SO ~S TO MAKE THE FOLLOWING CHANGES:
ZONE C~SE NO. 551.'
Request of William W. Harlan for rezoning a 1.636 acre tract of
land from an R-1 (Single-Family Residential) Zoning District to a
C.R.D. (Commercial Retail) Zoning District for commercial uses and
described as'follows:
Being a 1.636 acre tract as recorded in Volume 749, page 609,
of the Hale County Deed Records out of the south part of the
southwest quarter of Survey No. 38, Block JK-2, Hale County, Texas:
BEGINNING at a 1/2 inch steel rod set in the north right of way
line of West 24th Street as recorded in Volume 417, page 511 of the
Hale County Deed Records, said rod being 1155 feet East and 30 feet
North of the southwest corner of Survey No. 38, Block JK-2, Hale
County, Texas;
Thence North 434.64 feet along the east line of a 4 acre tract
as recorded in volume 676, page 65 of the Hale County Deed Records
to a 1/2 inch steel rod set for the northwest corner of said 1.636
acre tract, said rod being in the south line of UNIT 5, THUNDERBIRD
ADDITION TO THE CITY OF PLAINVIEW, HALE COUNTY, TEXAS, final plat
recorded in Volume 440, page 397 of the Hale County Deed Records;
Thence East along the south side of an alley, at 147.5 feet
pass the southeast corner of said UNIT 5, and the southwest corner
of UNIT 2, THUNDERBIRD ADDITION TO THE CITY OF PLAINVIEW, HALE
COUNTY, TEXAS, final plat recorded in Volume 383, page 249 of the
Hale County Deed Records, in all, 164 feet to a 1/2 inch steel rod
set for the northeast corner of said 1.636 acre tract;
Thence South 434.64 feet along the east line of said tract and
the west line of a 2 acre tract as recorded in Volume 738, page 49
of the Hale County Deed Records to a 1/2 inch steel rod set in the
north right of way line of West 24th Street;
Thence West 164 feet along the north right of way line of said
street to the POINT OF BEGINNING and containing 1.636 acres; and
located at 1406 West 24th.
WHEREAS, the proposed change in Zoning District as hereinafter
made has been duly presented to the Planning and Zoning Commission
for its recommendation which was received by the City Council, after
due consideration, the City Council of the City of Plainview finds
that for the orderly growth of the City making the proposed change
as hereinafter set out will be in the public interest which creates
and emergency; and

WHEREAS, all conditions precedent required by law for a valid
amendment to the Zoning Ordinance and Map, have been fully complied
with, as well as giving notices provided by Article 1011F Vernon's
Annotated Civil Statutes - Amended, 1953, and notice was duly
published in the Plainview Daily Herald more than fifteen (15) days
prior to the date of the Public Hearing according to said notice was
duly held in the City Council Room of the City Hall, Plainview,
Texas, at which time persons appeared in support of the proposal;
and after said hearing, it was by the City Council determined that
it would be in the public interest due to changed conditions, that
the Zoning Ordinance and the Zoning Map be amended in the manner
hereinafter set forth in the body of this Ordinance; NOW, THEREFORE;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAI1FVIEW:

be and the same are hereby amended as follows, to-wit:

SECTIO~ 2. A notice that a public hearing shall be held in the
Council Chamber of the City Hall in Plainview, Texas at 7:30 P.M.,
on the 28th day of July, 1987, to permit the public to be heard
prior to consideration of this Ordinance was published in the
Plainview Daily Herald, a daily newspaper of general circulation in
the City of Plainview, Texas, said publication being more than
fifteen (15) days prior to the time designated for said hearing.

If recommended for approval or if recommended for denial and a
notice of appeal is filed in pursuant to the Plainview Zoning
Ordinance, the Mayor and City Council will hold a public hearing on
the 28th day of July, 1987, at 7:30 P.M., in the Council Chamber of
the City City Hall, 901 Broadway, Plainview, Texas, to consider the
recommendations made to it by the City Planning and Zoning
Commission and at which time all interested person will again be
given an opportunity to be heard.
