ORDINANCE NO. 88-2734
AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS AMENDING
ARTICLE 10, MUNICIPAL COURT, OF THE PLAINVIEW CITY CODE,
BY ADDING SECTION 2-231 RELATING TO FINES AND SPECIAL
EXPENSES TO INCORPORATE CHANGES MADE IN STATE LAW AS
MORE FULLY SET OUT HEREIN; PROVIDING FOR EXPENSES AND
AN EFFECTIVE DATE.
WHEREAS, the 70th Legislature of the State of Texas has amended
state law in regard to the special expenses which may be imposed by
a municipal court when dismissal is required because of acts
occurring subsequent to the offense alleged, and
W~F. REAS, the City Council of the City of Plainview, TeXas finds
it to be in the best interest of the public to adopt the fines and
special expenses now allowed by state law.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PLAINVIEW:
That the Code of the City of Plainview, Texas is hereby amended
by adding Section 2-231, which Section shall read as follows:
Section 1. Fines and Special Expenses.
Ail special expenses described in Article 45.06, Code
of Criminal Procedure, as amended, dealing with
special expenses for the issuance and service of a
warrant of arrest for an offense under Article 38.11
of the Penal Code, or under Section 149 of the Uniform
Act Regulating Traffic on Highways (Article 6701d,
Vernon's Texas Civil Statutes, as amended), after due
notice, not to exceed $25.00 (twenty five dollars),
shall be paid into the City treasury for the use and
benefit of the City.
Ail special expenses described in Article 45.06, Code
of Criminal Procedure, as amended, dealing with the
dismissal of certain misdemeanor charges upon
completing a driving safety course, not to exceed the
actual expenses incurred for the service or $10.00
(ten dollars), which ever is less, shall be paid into
the City treasury for the use and benefit of the City.
Section 2.
