HomeMy WebLinkAbout00-3250ZONING ORDINANCE - Case 689 (Street Closure) ORI)INANCE NO. 00-3250 AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF PLAINVIEW, TEXAS FOR CLOSING OF UTICA ST.: BETWEEN 6TM & 7TM STREETS, LYING EAST OF LOTS 1-7, INCLUSIVE BLOCK 57, AND 7TM ST. BEGINNING AT THE INTERSECTION OF UICA AND 7TM STREETS THENCE WEST TO THE ALLEY BETWEEN BLOCK 57 AND 58. ALL LOTS ARE LOCATED IN THE COLLEGE HII.L ADDITION, HALE COUNTY, PLAINVIEW, TEXAS CUMULATIVENESS CLAUSE; CONFLICT CLAUSE; SEVERABILITY CLAUSE; AND EFFECTIVE DATE. WHEREAS, Ordinance No. 89-2798 known as the City of Plainview Zoning Ordinance, sets forth in Section 5 the requirements for amending the zoning map of the City of Plainview, Texas; and WHEREAS, Wayland Baptist University has petitioned the City of Plainview to dose Utica Street' th th . · · ih . . ' Between 6 and 7 Streets, lying east of Lots 1-7, inclusive, Block 57, and 7 Street begmnmg at the intersection of Utica and 7th Streets, thence west to the alley between Block 57 and 58, Hale County, Plainview, TX; and WHEREAS, said hearing was held in the Council Chambers of the City Hall, Plainview, Texas, at which time persons appeared in support of or against said proposal; and WHEREAS, the proposed street closure, as hereinafter made, has been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council; and WHEREAS, it was determined by the City Council that this street closure would not be detrimental or injurious to the public health, safety of general welfare, or otherwise offensive to the neighborhood, said closure shall be in the manner hereinafter set forth in the body of this Ordinance; NOW, THEREFORE, the City of Plainview hereby ordains: SECTION I The request of Wayland Baptist University for closing of Utica Street: Between 6ih and 7th Streets, lying east of Lots 1-7, inclusive, BlOck 57, and 7th Street beginning at the intersection of Utica and 7th Streets, thence west to the alley between Block 57 and 58, Plainview, Hale County, Texas is approved; SECTION II Provisions of this ordinance are cumulative and nOthing herein shall prevent, alter, or diminish the applicability or enforcement of other ordinances restricting, regulating or governing the subject matter herein. SECTION III All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith, are Ordinance No. 00- Page 1 of 2 hereby amended to conform ff, ffh the provisions hereof. SECTION IV Should any section, subsection, or any portion hereof be deemed invalid for any reason, such holding shall not render or invalidate any other section, sub-section, sentence, provision, clause, phrase, or word severable therefrom and the same shall be deemed severable for this purpose. SECTION V This ordinance shall be of full force and effect upon its passage and publication as required by law. PASSED AND APPROVED this the.7Jday of qTl,a,~ 2000.
