ORDINANCE 87-2733
AN ORDINANCE FIXING THE MAXIMUM RATE OF SPEED
FOR MOTOR VEHICLES; ALLOWING FOR SPEED ZONES;
PROVIDING FOR PENALTY; AND DECLARING AN EMERGENCY
WHEREAS, the City Council of the City of Plainview, Texas, upon the
basis of engineering and traffic investigation, find it necessary to establish
maximum speed limits, and create speed zones in certain areas all within
the Corporate Limits of the City of Plainview, Texas.
WHEREAS, the City Council of the City of Plainview, Texas, also finds
it is necessary to immediate preservation of the public health and safety
to provide for the immediate enactment of such measures, constituting an
emergency;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PLAINVIEW, TEXAS;
SECTION 1. Subsection (A). Speed restrictions. It shall hereafter
be unlawful for any person to drive or operate a motor vehicle upon any
street, roadway or highway in the City Limits of the City of Plainview,
Texas, at a speed greater than is reasonable and prudent under the conditions
then existing, having regard to the actual and potential hazards when approaching
and crossing an intersection or a railway grade crossing, when approaching
and going around a curve, when approaching a hill crest, when travelling
upon any narrow or winding roadway, or when special hazard exists with respect
to pedestrians or other traffic or by reason of weather or highway conditions;
and in every event, speed shall be so controlled as may be necessary to
avoid colliding with any person, vehicle or other conveyance on or entering
the highway in complaince with legal requirements and the duty of all persons
to use due care.

Subsection (B). Where no special hazard exists that requires lower
speed for compliance with Subsection 1 (A) of this Section, the speed of
any vehicle not in excess of the limits specified in this Subsection or
established as hereinafter authorized shall be lawful, but any speed in
excess of the limits specified in this Subsection or established as hereinafter
authorized shall be prima facie evidence that the speed is not reasonable
or prudent and that it is unlawful:
The speed zones established by this Ordinance shall include
all of that .portion of S.H. 194beginning at the point
of intersection with the Northwest City Limit, a point
.007 mile northwest of the centerline of Highland Road,
the maximum legal speed for both northwestbound and south-
eastbound traffic shall be 55 MPH for a distance of 0.872
mile; thence 45 MPH for a distance of 0.821 mile to a point
0.006 mile northwest of the centerline of West 24th Street;
thence 40 MPH for a distance of 0.974 mile to the point
of intersection with the centerline of West llth Street;
thence 35 MPH for a distance of 0.538 mile to the point
of intersection with the centerline of U.S. 70, West 5th
Street.
And all Ordinances and parts of Ordinances in conflict herewith are
hereby repealed.
SECTION 2. Any person violating any of the provisions of this Ordinance
shall, upon conviction thereof, be fined in any sum not less than Ten ($10.00)
nor more than Two Hundred ($200.00) Dollars.

and safety create a necessity requiring all rules providing
that no Ordinance shall be finally passed on the day of its
introduction be suspended; and this Ordinance is declared to
be an emergency measure, to take effect from and after the date
of its first publication.

RESOLUTION
On this 8th day of December , 1987, at a regular meeting
of the City Council of the City of Plainview, Texas, among other things,
there was considered by the Council a survey of speed of motor vehicles
made by the State Department of Highways and Public Transportation of the
State of Texas on or about the period between August 3, 1987 and September
4, 1987, inclusive, within the City of Plainview, Texas, and which was presented
to the Council for discussion, along with maps, charts, and figures of such
survey and together with recommendations and proposals as to the adoption
of speed zones on S.H. 194 in and through said City; and
WHEREAS, the City Council of the City of Plainview, Texas, by appropriate
actions has adopted such speed zone Plan of regulating the speed of motor
vehicles on the highways in the City of Plainview, as presented and outlined
in such survey, with certain modifications, and has on this date made and
passed an ordinance regulating the same;
NOW, THEREFORE, be it resolved that the City Council of the City of
Plainview, does hereby request the State Department of Highways and Public
Transportation of the State of Texas to come into the City Limits of the
City of PlainView, Texas, and erect speed zone signs on S.H 194 in and through
said City, in accordance with such survey and as may hereafter be changed,
modified, or agreed upon.

Dear Johnnie:
A resurvey of the speeds traveled by vehicles on S.H. 194 in the City Limits
of Plainview was initiated and the enclosed maps and sample documents are
sent to you for review and approval by the City. The following information
is enclosed:
1. Two copies each of the two strip maps for S.H. 194 from the
Northwest City Limit to the intersection with U.S. 70.
2. City Secretary's Certificate
3. Sample Resolution
4. Sample Ordinance
If this proposed speed zoning meets with the approval of the City and is
passed by the City Council, please return to this office three each copies
of the City Secretary's Certificate, the Resolution and the Ordinance.
Upon receipt of these signed documents the State will erect the necessary
signs for this speed zoning of S.H. 194.
