HomeMy WebLinkAbout88-2739SECOND DRAFT ELECT_IONS FOR MUNICIPAL OFFICERS ORDINANCE NO. 88-2739 AN ORDINANCE OF THE CITY OF YLAINVIEW, TEXAS WITH REGARD TO ELECTIONS' FOR MUNICIPAL OFFICE~ TO CONFORM TO THE TEXAS ELECTION CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR-PUBLICATION. W/4EREAS, the 70th Legislature of the State of Texas at its Second Called Session enacted House Bill No. 28 which changes uniform election dates and runoff election dates available to home rule cities within the State of Texas; and WHERe', said provisions of law require designation of dates by municipal governing bodies and supersede city charter provisions conflicting with such changes; and WHEREAS, the City Council of the City of Plainview believes that it would be in the best interest of the citizens of the City of Plainview to indicate by ordinance when the City of Plainview's general elections of municipal officers and any required runoff elections are to be held: N~,THKREFORE, BEIT O~NEDBYTHECITY CO~CILOFTHECITY OF P~I~I~ Section. 1. Regular Municipal Elections. The regular municipal election for the election of municipal officers of the City of Plainview shall be held on the first Saturday in May of even numbered years in accordance with the applicable provisions of the Texas Election Code. 378 Section 2. Runoff Election. Where in any election for elective office, no candidate receives a majority of all of the vo~es cast for such office at such. election, the City Council shall immediately upon declaring the official results of such election, issue a call for a runoff election for every place to which no one was elected. Such runoff election shall be hetd-on the third Saturday of May, and in such runoff election the two candidates who received in the preceding election the highest number of votes for each place shall be voted upon, and the candidate who receives the majority of the vo-tes case for such place in the runoff election skall be declared elected to such office-. SECTION 3. THAT should any section, paragraph, sentence, clause~ phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby au-thorized and directed to cause p~blication of the descriptive caption of this Ordinance as an alternative method of publication provided by law. 379 SECTION 5. passage.
