HomeMy WebLinkAbout89-2797ZONE CASE 557 - SPECIFIC USE PERMIT -.JESUS HERNANDEZ ORDINANCE NO. 89-2797 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 82-2478 AND THE OFFICIAL ZONING MAP OF THE CITY OF PLAINVIEW SO AS TO MAKE THE FOLLOWING CHANGES. ` ZONE .CASE NO. 557- Request of Jesus Hernandez, for a Specific Use Permit - Club Serving Alcoholic Beverages in a C.B. (Central Business District) Zoning District, being Lots 27, 28, 29 and 30, Block 26, Original Town Addition .and located at 617 Ash. WHEREAS, the proposed Specific Use Permit as hereinafter made has been duly presented to the Planning. and Zoning Commission for its recommendation which was received by the City Council and after due consideratY'on, the City Council of the City of Plainview finds. that for the orderly growth of the City making the proposed change is hereinafter set out wild be in the public interest which creates'an emergency; and WHEREAS, all conditions precedent required by-law for a valid amendment to the Zoning Ordinance and Map, have been fully complied with, as we1T as giving notices .provided by Article 1011F Vernon's annotated Civil Statutes - Amended, 1953, and notice was duly published in the Plainview Daily Herald more than fifteen {15) days prior to the date of the Public Hearing according to said notice was duly held in the City Council room of the City Hall, Plainview,. Texas, at which time persons appeared in support of the proposal; and after said hearing, it was by the City Council determined that it would be in the public interest due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of the Ordinance. NOW, THEREFORE, BE IT ORDAINED., by the City Council of the City of Plainview: SECTION 1. That Ordinance No. 82-2478 and the Official Zoning Map be and the same are hereby amended as follows, to wit: ZONE CASE NO. 557: Request of .Jesus Hernandez, far a Specific Use Permit - Club Serving Alcoholic Beverages in a C.B. (Central Business District) Zoning. District, .being Lots 27, 28, 29 and 30, Block 26, Original Town Addition and located at 617 Ash. --, 1 of 2 From the. date of this Ordinance, said lot, tract and parcel of land described .shall be and- hereby be changed to indicate a Specific.. Use Permit subject to the following conditions: 1. That a fence, not less than six (6) feet in height., shall be constructed and maintained by Applicant at the- location shown on the Site Plan, attached hereto and marked as Exhibit "A". The gate upon said fence shall be closed and secured by lock during the- Club's business hours, the purpose being to .discourage vehicle;and pedestrian traffic in the rear area of the Club. 2. That panic bar-.equipped doors are installed and utilized at the rear-exits of the Club and the doors shall be kept closed during business hours of the Club.. 3. That two (2) uniformed security guards shall. be provided by Applicant and present at all times during the Club's business hours. 4. That three {3) lights, of not less than 7000 illumines each, be placed upon the property at the locations designated on the Site Plan, attached hereto-and marked as Exhibit "B". 5. That the property be kept clean of trash/debris at all times. ~~~' It is expressly provided that the Permit is granted subject to the above conditions and Applicant's abiding thereby.. Failure to comply may result in revocation of the Permit by the City Council and a reversion of the property's zoning status to C.B. The Official Mag is amended in accordance herewith. SECTION 2. A notice that a public hearing ,shall be held in the. Council Chambers in the City Hall in Plainview, Texas, at 7:30 P.M. on the 25th day of July 1989, to permit the public to be heard prior to consideration of this Ordinance was published in the Plainview Daily Herald, a daily.- newspaper of general circulation in the City of Plainview, Texas, said publication being more .than fifteen {15) days prior to the time designated for said hearing. 2 of 3 ~~ Introduced and Public Hearing held on 22nd day of August, 1989. My reasons and/or comments are.-as follows: I am opposed to :the zone request of Jesus Hernandez. I have a business located across the street from the .premises being considered. There are several reasons for my opposition. .First., there is insufficient street parking to accomodate this, type of business. The only off-street parking around here is my parking lot--which will mean broken glass and other trash continually, not only in the downtown area generally, but also on my property.. Secondly, it is very dark downtown,. partially-due to the street lights no longer being turned on, which worsens during the winter months when the time changes and darkness comes much earlier. I have a hard working staff, all of which are female. There are numerous occasions they work late after dark.. They.. do not want to have to worry about walking to their cars--nor do I. Safety, itself, if not just plain harassment that can be expected by patrons of such a club, should be an important consideration. I will try`to be there at the hearing, but, if not, any of my ~_ employees are authorized to speak against the zone request on my behalf. My employees' names are: Darlene Curry, Ruth Faulks, Rhonda. I do not like the thought of having to go outside (in the dark or in the daylight) and running the risk of someone being drunk and out there waiting!.! Jesse is a hard worker and strive very hard'to make his business one that obeys the laws and rules he is to abide by. I have a tax and bookkeeping business in the same block where he wands to open`a club, this is to say I have no objection to a club- near my business, I feel that it will help to have. more people on this street at the time of night that his club would be open be- cause with more people a.found it should .cut down on the number of break in's. There would be mare protection for our business be- cause the police would be checking on our street mope, as they would be checking to see if their was any disturbance at the club. I work late at night four months of the year, .and feel safer with move people vn the street, on the other eight months, with more people on the street someone would hesitate to break into ~ business on abusy street. ,: , This should bring more revenue to the down town area since so many business have moved out on West Fifth street. First of atL, I think the owner, Mr. Jesse Hernandez, seems to run hts business very welt. He seems to have everything ~indPr. control and well under proportion, an^~ ^e+~tai.nty keeps evervnne sattsified, The only think Lacking is more space for his customers. P1eih~ more° room to move around in, I think it would make h`ts customers atot happier, more relaxed, and would he more enjovahte. , Second, the people are very kind and generous. Everyone gets along with one another. Since 2 can recall, there has not been any f i~hts or Jiff icutties throughout the five years I have done to DJ'S. Their bartenders and waitresses skive you excellent service. ~~, Last, their protection is very Qood. There~s a security guard watchinx what's going on insidQ the club. There is much tight outside the club so where as you don't worry much ahaut having someone damar~e or break tnto yo~~r car.
