ORDINANCE NO. 98-3201
AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS, AMENDING SECTION
24-158 OF THE CODE OF ORDINANCES TO ESTABLISH A MAXlMUM RATE
OF SPEED FOR VEHICLES TRAVELING NORTHBOUND AND SOUTHBOUND
ON COLUMBIA STREET, SAlD STREET IS ALSO KNOWN AS INTERSTATE
HIGHWAY 27 BUSINESS ROUTE (BI 27-U); PROVIDING FOR A PENALTY;
CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; SEVERABILITY CLAUSE;
AND EFFECTIVE DATE.
WHEREAS, the City Council of the City of Plainview, upon the basis of engineering and
traffic investigation, finds it necessary to establish a maximum speed limit on Columbia Street,
Interstate Highway 27 Business Route (BI 27-U) for traffic traveling northbound and southbound
within the corporate limits of the City of Plainview, Texas; and
WHEREAS, the City Council finds it in the best interest of the public safety of the citizens
of the City of Plainview to amend § 24-158 to reflect these changes; and
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Plainview,
Texas that:
Section 1: The speed limit on Columbia Street also known as Interstate Highway 27
Business Route, (BI 27-U), within the City limits of Plainview, at the following designated locations
shall be amended in the PlainView City Code of Ordinance (§ 24-158) and said speed limits shall be
as follows:
(a) Beginning at the point of intersection with the North City Limit, a point 1.565 miles north
of the point on intersection with the center line of West 29th Street, the_maximum legal speed limit
for both southbound and northbound traffic shall be 60 mph for a distance of 1.465 miles, a point
0.100 miles north of the centerline of 29th Street; thence 55 mph for a distance of 0.308 mile, a point
0.105 mile north of the centerline of 24th Street; thence 50 mph for a distance of 0.671 mile, a point
0.162 mile north of the centerline of 13th Street; thence 40 mph for a distance of 0.277 mile, a point
0.065 mile north of the centerline of 11th Street intersecting from the west; thence 35 mph for a
distance of 0.632 mile, a point 0.043 mile north of the centedine of west 4th Street; thence 50 mph
for a distance of 0.319 mile, a point 0.219 mile north of the centefline of Southwest 3ra Street; then
55 mph for a distance of 0.654 mile, a point 0.054 miles south of the centerline of Southwest l0th
Street intersecting from the east; thence 60 mph for a distance of 0.404 mile, a point 0.220 mile north
of the centerline of Southwest 20th Street; thence 65 mph, as established by the Texas Transportation
Commission"s Minute Order Number 107691 dated November 19, 1998 for a distance of 0.712 mile,
a point 0.492 mile south of the centerline of Southwest 20~ Street which corresponds with the south
corporate limes of Plainview, Hale County, Texas.
(b) The symbol "mph" as used in this Ordinance is a symbol for and means "miles per hour".

Section II
Any person who shall violate or fail to comply with the provision of this ordinance shall be deemed
guilty of a misdemeanor and upon conviction thereof, shall be punished by a fine of not less than
$1.00 and not more than $200.00.
Section III
Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish the
applicability or enforcement of other ordinances restricting, regulating or governing the subject matter
herein.
Section IV
All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith, are
hereby amended to conform with the provisions hereof.
Section VI
Should any section, subsection, or any portion hereof be deemed invalid for any reason, such holding
shall not render or invalidate any other section, sub-section, sentence, provision, clause, phrase, or
word severable therefrom and the same shall be deemed severable for this purpose.
Section VII
This ordinance shall be of full force and effect upon its passage and publication as required by law.
