ORDINANCE NO. 00-3252
AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS
AMENDING CHAPTER 19 OF THE PLAINVIEW CODE OF
ORDINANCES SEVERABILITY CLAUSE, CUMULATIVENESS
CLAUSE: CONFLICTS CLAUSE: AND EFFECTIVE DATE.
WHEREAS, The City of Plainview Planning and Zoning Commission met in open
Session and approved the proposed changes to the current Sign Code, and
WHEREAS, The City Council of the City of Plainview finds it in the best interest of
The citizens of Plainview to adopt the most recent edition of the Uniform Sign Code
Copyrighted in 1997 by the International Conference of Building Officials, Whittier,
California.
NOW, THEREFORE, BE IT ORDAINED the City of Plainview hereby ordains:
SECTION I:
Article VI of Chapter 19 of the Plainview Code of Ordinances is hereby deleted in part and
amended to add the following:
ARTICLE VI.
SIGNS
Sec. 19-81. Sign code adopted.
The 1997 Edition, Uniform Sign Code, as copyrighted in 1997 by the International Conference of Building
Officials, Whittier, California, as hereinafter amended, is specifically adopted as the Sign Code of the City of
Plainview, Texas, and a copy is attached hereto and incorporated herein by reference as though set out completely in
detail. A copy of said Uniform Sign Code shall be filed with the city secretary and a copy maintained in the office
of the building official of the City of Plainview, Texas. All such copies to be open to public inspection during
business hours of the offices in which they are maintained. (Ord. No. 71-1158, § 2, 4-5-71; Ord. No. 82-2499, § 2,

Sec. 19-82. Amendments.
The sign code adopted by the provisions of this article is hereby amended, altered and changed in the
following respect:
Section 103.3 Board of Appeals. Is hereby amended to add the following sentence:
See Section 6-41 of the Cit~ of Plainview Code of Ordinances for means of appeal.
Section 103.4 of the 1997 Edition, Uniform Sign Code, shall hereafter read as follows:
Sec. 103..4 Violation and penalties. It shall be unlawful for any person, finn or corporation to erect,
construct, enlarge, alter, repair, move, improve, remove, convert, demolish, equip, use or maintain any sign or
structure in the city, or cause or permit the same to be done, contrary to or in violation of any of the provisions of
this code.
Any person, firm or corporation violating any of the provisions of this code shall be guilty of a
misdemeanor and each such person shall be deemed guilty of a separate offense for each and every day or portion

thereof during which any violati~ff o~f any of the provisions of this cOde is commftt~l, continued or permitted, and
upon conviction of any such viOlation such person shall be punishable by a frae of not more than one thousand

Section 303 - Exemptions. 3. Signs less than 6 feet (1829 mm) above grade. Is hereby deleted in fin
entire _ty.
Section 304 of the sign code is hereby amended to read as follows:
Sec. 304.. 1 Fee Schedule. A sign permit fee shall be paid at the lime application is made for erection of a
sign. Sign permit fees are as follows:
All Signs $20.00
ITo include: Billboard, Wall, Pole, Marquee,
Portable, Ground, Roof, Ternporarp and Projecting Signs)
Reinspection or Red Tag Fee
After Hours Inspection
(After hours inspections are between the hours of
5:O0 pm and 8:O0 am. Monday through Friday,. All daf on
CitF recognized holidays and weekends.)

Section 304.2 Investigation Fees: Work without a permit
Section 304.2.1 Investigation. Whenever any work for which a permit is required by thi.q code has been
commenced without first obtaining said permit, a special investigation shall be made before a permit may be issued
for such work.
Section 304.2.2 Fee. An investigation fee, in addition to the permit fee, .qhall be collected whether or not a
permit is then or subsequently issued. The invest~ gation fee shall be equal to the amount of the permit fee required
by this code. The payment of such investigation fee shall not exempt any person from compliance with all other
provisions of this code nor from any penalt~ prescribed by law.
Chapter 3 of the sign code is hereby amended by adding the following sections thereto, reading as follows:

Section 308.
Locations Permitted and Prohibited.
Height requirements for Pole Signs will be 70' maximnm~ measured from surronnding natural
grade to the furthest point at the top of the sign structure. In the event that the natural grade is
above the nearest adiacent street curb line, the curb line will be the measuring point
Minimum height clearance on Pole Signs will be 8' measured from lowest projecting point on
the sign to natural grade or curb line, whichever poim is highest.
Section 403.1 General. Tables 4-B and 4-C are hereby deleted in their entire _ty.
Sections 403.5, 403.6, 503.1,803.1, 903.2, 1003.1, 1003.2, 1103.1, 1103.2 are hereby deleted in
their entirety.
Section 1402.3 Clearance. Is hereby amended by deleting the second i~araexavh
SECTION II:
If any section, subsection, sentence, clause, phrase or portion of this ordinance is, for any
reason, held invalid or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct, and independent provision and such holding
shall not affect the validity of the remaining provisions thereof.
SECTION III:
Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or
diminish the applicability or enforcement of other ordinances restricting, regulating, or
governing the subject matter herein.
SECTION IV:
All ordinances or portion of any ordinance of the City of Plainview, Texas, in conflict
herewith, are hereby amended to conform with the provisions hereof.
SECTION V:
This ordinance shall be of full force and effect upon its passage.
