The Plainview City Council met on February 12, 2013 at 7:00 p.m. in the City Council
Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting
was posted in City Hall at 3:45 p.m. on February 8, 2013. Mayor Wendell Dunlap
presided. Councilmembers present were: Cathy Waggoner- District 2, David Garcia -
District 3, V. O. Ortega- District 4, Shane Martinez- District 5, Lionel Garcia - District 6 and
Eric Hastey- District 7. Councilmember Charles Starnes - District 1 was absent.
Staff members present were: Greg Ingham -City Manager, Jeffrey Snyder- Assistant City
Manager, Leslie Pearce -City Attorney, Mike Gilliland- Director of Public Works, Todd
Kennemer- Community Development Manager, Dennis Harkins - Police Captain, Daniel
Born - Information Technology Specialist, Rusty Powers -Fire Chief and Belinda Hinojosa-
City Secretary.
Mayor Pro Tem Cathy Waggoner delivered the invocation and led in the pledge of
allegiance.
Councilmember Ortega moved to adopt the consent calendar. The motion was duly
seconded by Mayor Pro Tem Waggoner and carried by unanimous vote. Items
approved on the consent calendar included the approval of the minutes of January 22,
2013 and February 7, 2013; the granting of an excused absence to Councilmember
Charles Starnes; and authorizing Mayor to sign Amendment to Program Attachment
#002 to Contract #2013 - 041481 in accordance with Amendment No. 002A:
Immunization Branch - Locals between the Department of State Health Services and
Plainview -Hale County Health District.
Mike Gilliland, Director of Public Works presented for consideration Resolution R13-
281, a Resolution of the City Council of the City of Plainview, Texas Accepting the
Public Improvements, Including but not Limited to Water, Sewer, Streets, and Alley
Paving for the Wofford Subdivision in the City of Plainview, Hale County, Texas and
Declaring the Public Purpose as Furthering Economic Development. City staff would
like the Council to consider accepting the public infrastructure added by the Wofford
Subdivision. The subdivision is on Mesa Drive between 15 and 16 Public streets,
paved public alley, water, sewer have all been installed and tested in accordance with
state and local laws. The value of these improvements is approximately $271,000. The
City of Plainview is ready at this time to take over these improvements for operation and
maintenance.
Mayor Dunlap asked for public comment. There was no public comment. Mayor Pro
Tem Waggoner moved to adopt Resolution R13 -281. The motion was duly seconded
by Councilmember David Garcia and carried by unanimous vote.
Mr. Greg Ingham, City Manager presented for consideration Resolution R13 -282, a
Resolution of the City Council of the City of Plainview, Texas, Supporting the Legislative
Activity and Goals of the Alliance Of Xcel Municipalities (AXM) Before The Texas
Legislature as They Relate to Jurisdiction for the Setting of Electric Utility Rates and
Regulation of Electric Utilities; Finding and Determining that the Meeting at which this
Resolution was Passed was in Accordance with the Requirements of the Texas Open
Meetings Act; Making Other Findings and Provisions Related to the Subject; and

Declaring an Effective Date. State law provides cities with exclusive original jurisdiction
over electric utility rates within the city, and also provides for reimbursement of the
City's expenses to fully participate in ratemaking proceedings both at the City level and
before the Public Utility Commission of Texas. A recent report issued by the House
State Affairs Committee proposes to eliminate the City's local control over electric utility
rates and proposes to eliminate the provision of State law that provides for
reimbursement of the City's expenses. Each of these provisions, if allowed to become
law, would seriously jeopardize the City's ability to fully participate in the rate setting
process.
Plainview has participated in a coalition of cities known as the Alliance of Xcel
Municipalities. which is all cities that are currently served by Xcel in the Panhandle and
South Plains of Texas, for a number of years with regard to electric utility rates and the
setting of rates.
In a 2006 rate case, Xcel asked for $47.90 million and they were approved for $22.90
million. In a 2010 rate case, Xcel asked for $63.70 million and they were approved for
$44.60 million. We feel it helps our customers.
The Alliance of Xcel Municipalities goal is to help protect customers and work with Xcel
because we want to have strong utilities. We are asking the Council to approve this
resolution which would oppose any legislation that would impact the city's rate making
jurisdiction or the process for reimbursement of our expenses.
Mayor Dunlap asked for public comment. There was no public comment.
Councilmember Martinez moved to accept Resolution R13 -282. The motion was duly
seconded by Councilmember Hastey and carried by unanimous vote.
Captain Dennis Harkins presented the Racial Profiling Report for 2012.
Mayor Dunlap asked for public comment. There was no public comment.
Councilmember David Garcia moved to accept the Racial Profiling Report. The motion
was duly seconded by Mayor Pro Tem Waggoner and carried by unanimous vote.
There being no further business, Mayor Dunlap adjourned the meeting at 7:31 p.m.
