ORDINANCE NO. 99-3216
AN ORDINANCE OF THE CITY OF PLAINVIEW,
TEXAS AMENDING CHAPTER 20 OF THE
PLA1NVIEW CODE OF ORDINANCES
SEVERABILITY CLAUSE; CUMULATIVENESS
CLAUSE; CONFLICTS CLAUSE; AND EFFECTIVE
DATE.
WHEREAS, The City Council of the City of Plainview finds it in the best interest of
the citizens of Plainview to adopt the most recent edition of the Uniform Plumbing Code
copyrighted in 1997, by the International Association of Plumbing & Mechanical Officials,
Walnut, California,
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of
Plainview, Texas that:
SECTION I:
Licensed Irri.qator: A person licensed by the Texas Board of Irrigators under the
Licensed Irrigators Act, Article 8751, Section 7, Vemon's Texas Civil Statutes who sells,
designs, consults, installs, maintains, alters, repairs or services an irrigation system
including the connection of such system in and to a private or public, raw or potable
water system or any water supply.
SECTION II.
Section 20-95 (d) of the Plainview Code of Ordinances is hereby amended to add the
following:
(d) Any property owner for plumbing work to be done by him in a building owned and
occupied by him as his homestead.
SECTION III.
Section 20-99 of the PlainView Code of Ordinances is hereby ddeted in part and amended to
add the following:
Applications for permits either by phone or in person by the contractor must be secured prior
to commencement of any work. Contractors may pay in advance or apply for an account to be paid
once a month. Contractor's will be billed monthly. If an approved contractor fails to pay their
accounts within 15 days after the date of the billing statement, no permits can be issued to the
contractor until the past due account has been paid in full. Fees are as follows:

SECTION IV.
Section 20-130 of the Plainview Code of Ordinances is hereby amended as follows:
Sec. 20-130. Standard: 1997 Uniform Plumbin.q Code Incorporated by Reference.
All installation hereafter installed within the corporate limits of the City of Plainview shall be
done in a first class workmanlike manner in accordance with the 1997 edition of the Uniform
Plumbing Code as adopted at the sixty-seventh annual conference of the International Association
of Plumbing and Mechanical Officials, and said Uniform Plumbing Code is made a part of this
Ordinance, with the additions and deviations therefrom contained in this code. (Ord. No. 96-3072,

SECTION V.
Section 20-131 of the Plainview Code of Ordinances is hereby deleted in part and amended
to read as follows:
Sec. 20-131. Conformance with code.
(a) All plumbing systems hereafter installed shall conform with the provisions of the 1997
Uniform Plumbing Code and the amendments to that code as follows:

Amendments to the 1997 Uniform Plumbin.q Code:
Section 102.3.2 is amended to read as follows:
Any person, firm, or corporation violating any provision of this Code shall be deemed
guilty of a Class C misdemeanor, and upon conviction thereof, shall be punishable of a fine not

to exceed $2000.00 per offense. Each separate day or any portion thereof, during which any
violation of this Code occurs or continues, shall be deemed to constitute a separate offense.
Section 103.4.1 is amended to read as follows:
The fee for each permit shall be set forth in Section 20-99 of the Plainview Code of
Ordinances.
Section 103.4.2 is hereby deleted
Section 103.4.3 is hereby deleted
Section 103.4.5.3 is hereby deleted
Section 103.5.1.1 is amended to add the following requirements:
The following inspections shall be required for all plumbing installations in any building or
structure:
(a) Rough-in and sewer: All water, waste, vent, gas, and drainage piping installed below
grade.
(b) Stackout: A visual inspection of all water, waste, vent, gas piping installed above the
floor.
(c) Final: To be made after all plumbing work is completed and the building or structure
is ready for occupancy; and
(d) Water Service Inspections: In accordance with State Laws requiring a water
purveyor to perform certain inspections of its customers facilities, the property owner shall
allow his property to be inspected for possible cross connections and other illegal plumbing
practices. These inspections shall be conducted prior to initiating service and after any
changes to the plumbing system which require a permit and inspection.
The property owner and tenant shall be notified in writing of any cross connection or other
illegal plumbing practice which has been identified during the inspection.
The property owner shall immediately have any illegal plumbing installation on his premises
corrected.
The property owner shall cause all backflow prevention devices required by the code to be
installed, tested and maintained in accordance with this code.
Copies of all testing and maintenance records shall be provided to the City of Plainview
Building Inspections Department.
(e) Reinspection: When additional inspections are necessary due to plumbing
installations not being completed or meeting code requirements when requested for inspection.
Table 1-1, Plumbing Permit Fees is hereby deleted
Section 402.1 is hereby amended to read as follows:
No plumbing fixture shall be installed which has a discharge rating, measured in
gallons per minute (GPM) or gallons per flush (GPF) in excess of the following:

Sections: 402.2, 402.3, 402.4, 402.5, 402.6, 402.7, 402.8 are hereby deleted.
Section 413.0 - 413.7 and table 4-1 are hereby deleted.

Section 603.4.6.1 through Section 603.4.6.4 are amended by adding the following to the
end of each section:
Double check valve assembly
Section 604.1 is amended to add the following:
CPVC water pipe and tubing shall not be installed under any concrete floor slab on
grade construction.
Section 608.5 is amended to allow T & P valve drain to condensate drain trap, or other drain
tra ps.
Section 609.1, the last sentence thereof, is amended to read as follows:
The minimum cover shall be eighteen (18) inches below finished grade.
Section 609.10 is amended by adding the following exception:
Exception: One and two family residences
Section 610 is amended to allow 3/4 inch supply water to single family residential, as a
standard service line.

