The Plainview City Council met on March 12, 2013 at 7:00 p.m. in the City Council
Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting
was posted in City Hall at 5:00 p.m. on March 8, 2013, Mayor Wendell Dunlap
presided. Councilmembers present were: Charles Stames- District 1, Cathy Waggoner -
District 2, David Garcia - District 3, V. O. Ortega- District 4, and Shane Martinez- District 5.
Councilmembers Lionel Garcia - District 6 and Eric Hastey- District 7 were absent.
Staff members present were: Greg Ingham -City Manager, Jeffrey Snyder - Assistant City
Manager, Leslie Pearce -City Attorney, Mike Gilliland - Director of Public Works, Todd
Kennemer - Community Development Manager, William Mull - Police Chief, Daniel Born -
Information Technology Specialist, Rusty Powers -Fire Chief, Sarianne Beversdorf-
Director of Finance and Belinda Hinojosa -City Secretary.

Councilmember V. O. Ortega delivered the invocation and led in the pledge of
allegiance.
George Meriwether with Davis, Kinard & Co., P.C. George Meriwether with Davis,
Kinard & Co., PC presented the Comprehensive Annual Financial Report for year ended
September 30, 2012. The City received a clean opinion or unqualified opinion which is
the highest and best opinion they can render. He stated the city records are in good
condition and the finance staff is doing a great job.
Mayor Dunlap asked for public comment. There was no public comment.
Councilmember Starnes moved to approve and accept the Comprehensive Annual
Financial Report for Fiscal Year 2011 -2012. The motion was duly second by
Councilmember Ortega and carried by unanimous vote.
Mayor Dunlap presented for consideration on second reading Ordinance No. 13 -3590,
an Ordinance Continuing Chapter 8, Article 8.05, Juvenile Curfews of the Code of
Ordinances of the City of Plainview, Texas Defining Terms; Providing Curfew Hours for
Juveniles; Offenses and Defenses For Juveniles; Penalty For Violation Of The Curfew
Ordinance By Juveniles, Their Parents or Guardians, and Owners, Operators and
Employees of Business Establishments of a Fine Not to Exceed $500; Repealer;
Severability Clause; Cumulativeness Clause; Conflicts Clause; Effective Date; and
Providing for Publication and Enforcement of Such Ordinance. Since this is the second
of two readings, the Council chose to forego staff brieing and asked for public comment.
There was no public comment. Councilmember Ortega moved to adopt Ordinance No.
13 -3590 on second reading. The motion was duly seconded by Councilmember
Waggoner and carried by unanimous vote.
Todd Kennemer, Community Development Manager presented for consideration on first
reading Ordinance No. 13 -3591, an Ordinance Amending the Zoning Map of the City of
Plainview, Texas for Rezoning From an Agriculture ( "A ") Zoning District to a Single - Family
Residential ( "R -1 ") Zoning District Said Parcels Being Lots 63 -64 of the La Mesa
Subdivision, Unit 10, City of Plainview, Hale County, Texas, the Same Being 3301 and
3201 S.W. 8th Street; Cumulativeness Clause; Conflicts Clause; Severability Clause; And

184 Effective Date. The items on today's agenda are a simple rezone and plat of the same
property. The property is located at SW 8' and Ennis. The property is currently zoned
agriculture and they are requesting to change the zoning to R -1 single family residential.
The property meets all regulations and the Planning and Zoning Commission recommends
approval and City staff recommends approval.
Mayor Dunlap asked for public comment. There was no public comment. Councilmember
Martinez moved to adopt Ordinance No. 13 -3591 on first reading. The motion was duly
seconded by Councilmember David Garcia and carried by unanimous vote.
Mr. Kennemer presented to consider and take necessary action regarding Combination
Plat of La Mesa Subdivision, Unit 10, Plainview, Hale County, Texas. This is the plat of
the property in the previous ordinance. This is two lots with over an acre in size a piece.
It blends in with existing area. Staff recommends approval.
Mayor Pro Tern Waggoner moved to approve the Combination Plan of La Mesa
Subdivision, Unit 10, Plainview. Hale County, Texas. The motion was duly seconded by
Councilmember Starnes and carried by unanimous vote.
Councilmember Ortega moved to go into closed session to deliberate the purchase,
exchange, lease or value of real property, the public discussion of which would not be in
the best interest of the City's bargaining position with third parties, in accordance with
Tex. Gov't Code, Section 551.072. The motion was duly seconded by Councilmember
David Garcia and carried by unanimous vote.
Mayor Dunlap recessed the meeting at 7:35 p.m.
Mayor Dunlap called the meeting back in open session at 7:53 p.m. and announced no
action would be taken.
There being no further business, Mayor Dunlap adjourned the meeting at 7:53 p.m.
