Mayor Wendell Dunlap presided. Councilmembers present were: David Garcia - District
3, V. O. Ortega- District 4, Shane Martinez- District 5, and Lionel Garcia - District 6.
Councilmembers Charles Starnes - District 1, Cathy Waggoner- District 2 and Eric
Hastey- District 7 were absent.
Staff members present were: Greg Ingham -City Manager, Leslie Pearce -City
Attorney, Sarianne Beversdorf- Director of Finance, Jeffrey Snyder- Assistant City
Manager, William Mull - Police Chief, Todd Kennemer- Community Development

Councilmembers Charles Starnes - District 1, Cathy Waggoner- District 2 and Eric
Hastey- District 7 were granted excused absences.
Greg Ingham, City Manager presented for consideration on second reading Ordinance
No. 13 -3597, an Ordinance of the City of Plainview, Texas Approving A Settlement
Agreement Between The Alliance Of Xcel Municipalities ( "AXM ") And Southwestern
Public Service Company ( "SPS" Or "Company ") Regarding The Company's Statement
Of intent To Change Electric Rates In All Cities Exercising Original Jurisdiction;
Declaring Existing Rates To Be Unreasonable; Adopting Tariffs That Reflect Rate
Adjustments Consistent With The Settlement Agreement And Finding The Rates To Be
Set By The Attached Tariffs To Be Just And Reasonable; Finding The City's Rate Case
Expenses Reasonable; Directing SPS To Reimburse The City Its Reasonable Rate
Case Expenses; Determining That This Ordinance Was Passed In Accordance With
The Requirements Of The Texas Open Meeting Act; Declaring An Effective Date;
Providing A Repealer; Providing Severability; And Requiring Delivery Of This Ordinance
To The Company And Legal Counsel. The original filing was for $90 million and the
proposed settlement is for $50.8 million taking effect in two steps with $37 million taking
effect on May 1, 2013 and step 2 with a $13.8 million increase on September 1, 2013.
The overall impact on an average residential bill after step 2 implementation will be
about 6.6% on overall bill - base rate, fuel, and cost recovery factor and about 9.3% on
base rates. This helps us avoid multiple rate cases during the rest of 2013.
Mayor Dunlap asked for public comment. There was no public comment.
Councilmember Lionel Garcia moved to adopt Ordinance No. 13 -3597 on second
reading. The motion was duly seconded by Councilmember David Garcia and carried
by unanimous vote.
The Council and staff reviewed the agenda for the City Council meeting of May 28,
2013.

There being no further business, Mayor Dunlap adjourned the meeting at 11:54 a.m.
