HomeMy WebLinkAbout88-2772PARKING - CE~TAINVEHICLES ORDINANCE NO. 88-2772 AN ORDINANCE REGULATING THE PARKING OF CERTAIN VEHICLES ON STREETS IN THE CITY OF PLAINVIEW; PROVIDING REGULATIONS PERTAINING TO THE PARKING OF VEHICLES UPON THE STREETS OF THE CITY OF PLAINVIEW, PROVIDING SEVERABILITY, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Plainview, Texas finds that parking of certain vehicles and trailers upon certain streets within the City is injurious to the public enjoyment of the streets; and WHEREAS, the City Council finds that the parking of said vehicles and trailers on certain streets under specified conditions should be prohibited; and WHEREAS, the City Council finds it to be in the best interest of the citizens of the City of Plainview to prohibit the parking of certain vehicles and trailers upon the streets under the terms and conditions set forth. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS that: Section 1: It shall be unlawful for any person owning or having control of any truck, bus, or trailer having a carrying capacity in excess of one ton or which is more than (20) twenty feet in length, or (7) seven feet in width to park the same upon any street not designated as a Truck Route in the City of Plainview, or upon any street at a location that is within 100 feet of any single-family residence zone in the City; provided, however, the provisions of this section shall not be deemed to prohibit the parking of any truck, bus, or trailer on any street for the purpose of the actual loading and unloading of goods, wares, and merchandise when such vehicle is accompanied by driver; and provided further, "loading" and "unloading" as used in this section shall be limited to the actual time necessarily consumed in such operation. Section 2: Exemptions to this ordinance are vehicles commonly known and used as recreational vehicles. These are, and may not be limited to include, motor homes, camping trailers and boats. Section 3: Truck Routes are designated in the City of Plainview by Ordinance No. 66-951 and codified in Section 23-253, Code of Ordinances - City of Plainview. 1 of 2 Section 4: Should any paragraph, sentence, clause, word, or phrase be subsequently interpreted as unconstitutional or unlawful, the remainder of this ordinance shall remain unaffected. Section 5: lawful passage. This ordinance shall become effective upon its Passed and approved on first~ reading this December , 1988.
