HomeMy WebLinkAbout00-3258SIGN CODE AMENDMENT ORDINANCE NO. 00-3258 AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS AMENDING CHAPTER 19 OF THE PLAINVIEW CODE OF ORDINANCES SEVERABILITY CLAUSE, CUMULATIVENESS CLAUSE: CONFLICTS CLAUSE: AND EFFECTIVE DATE. WHEREAS, The City of Plainview Planning and Zoning Commission met in open session and approved the proposed change to the current Sign Code, and WHEREAS, The City Council of the City of Plainview is enacting this Ordinance to establish reasonable regulations for the posting of temporary signs on public and private property, and WHEREAS, The City Council finds that temporary signs provide an important medium through which individuals may convey a variety of noncommercial and commercial messages. However, left completely unregulated, temporary signs can become a threat to public safety as a traffic hazard and detriment to property values and the City's overall public welfare as an aesthetic nuisance, and WHEREAS, To balance the rights of individuals to convey their messages through temporary signs and the right of the public to be protected against the unrestricted proliferation of signs, and WHEREAS, To further the objectives of the City's comprehensive plan, and WHEREAS, To protect the public health, safety, and welfare, and WHEREAS, To reduce traffic and pedestrian hazards, and WHEREAS, To protect property values by minimizing the possible adverse effects and visual blight caused by temporary signs, and WHEREAS, To promote economic development, and WHEREAS, To ensure the fair and consistent enforcement of the temporary sign regulations specified below, NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Plainview, Texas that: SECTION I: Article VI of Chapter 19 of the Plainview Code of Ordinances is hereby amended to add the following: ARTICLE VL SIGNS Section 308. Locations Permitted and Prohibited. a. ~). Portable _signs that will be in place for seven days or less will not require a p_e_r, mi_t~_. h Portable display signs shall meet all the setback requirements as for other._sjg.n~ sba_Il be_a_ng_hored to the ground, and all electrical connections shall meet current City of Plainview Electrical Code requirements. Portable signs are considered temporary signs. Portable sign permits shall be for a maximum period of ninety (90) days~._No more than one (1) portable sign permit shall be issued within a six (6) month period for the same lot/tract. SECTION II: If any section, subsection, sentence, clause, phrase or portion of this ordinance is, for any reason, held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining provisions thereof. SECTION III: Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish the applicability or enforcement of other ordinances restricting, regulating, or governing the subject matter herein. SECTION IV: All ordinances or portion of any ordinance 'of the City of Plainview, Texas, in conflict herewith, are hereby amended to conform with the provisions hereof SECTION V: This ordinance shall be of full force and effect upon its passage.
