District 6. Mayor Wendell Dunlap and Councilmember Eric Hastey- District 7 were absent. Staff members present were: Greg Ingham -City Manager, Jeffrey Snyder- Assistant City Manager, Leslie Pearce -City Attorney, Mike Gilliland- Director of Public Works, Will Mull - Police Chief, Rusty Powers -Fire Chief, Daniel Born - Information Technology Specialist and Belinda Hinojosa -City Secretary. News Media Present: Jessica Thornton - Plainview Herald Councilmember V. O. Ortega delivered the invocation and led in the pledge of allegiance. Councilmember Charles Starnes moved to adopt the consent calendar. The motion was duly seconded by Councilmember David Garcia and carried by unanimous vote. Items approved on the consent calendar included the approval of the minutes of October 9, 2012 and October 18, 2012; the granting of an excused absence to Mayor Wendell Dunlap; and approval of Resolution R12 -275, a Resolution of the City Council of the City of Plainview, Texas, Approving The Request Of Plainview YMCA to Host the "YMCA 5k Road Race and 1 Mile Walk "; Authorizing the Filing of the Agreement for the Temporary Closure of State Right -Of -Way With the Texas Department of Transportation for This Road Race; Declaring that the Event Serves a Public Purpose; and Agreeing To Comply With Regulations. Greg Ingham, City Manager presented for consideration to authorize Mayor to sign Amendment No. 1 to the Airport Project Participation Agreement between Hale County and the City of Plainview and the Texas Department of Transportation, TxDOT Project No.: AP HALE, TxDOT CSJ No.: 12MPPLAIN — Airport Master Plan. This is an amendment to the Grant agreement executed in December 2011 to develop an Airport Master Plan for the Hale County /Plainview Airport and this grant is funded on a 90/10 basis. The original project was to be $180,000 with the Federal Government funding $162,000 of the project and the local sponsors funding $18,000. After TxDOT Aviation negotiated an agreement with the consultant selected for the project it was determined that the project cost would be $196,315; with the federal government providing $176,684 and the local sponsors providing $19,631. The City and County split the local sponsor cost so the City's original cost would have been $9,000 and the City's amended cost is now $9,815.50. The funding for this project is included in the 2012 -2013 Budget. Mayor Pro Tem Waggoner asked for public comment. There was no public comment. Councilmember Ortega moved to authorize Mayor to sign Amendment No. 1 to the Airport Project Participation Agreement between Hale County and the City of Plainview and the Texas Department of Transportation, TxDOT Project No.: AP HALE, TxDOT City Council Minutes October 23, 2012 Page 1 of 3 155 156 CSJ No.: 12MPPLAIN — Airport Master Plan. The motion was duly seconded by Councilmember Martinez and carried by unanimous vote. Mr. Ingham presented for consideration Resolution R12 -276, a Resolution Setting a Date, Time, and Place for Public Hearings on the Proposed Annexation of Certain Property by the City of Plainview, Texas; Authorizing the Mayor to Have Affected Persons Notified and Publish Notice of Such Public Hearings in the City of Plainview, Hale County, Texas; and Directing Staff to Inventory City Services Extended to Such Property in a Preliminary Municipal Service Plan and Provide an Updated Map. The Zeini Group LLC has asked the City to annex approximately 54.77 acres of their property located at 5205 North Interstate 27. The Zeini Group LLC owns the property and will be the landlord of their sister company Andalucia Nuts, which is currently in the process of opening a peanut processing division in the facility. This is a new business operating just outside the City Limits and since it is a food processing business, they would' prefer to have water from an approved municipal source. This Resolution sets two public hearings regarding this annexation request scheduled for Tuesday, November 27, 2012 at 7:00 pm at City Hall and a second public hearing on Tuesday, December 11, 2012 at 7:00 pm at City Hall. Notices of the Hearings will be sent to property owners, entities that provide services in the proposed annexed area, railroads that have right of way in the area, the School District, and anyone else required by law. The City will prepare a Municipal Service Plan that will state how services will be provided to the area in accordance with the Texas Local Government Code. Once this process has been completed, an Ordinance will be adopted regarding the annexation. Consideration of this Resolution by the Council is the first step in annexing the requested property. Mayor Pro Tem Waggoner asked for public comment. There was no public comment. Councilmember Martinez moved to accept Resolution R12 -276. The motion was duly seconded by Councilmember David Garcia and carried by unanimous vote. Mayor Pro Tem Waggoner presented for consideration on second reading Ordinance No. 12 -3583, an Ordinance Amending the Zoning Map of the City of Plainview For Rezoning From a Heavy Industrial (M -2) Zoning District to a Light Industrial (M -1) Zoning District, Said Parcel Being Lots 8 -9 and Lots 12 -14, Block 23 of the McClelland Addition, City of Plainview, Hale County, Texas, the Same Being 1101 -1109 East Fifth Street; Cumulativeness Clause; Conflicts Clause; Severability Clause; And Effective Date. Since this was the second of two readings, the Council chose to forego the staff briefing and asked for public comment. There was no public comment. Councilmember Ortega moved to adopt Ordinance No. 12 -3583 on second reading. The motion was duly seconded by Councilmember Lionel Garcia and carried by unanimous vote. Mayor Pro Tem Waggoner presented for consideration on second reading Ordinance No. 12 -3584, an Ordinance Amending the Zoning Map of the City of Plainview By Issuance of a Specific Use Permit to Operate Alamo Beer and Wine, a Package Store, in the Light Industrial (M -1) Zoning District, Said Parcel Being Lots 8 -9, Block 23 of the McClelland Addition, City of Plainview Hale County, Texas, Same Being 1101 East Fifth Street; City Council Minutes October 23, 2012 Page 2 of 3 Cumulativeness Clause; Conflicts Clause; Severability Clause; And Effective Date. Since this was the second of two readings, the Council chose to forego the staff briefing and asked for public comment. There was no public comment. Councilmember Starnes moved to adopt Ordinance No. 12 -3584 on second reading. The motion was duly seconded by Councilmember David Garcia and carried by unanimous vote.
