NO: 89-2803 AN ORDINANCE CALLING AND ORDERING A RUN-OFF ELECTION IN AND FOR THE CITY C)F PLAINVIEW TO BE HELD ON THE SECOND SATURDAY IN SEPTEMBER, 1989,.-.THE SAME BEING THE NINTH DAY OF SEPTEMBER, 1989, AS THE DATE FORA RUN-OFF ELECTION.. BETWEEN TWO CANDIDATES WHO RECEIVED IN THE SPECIAL ELECTION HELD ON THE SECOND SATURDAY IN AUGUST, 1.989, THE HIGHEST .NUMBER OF VOTES FOR PRECINCT NO. 6; DESIGNATING. THE PLACE WHERE SAID ELECTION IS TO BE HELD; APPOINTING. .ELECTION OFFICIALS; SETTING HOURLY RATE FOR ELECTION OFFICIALS; AND POSTING NOTICE OF ELECTION.. WHEREAS, after a canvaas of the votes cast at said Special Election the Mayor and City Council have found that none of the candidates for City Council Precinct No. 6 received a majority of the votes cast,for said office at said election, and that at such election the two candidates receiving the highest number of votes are Robert E. Carter and Dwain Dodson, and that,. therefore, it is necessary to ,call and conduct a Run-Off Election between said candidates, Robert E.- Carter and Dwain Dodson for the purpose of electing a Councilmember for the City of Plainview City Council Precinct No. 6. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Plainview, Texas: Section 1. Run-Off Election. In accordance with the statutes and laws of the State of Texas, and the Charter of the City of Plainview, a Run-.Off Election shall be held in and for the City of Plainview on the second Saturday in September, 1989, the same being the 9th day of September, 1989, for the purpose of conducting a Run-Off Election between, Robert E. Carter and Dwain Dodson, the two candidates receiving the .highest number of votes for the office of City Council of the City of Plainview at the Special Election of said City held on August 12, 1989, neither of them having received a majority of the votes cast for said office. All persons: qualified to vote in said City under the Election, Laws of the State of Texas shall be allowed to vote. Said election shall be held in the polling place designated in Section 2 of this Ordinance, and shall be open from 7.:00 A.M, to 7:00 P.M., and all electors shall vote in the voting precinct in which said voter resides, and the place provided for voting as designated in Section 2 of this Ordinance. Absentee voting will be conducted at the Gity Secretary's Office at City Hall, 901 Broadway, Plainview, Texas, commencing on the 24th day of August, 1989 and ending on the 5th day of September, 1989. 1 of 4 ~~ Section 2z Precinct and Polling Place. That-said election shall be held in the designated precinct within the City and. at , the designated polling place within the precinct as designated by Section 9 of the Charter of the City of Plainview, Texas. Precinct 6: Plainview High School, 1501 Quincy, Plainview, Texas. Votng'Precinct Six (6) is described more fully as follows. Beginning at a point of intersection of the North line of West 9th Street and the West .line pf Joliet Street; Thence North along said :West lane of Joliet Street to a point of intersection with the South line of 13th Street; Thence West along said South. .line of West 13th Street to a point of intersection with the West line of Portland_Street; Thence North along said West line of Portland Street. to a paint of intersection with the South line of West 16th Street; Thence West along the said South line of West 16th Street to a point of .intersection with the West line of Quincy Street; Thenice North along said West line of Quincy Street to the South line of West 17th Street; Thence West along said South line of West 17th Street to a point of interrsection with the East line of Smyth. Street; Thence South along said East line of Smyth Street to a point of intersection with the South line of West 16th Street; Thence West along_said South-line of-West 16th Street to a point of intersection with the East line of Floydada Street; Thence South along said East line of Floydada Street to a point of intersection with'the North line of West 11th Street; Thence East along said North line of West 11th 'Street to a point of intersection with the East line of Canyon Street; Thence South along said East line of Canyon Street to a paint of intersection with