HomeMy WebLinkAbout00-3269ORDINANCE NO. 00-3269 AN ORDINANCE OF THE CITY OF PLA1NVIEW, TEXAS, AMENDING SECTION 12- 122 OF THE CODE OF ORDINANCES TO PROHIBITING THE PARKING OR THE PARKING, STOPPING OR STANDING OF ANY MOTOR VEHICLE ON A PORTION OF SOUTI-I ENNIS STREET, PLAINVIEW, TEXAS, PROVIDING A PENALTY; CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; SEVERABILITY CLAUSE; AND EFFECTIVE DATE. WHEREAS, a traffic study has been conducted which indicates the parking or parking, stopping, or standing of motor vehicles of any type on South Ennis Street between SW 3a and to a point 580 feet South of said intersection of SW 3a and South Ennis be prohibited as creating a hazardous situation for persons and property; and WHEREAS, said traffic study has indicated that the portion of South Ennis Street from SW 3ra and to a point 580 feet South of said intersection ofSW 3~a and South Ennis Street be designated as no parking. Parking on the East and the West side of South Ennis Street from SW 3~a to a point 580 feet South of said intersection of SW 3~ and South Ennis Street being prohibited under said No Parking section of City Ordinances. WHEREAS, the City Council of the City of Plainview, Texas has determined that it would be in the best interest of the public that parking or parking, stopping or standing of motor vehicles of any kind be prohibited on said portiOn of South Ennis Street, City of Plainview, Texas NOW, THEREFORE, BE IT ORDAINED by the City of Plainview, Texas: SECTION I Parking or Parking, Stopping, or Standing of any kind of motor vehicles on the East side and the West side of South Ennis Street from a point 580 feet South of said intersection of SW 3~a and South Ennis Street is prohibited.' SECTION II. Should any section, subsection, or any portion hereof be deemed invalid for any reason, such holding shall not render or invalidate any other section, subsection, sentence, provision, clause, phrase, or word severable therefrom and the same shall be deemed severable for this purpose. Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish the applicability or enforcement of other ordinances restricting, regulating or governing the subject matter herein. SECTION IV. All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith, are hereby amended to conform with the provisions hereof. SECTION V This ordinance shall be of full force and effect upon its passage.
