HomeMy WebLinkAbout03 0325 minThe Plainview City Council met on March 25, 2003 at 7:00 p.m. in the City Council Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was posted in City Hall at 9:00 a.m. on Mamh 19, 2003. Mayor Mary Jane Shanes presided. Councilmembers present were: Kelvin Tipton-District 1, Belinda Pena-District 3, John N. Bertsch-District 4, Ross Owen-District 5, Buddy McGehee-District 6 and Irene Favila-District 7. Staff members present were: James P. Jeffers-City Manager, Dale Simpson-Civil Service Director, Wally Hatch-City Attorney, Will Mull-Police Chief, Gary Glass-Fire Chief, John Berry-Director of Public Works, John Castro-Director of Community Development, Jason Thompson-Main Street Coordinator and Belinda Hinojosa-City Secretary. News Media Representative: Richard Orr-Plainview Daily Herald Guests present were: John Anderson and George Meriwether Councilmember Bertsch delivered the invocation. The Girl Scouts led in the Pledge of Allegiance. Councilmember Owen moved to adopt the consent calendar. The motion was duly seconded by Councilmember Pena and carried by unanimous vote. Items approved on the Consent Calendar included: approval of the minutes of March 11,2003 and March 20, 2003; receipt of departmental reports; and approval of expenditures. No bids were received for the mosquito aerial spraying. The Council approved the appointment of Kenny Brown as an alternate to the Board of Adjustments with a term to expire January 1, 2004. The Council approved upon second reading Ordinance No. 03-3373, an Ordinance of the City of Plainview calling and setting the date for the Special Municipal Election; Designating districts and polling places for Districts 1, 2, 3, 4, 5, 6 and 7; Designating the election of a Mayor; Designating Early Voting Ballot Board Judge; Designating district polling place judges; Setting hourly rate for election officials; And posting Notice of Election. This election is to elect a Mayor at large to complete the unexpired term vacated due to the death of Mayor Lloyd C. Woods. The Council approved upon first reading Ordinance No. 03-3374, an Ordinance Amending the City of Plainview Code of Ordinances Chapter 2 Administration, Authorizing a Collection Fee in the Amount of 30% of Each Delinquent Debt and Account Receivable, Including Adjudicated Court Fines And Fees, Referred to Law Firm for Collection; Cumulativeness Clause; Conflicts Clause; Severability Clause; And Effective Date. This Ordinance authorizes an additional 30% collection fee on each delinquent debt in municipal court referred to the law firm for collection. Mayor Shanes read upon second reading Ordinance No. 03-3372, an Ordinance amending the zoning map of the City of Plainview, Texas for rezoning from single family (R-2) Residential Zoning District to Commercial General Business (C-3) Zoning District said parcel being Lot 9, West 55' - 8, Block 1, Titus and Pillow Addition, same being 802 and 804 W 24th Street, Plainview, Hale County, Texas, cumulativeness clause; conflict clause; severability clause; and effective date. Since this was the second of two readings and there was no public comment at the last meeting, the Council chose to forego the staff briefing and chose to go straight to public comment. There was no public comment. Councilmember Favila moved that Ordinance No. 03- 155_ City of Plainview Minutes March 25, 2003 Page 1 of 2 15 6 3372 be adopted upon second reading. The motion was duly seconded by Councilmember McGehee and carried unanimously. John Berry presented for Duncan Addition, Unit No. 2, Replat of Lots 34 J, 34 K, L1 and L2, Plainview, Hale County, Texas. Since portions of lots cannot be sold, the replatting of these lots will clean up this tract of property that is not currently in compliance. Mr. Berry stated that the Planning and Zoning Commission has recommended approval. Mayor Shanes opened the pUblic hearing. There was no public comment. Mayor Shanes moved that the Duncan Addition, Unit No. 2, Replat of Lots 34 J, 34 K, L1 and L2 be approved. The motion was duly seconded by Councilmember Owen and carried unanimously. George Meriwether presented the Comprehensive Annual Financial Report. He stated that the City received a "clean opinion." He stated the City was in very good condition and praised the assistance of Jack Keller, Tammy Adams and Kristi Hatch during the audit. Mayor Mary Jane Shanes moved to accept the Report. The motion was duly seconded by Council Favila and carried unanimously.
