HomeMy WebLinkAbout00-3238ZONING ORDINANCE - Zone Case 684 ORDINANCE NO. 00-3238 AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF PLAINVIEW, TEXAS FOR REZONING OF LOTS 1BT, BLOCK 57 (600 BLOCK UTICA); LOTS 5-6, BLOCK 41 (1900 BLOCK W. 6th ST.); LOTS 1-2, BLOCK 44 (2000 BLOCK W. 6t~ ST.); LOTS 7-8, BLOCK 41 AND LOTS 11-14, BLOCK 44 (500 BLOCK SMYTHE) FROM A SINGLE FAMILY RESIDENTIAL (R-I) AND COMMERCIAL RETAIL (C-2) ZONING DISTRICT TO A COLLEGE AND UNIVERSITY (U) ZONING DISTRICT ALL LOTS ARE LOCATED IN THE COLLEGE HI[,L ADDITION, HALE COUNTY, PLAINVIEW, TEXAS CUMULATIVENESS CLAUSE; CONFLICT CLAUSE; SEVERABILITY CLAUSE; AND EFFECTIVE DATE. WHEREAS, Ordinance No. 89-2798 known as the City of Plainview Zoning Ordinance, sets forth in Section 5 the requirements for amending the zoning map of the City of Plainview, Texas; and WItEREAS, Wallace E. Davis on behalf of Wayland Baptist University for rezoning of Lots 7-8, Block 41 and Lots 11-14, Block 44 (500 Block Smythe) from a Single Family Residential(R-l) and Commercial Retail (C-2) Zoning District to a College and University (I3) Zoning District, Hale County, Plainview, TX; and WHEREAS, said hearing was held in the Council Chambers of the City Hall, Plainview, Texas, at which time persons appeared in support of the proposal; and WHEREAS, the proposed rezoning, as hereinafter made, has been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council; and WItEREAS, it was determined by the City Council that this Re-Zoning would not be detrimental or injurious to the public health, safety of general welfare, or otherwise offensive to the neighborhOod, said Re-Zoning shall be in the manner hereinafter set forth in the body of this Ordinance; NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Plainview, Texas that: SECTION I The request of Wallace E. Davis on behalf of Wayland Baptist University for rezoning of Lots 7-8, Block 41 and Lots 11-14, Block 44 (500 Block Smythe) from a Single Family Residential (R-l) and Commercial Retail (C-2) Zoning District to a College and University (U) Zoning District, Ordinance No. 00-3238 Page 1 of 2 Plainview, Hale County, Texas is approved; SECTION II Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish the applicability or enforcement of other ordinances restricting, regulating or governing the subject matter herein. SECTION lli All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith, are hereby amended to conform with the provisions hereof. SECTION IV Should any section, subsection, or any portion hereof be deemed invalid for any reason, such holding shall not render or invalidate any other section, sub-section, s~entence, provision, clause, phrase, or word severable therefrom and the same Shall be deemed severable for this purpose. SECTION' V This ordinance shall be of full force and effect upon its passage and publication as required by law. PASSED AND APPROVED this the 22"d day of February, 2000.
