HomeMy WebLinkAbout98-3191ORDINANCE NO. 98-3191 AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS AMENDING SECTION 25-251 OF THE CODE OF ORDINANCES TO ESTABLISH CERTAIN STREETS IN THE CITY OF PLAINVIEW AS TRUCK ROUTES FOR INTER- CITY AND INTRA-CITY TRAVEL; PROVIDING FOR A PENALTY; CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; SEVERABILITY CLAUSE; AND EFFECTIVE DATE. WHEREAS, the City Council of the City of Plainview, upon the basis of annexation, expansion of economical development, and street improvements, finds it necessary to eliminate the following roads or streets as Truck Routes within the corporation limits of the City of Piainview, Texas; and WHEREAS, the City Council finds it in the best interest of the public safety of the citizens of the City of Plainview to amend §24-251 to reflect these changes; and NOW, THEREFORE, the City of Piainview hereby ordains: SECTION I Section 24-251 is amended as followed: The following streets and portions of streets in the city are hereby designated as truck routes for ali trucks and motor vehicles having a gross tonnage in excess of one ton: Streets Columbia Street Date Street (FM 400) Dimmitt Road, Northwest (US Highway 194) Milwee Street Quincy Street 11th Street 5th Street and (US Highway 70) Olton Road (US Highway 70) 16th Street 24th Street Industrial Blvd Farm Market 3466 Extent Entire length Entire length Entire length From US 70 to E 9th Street Industrial Blvd to SW 3rd Street From Date St. to Columbia St. From Yonkers Street to East City limits From Yonkers Street to West City Limits From Date St. to East City Limits From Date St. to State Hwy 194 Entire length Entire length Section H Any person who shall violate or fail to comply with the provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof, shall be punished by a fine of not less than $1.00 and not more than $200.00 Section III Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish the applicability or enforcement of other ordinances restricting, regulating or governing the subject matter herein. Section IV All ordinances or portions of any ordinances of the City of Plainview, Texas in conflict herewith, are hereby amended to conform with the provisions hereof. Section V Should any section, subsection, or any portion hereof be deemed invalid for any reason, such holding shall not render of invalidate any other section, sub-section, sentence, provision, clause, phrase, or word severable therefrom and the same shall be deemed severable for this purpose. Section VI This ordinance shall be full force and effect upon its passage and publications as required by law.
