UNIFORM BUILDING CODE - 1988
ORDINANCE NO. 88-2757
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
PLAINVIEW, TEXAS, REGULATING THE ERECTION,
CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING,
REMOVAL, DEMOLITION, CONVERSION, OCCUPANCY, EQUIPMENT
USE, HEIGHT, AREA, AND MAINTENANCE OF ALL BUILDINGS
AND/OR STRUCTURES IN THE CITY OF PLAINVIEW, TEXAS;
PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION
OF FEES, THEREOF; PROVIDING PENALTIES FOR THE
VIOLATION THEREOF; REPEALING ORDINANCE NO. 86-2642
OF THE CITY OF PLAINVIEW, AND ALL OTHER ORDINANCES
AND PARTS OF ORDINANCES IN CONFLICT HEREWITH;
PROVIDING FOR THE ADOPTION OF THE 1988 EDITION OF THE
UNIFORM BUILDING CODE, VOLUME 1, AS COPYRIGHTED IN
1988 BY THE INTERNATIONAL CONFERENCE OF BUILDING
OFFICIALS, WHITTIER, CALIFORNIA, WITH CERTAIN
AMENDMENTS THERETO; DIRECTING PUBLICATION OF THE
DESCRIPTIVE CAPTION OF THIS ORDINANCE, WITH THE
PENALTY PROVISION OF THE UNIFORM BUILDING CODE 1988
EDITION; AND PROVIDING AN EFFECTIVE DATE OF THIS
ORDINANCE.
WHEREAS, the City Council of the City of Plainview has found
the present Building Code of the City of Plainview has become
obsolete; and
WHEREAS, the City Council appointed the Fire Code/Building Code
Board of Appeals to prepare recommendations for the City Council in
regard to a new Building Code; and
WHEREAS, the Fire Code/Building Code Board of Appeals
recommends the Uniform Building Code, 1988 Edition, with certain
amendments thereto, be adopted as the Building Code of the City of
Plainview;
NOW, T~RREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PLAINVIEW, TEXAS:
SECTION 1.
That the Uniform Building Code, 1986 Edition
(being Ordinance No. 86-2642 of the City of
Plainview) be, and the same is hereby repealed.
SECTION 2.
That the 1988 Edition of the "Uniform Building
Code", Volume 1, as copyrighted in 1988, by the
International Conference of Building Officials,
Whittier, California, as hereinafter amended is
specifically adopted as the Building Code of the
City of Plainview, Texas, and a copy is attached

hereto and incorporated herein by reference as
though set out completely in detail.
A copy of said Uniform Building Code shall be filed with the City
Secretary and a copy maintained in the office of the Building
Official of the City of Plainview, Texas, all such copies to be open
to publiC inspection during business hours of the offices where they
are maintained, with the following amendments thereto;
SECTION 3.
That Chapter 2, Section 205, of the "Uniform
Building Code", 1988 Edition, shall be and the
same is hereby amended by the addition thereto of
a new paragraph which shall read as follows:
"Any. person, firm, or corporation violating any of
the provision of this Code shall be deemed guilty
of a misdemeanor, and each such person shall be
deemed guilty of a separate offense for each and
everyday or portion thereof during which any
violation of any of the provisions of this Code is
committed, continued, or permitted, and upon
conviction of any such violation such person shall
be punishable by a fine of not more than One
Thousand Dollars, ($1,000.00)."
SECTION 4.
That Section 304, (b) and (c), of the "Uniform
Building Code", 1988 Edition, shall be amended to
read as follows:
"(b) Any person desiring a building permit shall
at the time of filing an application therefore, as
provided in Section 301, of this Code, pay to the
Building Official a fee as set out by separate
ordinance.
There shall be no charge for first re-inspection
of new buildings and additions or alterations of
old buildings, and when more than one
re-inspection per permit is required, a
re-inspection fee of $20.00 for each additional
re-inspection shall be charged. The re-inspection
fee must be paid at the City Hall before a further
inspection will be made."
(c) Plan Checking fees. Whenever a plan is
required to be submitted by sub-section (b),
Section 302, of the "Uniform Building Code"
adopted in Section 2 of this ordinance, a Plan
Checking fee shall be paid to the Building
Official at the time of submitting the plans and
specifications for checking. Said Plan Checking
fee shall be equal to one-half of the Building
Permit fee as set out by special ordinance.

SECTION 5:
That Chapter 3 of the "Uniform Building Code",
1985 Edition is hereby amended by and adding
thereto a section to be known as Section 308 to
read as follows:
SECTION 308: (A) No person or persons shall
hereafter move any building, house or structure
within the limits of the City of Plainview, Texas,
where the same shall be moved in, through or upon
the streets, alleys, avenues, or public grounds
unless said person shall, before moving said
building house or structure, secure a permit to do
so from the Building Official of the City of
Plainview, Texas.
(B) No person or persons shall hereafter move any
building or structure from within or from outside
the City limits of the City of Plainview, Texas,
to any place within the City limits of the City of
Plainview, Texas, or cause the same to be done,
without first obtaining a separate building permit
for each building or structure from the Building
Official of the City of Plainview, Texas.
(C) Whenever any person or persons shall make an
application for a building permit for a building
or structure which is to be moved from outside the
City limits of the City of Plainview, to a place
inside the City limits, the said person shall
deposit with the Building Official a sum of money
equal to twenty-five cents (.25¢) per mile for
each mile necessary to travel from the City limits
of Plainview to the building and return to the
City limits of the City of Plainview, plus a sum
of money equal to the sum of ten dollars ($10.00)
per hour based upon the Building Official's
estimated time required to make the inspection and
in traveling to said building and returning to the
City limits of the City of Plainview with a
minimum of one hour charged on each inspection.
Said deposit shall become the property of the City
of Plainview and is to pay for the extra expense
for inspecting said building and shall not be
returned to the person making application
regardless of whether or not the Building Permit
is issued. Such payment shall be in addition to
the regular fees required for issuing a building
permit as set out, and prescribed by special
ordinance.
(D) The Building Official may designate a
competent deputy to make such inspection for him,
who shall, in such event, be paid the sum of