the North line of West 10th Street; Thence East along said North line of West 10th. Street to a point of intersection with the East line of Quincy Street; Thence South along said East line of Quincy .Street to a point of _ intersection with the North line of West 8th Street; ~~ Thence East along the said North line of. Section 3: Election Official. Said election shall be conducted by the fallowing presiding judge who is hereby appointed to hold said election. Precinct 6: Mary .Sherman Mary Sherman .and Nova Sherman are hereby appointed- as the election officials-of Precinct 6. Mary Sherman shall act as the presiding judge of Precinct 6, and Nova Sherman is hereby appointed first alternate judge, to act as presiding judge of Precinct 6 in the event that Mary Sherman is for any reason unable to .serve as such presiding judge. Mary Sherman is hereby appointed as the Presiding Judge of the Absentee Ballot Board. It is further prouided that the maximum .number of clerks which shall be appointed to serve in .said election shall not be in excess of 3 '~_~.~ persons for each precinct.: Section 4: Hourly Rate for Election Officials. It is further provided that the hourly rate for Presiding Election Judges shall not exceed` $5.OO per hour, and the hourly rate for Clerks shall .not exceed $4.OO per hour.. The compensation for the delivering of .election records and unused election supplies shall-not exceed an amount o£ $25.00. Section 5c Posting Notice of Election. Notice of said erection shall be given by posting and by publication of a copy of this ordinance, and at the top. of which shall appear the words "Notice of Special Election". Nat later than the 15th day before said election,. notice shall be given by posting a copy of this ordinance in three public places in said City of P3ainview, and in the voting precinct. Notice by publications shoal also be made by publishing notice of said election in the Plainview Daily Herald, said publication not to be more than thirty days nor less than ten days prior to the election. Section 5: Ordinance to Election Officials. Par cansiguiente, despues del escrutinio de los votos del tal eleccion, el Mayor y_Consejo de la ciudad hen establecido que una eleccion de los candidates pare cansejo de la ciudad precinto no. 6 que recibieron la mayoria de votos Para tal puesto en tal eleccion, y en, que tal eleccion los dos candidates recibieron los mas alto numeros de votos Robert E. Carter y Dwain Dodson., y que, par 1o tamo,_es necesardo llamar y conducir una eleccion de empate entre tal candidatos, Robert E. Carter y Dwain Dodson con el propostio un miembro de cansejo Para la ciudad de Plainview precinto no. 6. Seccion 1. Eleccion de Empate. En acuerdo con dos estatutos y-leyes del estado de Tejas, y la Carta constitucional de Ia .Ciudad de Plainview, una Eleccion de Empate se llevara acabo en, y pare lacinda y de Plainview en el Segundo Sabado en Septiembre, 1989, el mismo siendo el die nueve de Septiembre, 1989, con el proposito de conducir una- eleccion de empate entre, Robert E. Carter y Dwain Dodson, los dos candidates que reciban el numero mas altq de votos pare el puesto del consejo de la Ciudad de .Plainview en la eleccion. especial de tal ciudad, que se llevara a Cabo en Agosto 12, 1989, ninguno de ellas recibiendo la mayoria de votos-pare tal puesto. Todas los personas calificados Para votap en tal ciudad bajo ias leyes de Eleccion del Estado de Texas deberan ser permitidos voter. Dicha eleccion se llevara acabo en los casllas designadas en la Seccion 2 de esta ordenanza, y de beran ser abiertos de 1as 7.:00 A.M. a las 7:00 P.M. , y todas los electores deberan voter en el recinta de votacion en el cual tal votante reside, yel lugar proveido par eleccion coma. se designa en la Seccion 2 de esta ordenanza. Votacion en ausencia se llevara acado en la oficno de la Secretaria de la Ciudad, en el edificio municipal, 901 Broadway, Plainview, Texas, comensando el die 24 de Agosto,-1989 y terminardo el die 5 de Septiembre, 1989. Noticia por publicacion se dares tambien par publicando notices de tal eleccion en el Plainview Daily Herald, tal publicacion no puede estar mss que trienta Bias ni menos que dez Bias antes de tal eleccion.
