HomeMy WebLinkAbout88-274440'0 PUBLIC SERVICE - RATE DECREASE ORDINANCE NO. 88-2744 AN ORDINANCE APPROVING A DECREASE IN THE RATES WHICH MAY BE CHARGED BY SOUTHWESTERN PUBLIC SERVICE COMPANY IN THE CITY OF PLAINVIEW, TEXAS; PROVIDING FOR AN EFFECTIVE DATE FOR SUCH RATES; AND PROVIDING FOR EMERGENCY PASSAGE. WHEREAS, on February 22, 1988, Southwestern Public Service Company filed with the City of Plainview a request for a decrease in rates to be charged within the City of Plainview; and WHEREAS, the City of Plainview has received the Application for such proposed rate decrease and has conducted an informal public hearing thereon in accordance with Section 43(c) of the Public Regulatory Act at which it considered the analysis of its rate consultants, evidence from representatives of Southwestern Public Service Company and comments from the public; and WHEREAS, the City of Plainview finds that a decrease in rates in the amount hereafter set forth should be approved; NOW, THE~RFORE, BE IT ORDAINED by the City Council of the City of Plainview, Texas: SECTION 1: That a decrease in the rates, tariffs and charges of Southwestern Public Service Company for electric power and energy sold within the City of Plainview be approved in an amount that as applied to the Texas retail system would decrease the system-wide operating revenues for~ said company by $14,400,000, based on annualized test year usage. SECTION 2: Southwestern Public Service Company's Schedule of Rates and Tariffs, as are hereby approved, are those under which said Company shall be authorized to render electric service and to collect charges frOm its customers in accordance therewith for the sale of electric power and energy within the corporate limits of the City of Plainview on and after March 28, 1988, and until such time as said Rates and Tariffs might be changed, modified, amended or withdrawn. SECTION 3: That the action of the City Council of the City of Plainview enacting this ordinance constitutes, on its effective date, a final determination of rates for Southwestern Public Service Company in accordance with Section 43 of the Public Utility Regulatory Act. SECTION 4: The necessity to effect this change in the authorized rates at the earliest possible date so that a financial return may begin creates an emergency and it is an imperative public necessity that more than one reading thereof be, and the same is hereby suspended; this ordinaDce shall be passed and take effect from and after its passage as provided by law, and it is so ordained. 1 of 2 401 PASSED AND APPROVED, on first day of March , 1988.
