Specific Hse Permit ORDINANCE NO. 99-3217 AN ORDINANCE AUTHORIZING THE ISSUANCE OF A SPECIFIC USE PERMIT TO OPERATE A MOTOR FREIGHT TERMINAL IN A COMMERCIAL RETAIL(C-2) ZONING DISTRICT GENERALLY KNOWN AS 2801 OLTON RD., CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; SEVERABILITY CLAUSE; AND EFFECTIVE DATE. WHEREAS, Ordinance No. 89-2798, known as the City of Plainview Zoning Ordinance, sets forth in Section 33 the requirements for obtaining a specific use permit; and WHEREAS, Wal-Mart Properties has requested a Specific Use Permit to operate a motor freight terminal in a Commercial Retail C-2 Zoning District generally known as 2801 Olton Rd. Plainview, Texas, County of Hale; and WHERE/kS, notice of a public hearing to discuss the issuance of said permit was published in the Plainview Daily Herald before the 15th day prior to the hearing date; and WHEREAS, said heating was held in the Council Chambers of the City Hall, Plainview, Texas, at which time persons appeared in support of the proposal; and WHEREAS, the proposed issuance of a specific use permit, as herein after made, has been duly presented to the Planning and Zoning Commission for its recommendation, which was received by the City Council; and WHEREAS, it was determined by the City Council that issuance of the Specific Use Permit would not be detrimental or injurious to the public health, safety or general welfare, or otherwise offensive to the neighborhood, said Specific Use Permit shall issue in the manner hereinafter set forth in the body of this Ordinance is approved; NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Plainview, Texas that: SECTION I The request of Jabo Floyd on behalf of Wal-Mart Inc., for a Specific Use Permit, to operate a Motor Freight Terminal in a Commercial Retail (C-2) Zoning District, said parcel of land being Block 86, 360'x752' Tract, College Hill Addition, City of Plainview, Hale County, Texas same being 2801 Olton Road, under the following conditions: 1. Incoming truck traffic shall access the facility at 2801 Olton Road via IH 27, travel east on Highway 70/Olton Road to location. Outgoing traffic shall depart the facility by traveling east on Highway 70/Olton Road, to Quincy Street. 2. All truck traffic shall enter and exit the facility parking lot from Highway 70/Olton Road. Canyon Street, West 4th Street, and Amarillo Street shall not be used for this purpose. 3. Hours of Operation shall be restricted to 7:00AM to 6:00PM Central Standard Time. 4. Truck traffic shall be kept to not more than 20 trucks daily. 5. No tractor-trailer or trailers shall be left standing on the facility parking lot overnight. 6. The Spedfic Use Permit shall expire in twenty-four (24) months, after the effective date of this ordinance in accordance with the provisions of Section 33, of the City of Plainview Zoning Ordinance. 7. No trucks shall travel on 5th street between Amarillo street and Yonkers street. Page 1 of 2 SECTION II Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish the applicability or enforcement of other ordinances restricting, regulating or governing the subject matter herein. SECTION III All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith, are hereby amended to conform with the provisions hereof. SECTION IV Should any section, subsection, or any portion hereof be deemed invalid for any reason, such holding shall not render or invalidate any other section, sub-section, sentence, provision, clause, phrase, or word severable therefrom and the same shall be deemed severable for this purpose. SECTION V This ordinance shall be of full force and effect upon its passage and publication as required by law. PASSED AND APPROVED this the day o~g~1999.