Section 707.4 Exception (1) is amended to read as follows:
A clean out may be omitted on a horizontal drain line less than five (5) feet in length
said line serves a sink, urinal, or washing machine.
Section 807.4 is hereby deleted in its entirety.
Section 910.1 is amended to read as follows:
Combination waste and vent systems shall be permitted only where structural
conditions preclude the installation of conventional systems as otherwise prescribed by this
Chapter. All combination waste and vent systems must be approved by the Building Official or
the Plumbing Inspector prior to installation. In no event shall a combination waste and vent
system be used in a commercial kitchen installation. A commercial kitchen installation must
comply with Section 1014.5.
Section 1101.1 is amended by adding the following:
Direct connection to the city storm sewer system shall not be made.
Section 1101.5 the first sentence thereof is amended as follows:
Where sub-surface groundwater is present subsoil drains may be required around the
perimeter of buildings having basements, cellars, or crawl spaces, or floors below grade.
Section 1204.3.2 is amended to require gas line tests to be 10 inches of mercury.
Exception: 6 inches of mercury may be allowed by the plumbing inspector when conditions warrant.
Section 1204.5 is amended to add:
(a) Unvented gas-buming room heaters equipped with an Integral Oxygen Depletion
Sensing System (ODS) may be installed in Group R-3 occupancies if the unit is certified by an
approved scientific testing laboratory and it is installed in accordance with the National Fuel Gas
Code as copyrighted in 1992 by the American Gas Association, 1515 Wilson Boulevard, Arlington,
VA 22209.

(b) Existing gas-burning unvented room heater(s) installed in R-3 occupancies
which do not comply with code requirements shall be removed or replaced with vented or other
approved heaters when alterations or remodeling of the structure occur which would require a
building permit, or when a city pressure test is required on the gas line system. Additionally all gas
outlets for room heaters in bathrooms and bedrooms shall be capped.
EXEMPTION: Homeowners that are living in their homestead are exempted from
the requirement of removing the non-approved heaters when a pressure test of the gas line is done.
However, the requirements to re place unvented heaters shall be enforced when a building permit
is required.
Section 1211.3 is amended to read as follows:
No gas piping or gas service entrance shall be installed in or on the ground under any
building or structure. The term "building or structure" shall include structures such as porches
and steps, whether covered or uncovered, breezeways, roofed porte-cacheres, roofed patios,
carports, covered walks, covered driveways, and similar structures or appurtenances.
Section 1211.16 is amended with exception as follows:
Exception: One and two family dwelling units where the gas line from the meter to the
connection at the building does no vary more than 22-112 degrees.
Table 14-1 is amended to add the following footnotes:
8/Cellular core PVC pipe shall be limited to exterior buried installations only.
9/PVC piping used in water distribution systems shall utilize schedule 40 or heavier
pipe except that commercial and residential sprinkler and landscaping irrigation systems may
utilize PVC 200 psi pipe downstream from the double check valve assembly.
Adoption of Plumbing Code appendix
The following appendix chapters of the 1997 Uniform Plumbing Code are hereby
adopted:
Appendix A, Recommended rules for sizing the water supply system
Appendix B, Explanatory notes on combination waste and vent systems
Appendix D, Rainwater systems
Appendix E, Manufactured/mobile home parks and recreational vehicle parks
APPENDIX E is amended forbidding gas piping to be installed under ground under any
mobile home. (Amendments adopted Ord. No. 96-3072, 5-28-96)
Appendix G, Graywater systems for single family dwellings
Appendix h, Recommended procedures for sizing commercial kitchen grease
interceptors
Appendix I, IS 1 through 9, 11 through 13, 16, 18, 20 and 21
Appendix J, Reclaimed water systems for non-residential buildings
Appendix L, Alternative Plumbing Systems
SECTION VI.
Section 20-141 of the Plainview Code of Ordinances is hereby amended to read as follows:
The materials used shall conform with the standards set forth in the 1997 edition of the
Uniform Plumbing Code, unless amended in this ordinance. (Ord. No. 85-2587, 2-25-85)

Section 20-143 of the Plainview Code of Ordinances is hereby amended to read as follows:
Materials other than those listed in the 1997 Uniform Plumbing Code may be permitted upon
approval of the Plumbing Appeals and AdviSory Board. (Ord. No. 85-2587, 2-25-85) (Repealed Ord.
No. 96-3072, 5-28-96)
SECTION VIII.
Section 20-144, Materials and Uses Table of the Plainview Code of Ordinances is hereby
deleted.
SECTION IX.
If any section, subsection, sentence, clause, phrase, or portion of this ordinance is, for any
reason, held invalid or unconstitutional by any court of competent jurisdiction, such portion
shall be deemed a separate, distinct, and independent provision and such holding shall not
affect the validity of the remaining provisions thereof.
SECTION X.
Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish
the applicability or enforcement of other ordinances restricting, regulating, or governing the
subject matter herein.
SECTION XI.
All ordinances or portion of any ordinance of the City of Plainview, Texas, in conflict
herewith, are hereby amended to conform with the provisions hereof.
SECTION XII.
This ordinance shall be of full force and effect upon its passage.