twenty-five cents (.25¢) per mile for travel
outside the City limits of the City of Plainview
in making the inspection, plus the amount of ten
dollars ($10.00) per hour for each hour of time
necessary to'make the inspection and travel from
the City limits of the City of Plainview to said
place where the building or structure to be
inspected is located and return to the City limits
of the City of Plainview with a minimum of 1 hour
charge for each inspection.
SECTION 6:
That Chapter 5, Section 503 (d) of the "Uniform
Building Code", 1988 Edition, shall be and the
same is hereby amended by the addition thereto of
a new paragraph which shall read as follows:
"EXCEPTION 4: Occupancy Group R buildings with an
attached garage shall not be required to have one
hour fire resistive separation between the garage
and living quarters."
SECTION 7:
That Chapter 22 of the "Uniform Building Code",
1988 Edition is hereby amended by adding thereto a
section to be known as Section 2205, which said
section shall read as follows:

(1) The ground shall Slope away from the house at all locations.
SECTION 8:
That Chapter 29 Table No. 29-A, of the "Uniform
Building Code", 1988 Edition is hereby amended to
read as follows:

Note:
Where unusual conditions or frost conditions are found,
footings and foundations shall be as required in Section
2907(a).
The ground under the floor may be excavated to the elevation of
the top of the footing.
Foundations may support a roof in addition to the stipulated
number of floors. FoUndations supporting roOfs only shall be
as required for supporting one floor.
Increase footing two inches in thickness and width for brick
veneer.
Increase re-enforcing steel by one additional bar, and one
additional size of brick veneer.
Ail dowel rods to be the same size as re-enforcing steel.
SECTION 9:
Chapter 29 of the "Uniform Building Code", 1988
Edition shall be amended to include a new Table to
be designated as Table 29A-1, and by the addition
to read as follows:
SECTION 2905 (a) General. The classification of
the soil under all portions of every building shall
be based upon the examination of adequate tests
borings or excavating made at the site when
required by the Building Official. The location of
the test boring or excavations and the nature of
the sub-surface materials shall be indicated on the
plans.
EXCEPTION: Design criteria for foundation and
footings in one and two story building housing
groups R-3 and M-1 Occupancies, Type V
Construction, where engineering design is not
provided shall be set for in Tables 29-A and 29-A1.

SECTION 10: That Section 2907 (A) of Chapter 29 of the "Uniform
Building Code", 1988 Edition shall be amended to
read hereafter as follows:
(a) General. Footings and Foundations, unless
otherwise specifically provided, shall be
constructed of solid masonry or concrete and shall
be in all cases extended below the frost line.
Foundation walls supporting wood shall extend at
least eight inches (8") above the finish grade
adjacent to the wall at all points. Footings shall
have a minimum depth as indicated in Table No. 29-A
unless another depth is recommended by a foundation
investigation.
SECTION 11: That Section 2517 (g) 1. of Chapter 25 of the
"Uniform Building Code," 1988 Edition shall be
amended by adding the following:
Ail exterior and interior walls of conventional
light-frame construction shall be framed on 16"
centers with not less than 2 inch by 4 inch
material.
SECTION 12: That Chapter 25 Table No. 25-R3, of the "Uniform
Building Code," 1988 Edition is hereby amended to
read as follows:

Utility grade studs shall not be spaced more than 16 inches on center,
nor support more than a roof and ceiling, nor exceed 8 feet in height
for exterior and load bearing walls or 10 feet for interior non-load
bearing walls.
Shall not be used in exterior walls.

Listed heights are distances between points of lateral support placed
perpendicular to the plane of the wall. Increases in supported height
are permitted where justified by analysis.
SECTION 13:
That Section 2517(h) of Chapter 25 of the "Uniform
Building Code", 1988 Edition shall be amended by
adding the following:
In conventional, light-frame construction, rafters
and ceilings joists shall be of not less than 2
inch by 6 inch nominal material with rafters
framed on a minimum 24" on center ceiling joists
at 16" on center unless an approved truss system
is used for the roof framing.
SECTION 14:
Severability Clause. If any provisions of this
Ordinance or of the Code hereby adopted or the
application thereof to any person or circumstance
is held invalid, the remainder of the Code, and
the application of such provisions to other
persons or circumstances, shall not be affected
thereby.
SECTION 15:
The City Secretary is hereby authorized and
directed to cause the publication of the
descriptive caption of this ordinance together
with the penalty provisions as provided herein.
This ordinance shall become effective after its
passage and publication as required by law.
