HomeMy WebLinkAbout98-3169PARKS AND RECREATION - Fee Amendment Ordinance No. 98-3169 An Ordinance amending Section 18,1, entitled Fees and Charges; of the Code of Ordinances of the City of Plainview, Texas; Severability clause; Cumulativeness clause; Conflicts clause; And effeCtive date. WHEREAS, on April 22, 1975 the Plainview City Council; through the adoption of Ordinance No. 75- 1801, established the requirement for fees and charges for the use of parks facilities; WHEREAS, resolutions 94-120 and 95-100 set fees and charges for the use of parks facilities; WHEREAS, the Mayor and City Council has determined there is a need to adjust the current fees to properly maintain the parks facilities; WHEREAS, it is the desire of the Mayor and City Council that the parks continue to provide an enjoyable experience for the citizens of the City of Plainview and the surrounding area; THEREFORE BE IT RESOLVED, THE CITY OF PLAINVIEW HEREBY ORDAINS that Section 18-1 of ttie Code of Ordinances is hereby amended and henceforth shall read as follows: SECTION I Section 18-1 FEES AND CHARGES; The fees and charges to be imposed by the city for the use of the Broadway Shelter House, Regional Park Rotary Building and Joliet Street Community Center when used for the special benefit of the user shall be as folloWs: Use by public: Use by corporations: Use by any organization hosting a dance: Use by a Not for Profit organization: Damage and cleanup deposit: Use of one electrical panel: $75.00 $100.00 $100.00 $5O.OO $100.00 $25.OO These fees apply to each day of use by the individual or group using the facilities. The damage and cleanup deposit is refundable as recommended by the City Manager or his/her designee. The City Manager and his/her designee shall establish procedures necessary for the user to receive the deposit. The refund procedures and requirements will be posted in the buildings and provided to the user at the time a contract is signed Page 1 of 2 SECTION H Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish the applicability or enforcement of other ordinances restricting, regulating or governing the subject matter herein. SECTION IH All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith, are hereby amended to conform with the provisions hereof. SECTION IV Should any section, subsection, or any portions hereof be deemed invalid for any reason, such holding shall not render or invalidate any other section, subsection, sentence, provision, clause, phrase, or word severable therefrom and the same shall be deemed severable for this purpose. SECTION V With the exception of any contraCts in effect prior to the adoption of this ordinance, this ordinance shall be of full force and effect upon its passage and publication as required by law.
