The Plainview City Council met on October 8, 2002 at 7:00 p.m. in the City Council
Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting
was posted in City Hall at 1:30 p.m. on October 1, 2002. Mayor Lloyd C. Woods
presided. Councilmembers present were: Kelvin Tipton-District 1, Belinda Pena-District
3, John N. Bertsch-District 4, RoSs Owen-District 5, Buddy McGehee-District 6 and
Irene Favila-District 7. Councilmember Mary Jane Shanes-District 2 was absent.
Staff members present were: James P. Jeffers-City Manager, Elizabeth Regner-
Assistant City Manager, Dale Simpson-Civil Service Director, John Berry-Director of
Public Works, Gary Glass-Fire Chief, Wally Hatch-City Attorney, John Castro-Director of
Community Services, Will Mull-Police Chief, Jack McCasland-Sanitarian, Linda Milner-
RSVP Director and Belinda Hinojosa-City Secretary.
Guests present were: Payton Harrell, Caleb Norrell, and Jeff Harrell
Councilmember Tipton delivered the invocation.
The Boy Scouts led in the Pledge of Allegiance.
Councilmember Favila moved to adopt the consent calendar. The motion was duly
seconded by Councilmember Owen and carried by unanimous vote. Items approved on
the Consent Calendar included: approval of the minutes of September 24, 2002 and
October 3, 2002; receipt of departmental reports; approval of expenditures and the
granting of an excused absence to Councilmember Shanes.
Mayor Woods stated Councilmember Pena has declared a conflict of interest on the
below listed matters. Mr. John Castro, Director of Community Services presented for
second reading Ordinance No. 02-3355, an Ordinance Amending The Zoning Map of the
City of Plainview By Issuance of a Specific USe Permit To Operate An Adult Day Care
Center in a General Commercial (C-3) Zoning District Said Parcel Of Land Being Lot 1,
Cooper-Pardo Subdivision, Out of the Lakeside Addition, the Same Being 1709 North
Columbia Street; Cumulativeness Clause; Conflicts Clause; Severability Clause; And
Effective Date and presented for second reading Ordinance No. 02-3356, an Ordinance
Amending the Zoning Map of the City of Plainview, Texas For Rezoning Of Lot 1, Cooper-
Pardo Subdivision From a Light Manufacturing (M-l) Zoning Distdct to a General
Commercial (C-3) Zoning District, Plainview, Texas Cumulativeness Clause; Conflict
Clause; Severability Clause; And Effective Date. 1709 North Columbia Mr. Castro
stated there was sufficient parking at this time with additional space in the back should
more parking be required. The Planning & Zoning Commission has recommended its
approval of both Ordinances.
There was no public comment.
Mayor Woods moved that Ordinance' No. 02-3355 be approved upon second reading.
The motion was duly seconded by Councilmember Owen and carried unanimously with
Cou ncilmember Pena abstaining.
Councilmember Owen moved that Ordinance No. 02-3356 be approved upon second
reading. The motion was duly seconded by Councilmember Favila and carried
unanimously with Councilmember Pena abstaining.

John Castro-Director of Community Services presented for first reading Ordinance No. 02-
3357, an Ordinance of the City Of Plainview, TexaS, Amending Section 34.7 Fence And
Wall Regulations Of The City Of Plainview Zoning Ordinance No. 89-2798; Regarding
Fence Requirements In Front Yards Of Residential Districts; Severability Clause;
Cumulativeness Clause; Conflicts Clause; Effective Date. The current Ordinance states,
"All fences and walls in the required front yard, except headlight screens required by
Section 31.9, shall be at least fifty (50) percent open." The Planning & Zoning
Commission reviewed the ordinance and was unanimously in agreement to remove the
50% open requirement.
There was no public comment.
Councilmember Tipton moved that Ordinance No. 02-3357 be approved upon first
reading. The motion was duly seconded by Councilmember McGehee and carried
unanimously.
Elizabeth Regner, Assistant City Manager presented the RSVP Annual Report. She
introduced Linda Milner, the new RSVP Coordinator.
Jack McCasland, Sanitarian presented a re port on the Health Alert Network.
Mayor Woods moved the Council go into Closed Session to deliberate the appointment,
employment, evaluation, reassignment or duties, removal, discipline or dismissal of a
public officer or employee, board, commission, or committee member, or to hear
complaints or charges. [Tex. Gov't. Code Section 551.074]. City Manager and City
Attorney. The motion was duly seconded by Councilmember Owen and carried
unanimously.
Mayor Woods recessed the meeting into closed session at 7:24 p.m.
The Council reconvened in open session at 8:21 p.m. and did not take any action.
Councilmember Favila moved the meeting be adjourned. The motion was duly
seconded by Councilmember McGehee and carried by unanimous vote.
There being no further business, Mayor Woods adjourned the meeting at 8:21 p.m.
