ORDINANCE NO. 99-3204
AN ORDINANCE OF THE CITY OF PLAINVIEW
REGULATING AND CONTROLLING THE MAINTENANCE
OF BUILDINGS AND PREMISES; TO SAFEGUARD LIFE,
HEALTH, PROPERTY AND PUBLIC WELFARE BY
REGULATING THE STORAGE, USE AND HANDLING OF
DANGEROUS AND HAZARDOUS MATERIALS,
SUBSTANCES AND PROCESSES, AND BY REGULATING
THE MAINTENANCE OF ADEQUATE EGRESS FACH JTIES,
PROVIDING FOR THE REPEALING OF ORDINANCE NO.
88-2765 OF THE CITY OF PLAINVIEW; PROVIDING FOR
THE ADOPTION OF THE UNIFORM FIRE CODE, 1997
EDITION, INCLUDING THE 1997 UNIFORM FIRE CODE
STANDARD ARTICLE 10, ARTICLE 24, ARTICLE 52,
ARTICLE 62, ARTICLE 74, ARTICLE 79. THE
INTERNATIONAL CONFERENCE OF BUILDING
OFFICIALS OF WHITTIER, CALIFORNIA, PROVIDING
FOR CERTAIN AMENDMENTS THERETO; PROVIDING
PENALTIES FOR THE ~OLATION THEREOF; PROVIDING
A SEVERABILITY CLAUSE; DIRECTING THE
PUBLICATION OF THE DESCRIPTIVE CAPTION OF THIS
ORDINANCE, TOGETHER WITH THE PENALTY
PROVISION; AND PROVIDING AN EFFECTIVE DATE OF
THIS ORDINANCE.
WHEREAS, the City Council of the City of Plainview finds that the present Fire Code of the City of
Plainview is inadequate to properly protect the public health, safety, and welfare of the citizens of the
City of Plainview and their property, from loss due to fire; and
WHEREAS, the City Council appointed the Fire Code Board of Appeals to prepare recommendations
for the City Council in regard to a new Fire Code; and
WHEREAS, the Fire Code Board of Appeals recommends the Uniform Fire Code, 1997 Edition, with
certain amendments thereto, be adopted as the Fire Code of the City of Plainview.
NOW THEREFORE BE IT ORDAINED by the City of Plainview, Texas that the following section
of the Plainview Code of Ordinances be amended as follows:
Section 11 - 10 (e)
The owner, manager or person in charge of any building to which fire lanes or turn-arounds

have been designated by the fire marshal or his designated representative shall post and maintain
appropriate signs in conspicuous places along such fire lanes or turn-arounds stating "No Parking -
Fire Lane" and one designating "Tow Away Zone." The fire marshal or his duly authorized
representative or the chief of police or his authorized representative is hereby authorized to cause
such streets, fire lanes and turn-arounds to be maintenance free and unobstructed at all times for fire
department uses. "Appropriates signs" required in these sections shall consist of white letters painted
on a red background located along one side of the fire lane easement at 25 foot intervals or as the fire
marshal or his designated representative may determine. Those letters shall be not less than three (3)
inches in height, as to "No Parking," not less than two (2) inches in height, as to "Fire Lane," and not
less than (1) inch in height as to "Tow Away Zone." A solid red stripe shall be placed along one side
of the fire lane easement.
Section 11-51
The 1997 Edition of the "Uniform Fire Code," as copyrighted in 1997, by the International
Conference of Building Officials of Whittier, California, as hereinafter amended, is specifically
adopted as the Fire Code of the City of Plainview, Texas, and a copy is attached hereto and
incorporated herein by reference as though set out completely in detail. A copy of said Uniform Code
shall be filed with the city secretary, and a copy maintained in the office of the fire marshal. All such
copies are to be open to public inspection during business hours of the office where they are

Section 11-52 {}2.303 (b)
Part VIII, Article 90, Section 9002 of the Uniform Fire code, 1997 Edition, shall be and the
same is hereby amended by addition to the list of recognized Standards as part of the list, of the 1997
Edition of the "Life Safety Code," N.F.P.A. 101, copyrighted 1997.
Section 11-52 {}4.101
Part I, Article I, Section 105 of the Uniform Fire Code, 1997 Edition, shall be and the same
is hereby amended by deleting requirements for permits. No permit shall be required when referred
to in this Code.
Section 11-52 {}79.501
Part VII, article 79, Section 7904.2.5.4.2 of the Uniform Fire Code, 1997 Edition, shall be
and the same is hereby amended to read as follows: "The limits in which storage of Class I and Class
II liquids in outside above ground tanks is prohibited in any residential district, as set out by the
Zoning Ordinance of the City of Plainview, as amended.

Section 11-54
It shall be unlawful for any person to keep, park and leave unattended any tank truck or
portable tank used for the purposes of transporting anhydrous ammonia, gasoline or any other
inflammable or combustible liquids, or any other gaseous substance that is harmful to humans if
inhaled, within one hundred tiff7 (150) feet of any residence or house in the city, in which persons are
living and using as a place of abode. (Ord. No. 71-1186, §1, 7/19/71).
