AN ORDINANCE OF THE CITY COUNCIL OF THE .CITY OF
PLAINVIEW, TEXAS AMENDING THE PLAINVIEW CODE OF
ORDINANCES, CHAPTER 7, ARTICLE 6, ENTITLED "PEDDLERS,
ITINERANT VENDORS AND SOLLCITORS"
WHEREAS, the City of Plainview recognizes a measure of regulation is
necessary to provide the citizens of Plainview with information relating to peddlers,
itinerant vendors, and solicitors who solicit or canvass. within the City of Plainview; and
WHEREAS, the City of Plainview recognizes a measure of regulation is
necessary to protect the citizens of Plainview from. deceptive and dishonest practices
from those persons and organizations who solicit and canvass within the City of
Plainview; and
WHEREAS, the City of Plainview recognizes a change in these regulations is
necessary due to the changes in the insurance industry as it relates to the bonds for
peddlers, itinerant vendors, and solicitors' changes in rules regulating them are
necessary.
NOW, THEREFORE,.. BE IT ORDAINED by the City Council of the City of
Plainview that:
Section I
The Plainview City. Code Section 7-203 (f) shall be amended to read as follows:
(f) Each application for an itinerant vendor's license shall be
accompanied by a license fee of seventy-five dollars
($75.00) #or the applicant and an additional fifteen dotlars
($15.00) for each employee, agent, or representative of the
applicant vendor who will sell, offer, exhibit, or solicit orders
for the sale of goods, wares, or merchandise for or on behalf
of the applicant vendor.
The Plainview City Code Section 7-204 shall be deleted in its entirety.
Section II
Provisions of this ordinance are cumulative and nothing .herein shall
prevent, alter, or diminish the applicability or enforcement of other ordinances
restricting, regulating, or governing the subject matter herein.

Section III
Alf ordinances or portions of any ordinance of the City of Plainview, Texas
in conflict herewith, are hereby amended to conform with the provisions hereof.
Section IV
Should any section, subsection,. or any portion hereof be deemed invalid
for any reason, such holding shall not render or invalidate any other section,
subsection, sentence, provision, clause, phrase, or word severable therefrom
and the same shall be deemed severable for this purpose.
Section V
This ordinance shall be in full force and effect upon its passage and
publication as required by law.
PASSED AND APPROVED on first reading this the 26t" day of November, 2002.
PASSED AND APPROVED on second reading this the 10t" day of December,
2002.
